I am the mother......can I just move? or do I have to go to court?

Motorcycle Passenger age restriction?

My son who is almost 5 has been riding with my husband on his motorcycle since he was 3 years old with full protective gear special pegs and everything with no problem . We would pass cops and they would just smile and wave. Even before we put him on the bike we looked up the laws of age restriction and all the laws required to carry a Passenger in Oklahoma and have followed every one.. Of course we do not go 65 miles down the highway with him we go around the local park at 15/20 miles an hour. I know everyone has a different opinion on whats safe for a child and I totally respect that. My problem is today my husband was pulled over by an officer that told him that any child under the age of 6 had to be in a car seat. Which KUDOS for him it is, in a CAR. He did not get a ticket in my opinion because he couldn't because there is no age restrain he probably just though it was unsafe for my son to be on the motorcycle which is fine. I understand that. However he told him if he caught him again that he would call child protective services and nail his @SS to the wall. Any opinions ? Advice ? Resources?

You can ask for a restraining order for any reason. The Judge has the final say if it has legal merit to it.You will need to show a pattern of actions that would cause a reasonable person to be in fear for life and safety.I don't mean to sound dismissive, but the system around these orders is heavily abused by people. It is often used as a tactic in divorce and custody issues. Judges often give them out like candy to avoid any potential bad press if something happens and they had denied a request.With all of that said, there are 2 things you need to know. A restraining order is nothing more than a piece of paper. If someone wants to hurt you, it cannot stop anyone if they are determined. So on top of the order, you need to take all of the precautions to protect yourself including using abuse shelters if needed. Its not over immediately after the gavel fall in court.Get the order if you need it. But you need to follow all of the other advice you will be given when you file the paperwork. Can my parents put a restraining order on my boyfriend?

My boyfriend and I have been dating on and off for nearly two years, and have recently started having sex (as in the past 6 months). However, my dad found out back in July '13 and threatened to put a restraining order on him if we were to speak again. Naturally, we completely ignored him and went on dating behind my parents' backs anyways. His parents knew about us being together as of last month, and my parents found out today through a text message i sent to my friend about us having sex. Being my dad's only product of two marriages, i understand why he's being protective, but i think it's dumb to take away one of the most supportive and caring people in my life just because of sex. We've always been careful and used protection.
Anyways, my dad threatened yet again to put a restraining order on him and sue him, but i'm not sure for what. The only one i could think of would be statutory rape, i'm 17 as of november and he is 19 as of november, but according to Ohio laws i am of age of consent.
He's a great guy, he's never hurt me or done me wrong. Sure, we've had our fair share of arguments, but every couple does. He's going back to college, Miami of Ohio, this friday.

Yes, they both violate Constitutional Rights.

Little by little our rights are going to be stripped away. It is going to happen with such subtlety that we won't even notice.

First the sex offenders, then the drug dealers, then the attempted murderers... there will be lists for everyone eventually. Just like the Scarlet Letter. And because the majority justify it and are brainwashed that it is a necessity, they will allow it to happen.

The Sex Offender list denies those on it Due Process of the Law. They are being punished for a crime that they "might" commit one day. So much for "beyond a reasonable doubt." I agree that pedophiles might be a danger, but many people on the list are not pedophiles, although the ignorant people (even many that answered your question), don't know the difference between a pedophile and a sex offender.

They are not synonyms. They should be judged on a case by case basis on whether they are actual threats to society. But I guess the judicial system is just too lazy so they throw them all on the list and stereotype them.

I am 16.My parents put a restraining order on my boyfriend who is 18, against myself, my school, and my home because I brought him over my house a couple times and a neighbor that was my dad's friend told my dad. The restraining order was put in by domestic violence but there never was any. Right now it is a temporary court order restriction, and the court date to decide whether or not it will be permanent is on May 20th 2008. I want to help get the restraining order lifted, it was put forth on false information, and I was wondering what do you suggest I should do, what might they ask me at th courthouse? I was mentioned the restraining order, but I never testified, so I want to know what my rights are, and how to help get the restraining order lifted, or appealed? I'm assuming the judge let the restraining go through because my dad made it seem as if my boyfriend was stalking me.My dad directly put that he would go in my neighborhood looking for me and he would call my house at 3 or 4 in the morning, both are false statements.

How do I put a restraining order against my mother?

I am so saddened that you would feel the need to take such a serious step. First of all, you need to think carefully as to your reason(s), for contemplating such action. After careful consideration, you should then contact a repotable solicitor/lawyer who deals in family and criminal matters. Most likely, the solicitor would recommend he/she writes a letter explaining to your mother that you do not want her to contact you again, and that you yourself have requested this. If your relationship is irretrievably broken down, then this initial step would take place. If your mother then continued to contact you following legal notification that you do not want ANY contact, then it would become a matter for the police. The police would caution or arrest your mother for harassment. Criminal charges may then follow. Any continuation of such harassment would ‘arm' you with solid evidence that you could take to a judge. If you continued your stance and the judge considered that a restraining order was necessary, one would be put in legal place. If the order is breached (and proven beyond doubt), then arrest and almost certainly legal custody would follow as a result of breach of a court ORDER. You must give this matter very careful thought. Whatever the background, it is your mother we are talking about. A court order would probably sound the permanent death knells to your fractured relationship.
