Is What My Boss Wants Illegal

Is it illegal for your boss to text you on your day off?

Depends on your pay structure and if you are being compensated for the time it takes to address his texts. If you are a salaried employee, your boss can text away without concern. The employee does not have a leg to stand on complaining about the annoying texts.Hourly employees may have a leg to stand on. If you are paid hourly, request compensation for the time spent addressing the texts. If the boss refuses, the texts are proof you are working without compensation and you need to take it to Human Resources, the Union or the Labor Board.Good Luck.

My boss wants me to file a 1099 What dose this mean? Dose he have to pay taxes on me?

This means that he avoids several employee taxes some of which you will be required to pay. In some cases you will not be able to pay those taxes yourself and therefore will not get the benefits if you were to need them. Generally this is a really good deal for the employer and a really bad deal for the employee. It is also illegal for the employer to require employees to do so.

Is it illegal to have sex with my boss?

I don't mean to be a d-ck, but...have you been watching Friends with Benefits? Honestly, though, as long as you aren't expecting it to lead to anything big, or the both of you to move your little f--k buddies thing into an actual relationship, I would say go for it.

Hope that helps. :)

Is it illegal for my boss to make me wait to clock in and make me work while not on the clock?

I always arrive at work 5 minutes early before my designated time. Once I enter the building, I greet my boss and my coworkers and proceed to clock in. But when I'm just about to clock in, my boss tells me that he wants me to wait and to sit down in the corner. After a couple minutes of sitting doing nothing, my boss tells me to help set everything up while I'm waiting to clock in. This takes roughly 20 minutes. When I'm all finished setting up, my boss gives me a set of tasks that they want finished. So I do it, then he lets me clock in.

What would you do if your boss asks you to do something illegal?

I guess you're not talking about murder, but about orders with debatable lawfulness.First, I would say to my boss that I suspect that her orders are illegal. Legal ignorance is quite widespread, and bosses don't know everything. I'd advice her to look for legal expertise regarding what she wants to do. If she wasn't aware of the illegality of her orders, she may be even grateful of your advice.If she doesn't want to seek legal advice to check the lawfulness of her orders and insists for me complying, I would take personal legal advice, to make sure that her orders are actually illegal.Then, except if my lawyer advices me against this, I would send her a written message recapitulating exactly what she asked me to do, and explaining that I refuse to do it because it's illegal according to my legal advisor. I'd put the company's HR in copy if necessary.When you are before a judge, "I was just following orders" isn't an argument to justify breaking the law. Your first responsibility is to yourself, not to your boss. Say no and take steps to protect yourself legally.

What is something your boss has asked you to do that was illegal? Did you do it?

My ex-boss and the head of finance had integrity issues. The ex-boss led a glamourous life-style: antique collection, art collection, sports car, wealthy boyfriend who took him on vacations flying first class. He was thick as thieves with the head of finance.One day, the head of finance came to me with a proposal. Ex-boss had his eye on an expensive painting but was unwilling to pay the customs duties for importing it. The head of finance proposed to me that the company could buy the painting, pay the import tax, sell the painting at cost to ex-boss, and claim back the tax as a business-related tax deduction. I was approached because all purchases were under my purview, so they needed me to collaborate with them. I remember wondering how this head of finance could be such a lowlife. Needless to say, I declined to assist and I put my staff on alert in case they tried to sneak it through.

Is it legal for my boss to show up at my house?

First of all you don't give a lot of information in your question. What were you chastised for. Were you supposed to be at work or did you miss work. I just don't know.

If this is your boss's first time coming to your house, no I don't think its harassment at all. If she came to your home to discipline you she was out of line. It should have been done at the work place and you could file a complaint with your supervisor.

On another note, Shanne, does not know the meaning of workplace harassment, well let me give you the defenition.

Harassment that results in a tangible employment action occurs when a management official’s harassing conduct results in some significant change in an employee’s employment status (e.g., hiring, firing, promotion, failure to promote, demotion, formal discipline, such as suspension, undesirable reassignment, or a significant change in benefits, a compensation decision, or a work assignment). Only individuals with supervisory or managerial responsibility can commit this type of harassment.

A claim of harassment generally requires several elements, including:

*****The complaining party must be a member of a statutorily protected class;

******S/he was subjected to unwelcome verbal or physical conduct related to his or her membership in that protected class;

*****The unwelcome conduct complained of was based on his or her membership in that protected class;

******The unwelcome conduct affected a term or condition of employment and/or had the purpose or effect of unreasonably interfering with his or her work performance and/or creating an intimidating, hostile or offensive work environment.

***************************** Your boss can't let go. s/he is not a good supervisor, and does not trust her/his self to delegate to other employees. She wanted to make sure you got the message about her taking off that day and also wanted to make sure you remembered about the appointment. I would talk to her boss and explain that she not contact you at home by showing up unannounced. If it is a small company you need to start looking for another job. If you are like me I hate people that just show up at my door without calling first.

Can you name any anime that is illegal in the U.S.?

I don't think there are any illegal animes. Hentai, shota, lolicon, are all legal in the U.S. and those are the ones that are typically deemed illegal in other countries. You can acquire anime illegally, but the anime itself isn't illegal.

My boss is altering my Clock out times, is this illegal?

Technically, by law, your employer has to tell you when he is clocking you out and give you a reason. Try to talk to him and see why he clocked you out early. I had to fight with a previous employer who would clock me out early if I was in overtime because he didn't want to pay it. The company that I currently work for is fighting a huge lawsuit from one of our district offices in a different state for the same thing. If you are working it is illegal to clock you out. If you talk to him and he refuses to reimburse you for the amount that was lost I suggest talking to a lawyer. And no you cannot lose your job by doing this. If he fires you that will be just something else to add to the lawsuit because retribution is illegal in all states. As long as you have pay stubs and an eye witness (besides your boss) that can say indefinately that you were at work the whole time that is all the proof that you need.
