Regarding the U.S. Civil War, how would one legally defend this statement? "It wasn't treason. There's a difference between treason and secession."

It is very easy to judge earlier generations by the standards of today. One only has to be ignorant of the culture and world view and values of earlier people's. Ignorance, the absence of information, is a common enough situation. We all are ignorant about some things, after all.We forget that people of the Civil War era felt much more loyalty to their local community and to their Colony or State than to the concept of “Country” or “Nation-State.” The Nation-State as a concept commanding loyalty was still emerging. Most people would not have traveled widely enough to know of or to identify with the major cities and landmarks of the various states of the Union. The habits and customs and practices of New Englanders were foreign to Southerners and vice versa. Foods and climate and geography were all different. Today, we have difficulty grasping these differences.Yet, even today we have people who magnify political differences such as alternative views on abortion, separation of church and state, alternative views on race, specific religions, sexuality, taxation, militarism, education, science and social safety systems.Why is it so difficult to imagine that principled people, people like Robert E. Lee, could oppose slavery but love Virginia? That he could feel that his loyalty was to Virginia instead of the Union? He knew that, if Virginia went to war against the Union, his family’s estate at Arlington would be lost to him. He also knew that many Northerners did not fight to end slavery but did fight “to save the Union” and considered him a traitor engaged in a terrible treason. His principles stood to cost him dearly.There were plenty of folks who believed that, as the Union was founded by a voluntary association of peoples through their representatives, these peoples should be able to voluntarily disassociate as well. The Civil War decided this issue.Before the war, it was a debatable issue; after the war it was no longer subject to debate.

Is it treason if a U.S. citizen speaks against the United States Government on foreign soil/in another country?

Usually not. Treason is defined in the U.S. Constitution as levying war against the United States, or adhering to its enemies and giving them aid and comfort. So, at a bare minimum, the U.S. would have to be at war with that country for the speech to constitute treason. Even then, the speech would have to be in direct aid of the enemy’s war effort, doing something like encouraging U.S. troops to desert and working for that specific intention. Just saying something like, “I think this specific U.S. policy is bad” would not be enough.There have been two treason convictions for speaking against the U.S. government on enemy territory in wartime: Iva Toguri D'Aquino, who was the principal voice of the “Tokyo Rose” Japanese propaganda broadcasts in World War II, and Mildred Gillars, who was the main voice of “Axis Sally” in the European theater. Both women not only spoke against the United States, but worked under the direct orders of the enemy government, mainly delivering propaganda designed by the enemy government rather than her own thoughts and opinions, for pay. That’s enough for treason; if you remove any of those facts, conviction starts becoming very doubtful.Contrast D’Aquino and Gillars to the various U.S. prisoners of war who have spoken out against the U.S. government while in enemy custody in Korea and Iraq. None of those POWs were convicted of treason, because they were speaking under at least the threat of torture, and often had been actually tortured, rather than working for pay.

Obviously, he is a deserter.

It is possible he collaborated and provided tactical information to the Taliban because his fellow soldiers reported that within a short time after he left the Taliban started showing a much more effective understanding of how the Army reacts to IEDs and ambushes.

Six Army personnel died in the process of looking for him to "rescue" him and he should be charged with voluntary manslaughter in each death.

Personally, I will be happy when he is Court Martialed for Desertion, Treason (for collaborating), and six counts of voluntary manslaughter. The death penalty is an option for those charges and is appropriate in this instance.

If Mueller concludes that Trump committed treason, would that mean life jail sentence? Besides Mueller, wouldn't Trump already know, if he is guilty? Isn't there a real risk of an escape to Russia, another Snowden? When is Trump predictable?

I don’t know how many times I have had to say this, but prosecutors don’t make “conclusions,” they deliver reports or present cases to the Grand Jury. In this case, the Grand Jury is the House of Representatives. I have no doubt Nancy P. will vote to impeach Trump for spitting on the sidewalk. But just like when Bill Clinton was impeached, it means nothing unless you are convicted by a two thirds vote of the Senate. And there were many Republicans that voted not to convict Pres. Clinton.Here, Republicans are the majority in the Senate. They are not going to convict him for spitting on the sidewalk. But if there really was treason, it is the Senate’s 2/3rds vote that will convict him of it. But even then, he would only lose his office. He would have to be charged criminally, separately, after he was kicked out of office. This is much more unlikely because there are actual rules when you try someone criminally. While you can impeach on a whim, an actual criminal conviction requires that the jurors not have reasonable doubts. Furthermore, Trump’s attorneys would be able to exclude evidence that was wrongly obtained — probably most of it.And where are you going to find an impartial jury? Ha, like that actually exists anywhere in the world, let alone in the U.S. And if you could find a jury that was really impartial, could anybody trust them? You would first wonder what rock they were found under.But in all seriousness, there is absolutely nothing that is credibly claimed that would result in a Senate conviction. He is most likely going to be reelected—-because the Democrats and the “liberal media echo chambers” still don’t understand why he was elected, why he did better with hispanics and blacks than Romney or McCain, and why he still polls better, much better now than before the election with both groups. That should scare the hell out of Democrats. Yes, he will be reelected. You don’t know why unless you watch Fox. Don’t you want to know why? Why he won last time too? Check out Fox for a couple weeks and you will find a whole new world — with liberals and conservatives talking together — and yelling. You will begin to understand.

They were convicted either of espionage or perjury for lying about espionage. There is no doubt in my mind about Agents of Influence such as Harry Dexter White ( who may also have committed espionage) were guilty of treason. But I can see an argument that they were attempting to influence policy which would be legal. The same argument would go to protect Hanoi Jane Fonda and other anti Vietnam War protestor  like Bill Clinton.Also Jonathan Pollard aided Israel and was quite correctly convicted of espionage. But did he harm the United States. Was Pollard a traitor?
