Will my dismissed charge show on my criminal record?

If you're charge was dismissed and you never plead to anything or never convicted either, then no, it should not show on your record. If a charge is disnissed if is the same as if the charge was never filed to begin with. Now you would want to see if they dismissed it “with predfudice” or “wothout predjuduce”? If it's dismissed with predjudice, then they cannot go back and refile the charge at a later date. If they dismiss without predjuduce which is the most common, the prosecutor would retain the legal right to refile the charge at a later date, even though it's highly unlikely. I hope this helped

Dismissed with prejudice case & the military.?

Charged with a class 6 felony for 1gram of marijuina, hired a lawyer and had my charges Dimissed with prejudice. I saw a marine corps recruiter and was told that I needed my charge expunged. So i contacted my lawyer and was told that there was nothing to expunge at all, my case was completly thrown out by the state.

Has anyone here ever had a similar situation? I'm going to talk with Marine Corps JAG officers next week. I was told recruiters are kinda clueless to things they just want you in and out.

If I got charged for disorderly conduct can I still join the army?

The court is under NO OBLIGATION to drop the case. Maybe if you catch the county attorney on good day, or if they are strapped for cash and need to save county resources for a bigger fish, MAYBE the office would consider asking the judge to dismiss the charges with prejudice... but FORGET a note from the recruiter!

The CHARGE may not sink you, but if you are CONVICTED, you are done.

Here is why. The original charge is DOMESTIC VIOLENCE. You just as well go into a party and announce "I have Ebola!"- It will get that quiet in the recruiter's office. Yes - you said it is now 'disorderly conduct' in exchange for taking anger management classes and paying a fine. But you see - that is considered adverse adjudication by the military. IF YOU TAKE 'the deal' it will be looked upon as a conviction of the original charge. In the military's eyes, you took the deal because you knew you'd be convicted. And a domestic assault conviction is bad news. Could be seen as a violation of the lautner act, and if so, you can't own, posses, or use a firearm, which makes you useless to the military.

If a case is "dismissed in the interest of justice", can you be awarded a certificate of innocence?

No. In the U.S. you have to seek a finding of factual innocence from the court. A dismissal “in the interests of justice,” is kind of the catch-all phrase the prosecution uses when they’ve decided, for whatever reason, to dismiss a charge. Often a dismissal in the interests of justice is in exchange for a plea to other charges. Remember, the prosecution has an obligation to dismiss if they believe they cannot prove every element of the charged offense beyond a reasonable doubt - this doesn’t mean they think you didn’t do it.

I'm trying to get inside the navy with a dismissed domestic battery?

I'm currently trying to join the military (navy). I've taken my asvab test and i did ok ,and they've recently did a background check n found that I had a dismissed domestic battery I was never charged with anything and I was let go on an I-bond I'm really passionate about going to the navy and wanted to know if anyone had some insight about this situation what my chances of getting in the military please help with some insight

Trace Energy, dismissed and expunged aren't the same thing. If you was guilty and got the case expunged you're still ineligible if the crime disqualified you in the first place. If it was dismissed you can still get in. It's possible to get in the military with a dismissed murder or rape charge as long as the charge was dismissed without any other stipulation and the suitability review done on you based on your court documents shows that you was falsely accused of the charges. In terms of if the Navy will take you, I can't say. I don't know what they look at when they do a review of a dismissed charge. If the Navy won't accept you the the Army most likely will. All we need from you is copies of the dismissal and you would have to write a statement explaining why you was charged in the first place (person lied on you, wrong place at the wrong time, etc). From there, you'll either get the thumbs up or the thumbs down. The other charges aren't an issue since they are less than misdemeanors and don't require waivers.

Can I join the military with a nolle prosequi domestic violence?

I have been interested in joining the air force for a long time and as I was reading about moral waivers (since I have a misdeamnor record for possession of paraphanalia) I noticed that any kind of domestic violence will DQ me for ever. I was just curious about the stipulations for this. I was arrested twice within two months of each other for domestic violence, due to some childhood issues I was dealing with in therapy (long after I should have been dealing with the fact that I was sexually abused). I was honest with the judge and he have me an opportunity to redeem myself with a pre trial diversion program(anger management) and relationship focus. This was in 2008 and charges were ultimately dismissed with a nolle prosequi. Should I still need a waiver for this? And will I still be allowed to join? The air force is and has been my first choice for a long time. Also, do I need to say anything about my other arrests if they were dismissed or I was found not guilty? I am willing to do everything I need to to make this a reality rather than just a dream...
