Threatened to be sued for Libel/Defamation?

My step-uncle is threatening to sue me for Defamation over something i wrote about him on the net. Everyone in the family agrees with me, and is on my side. But all he thinks about is himself, and i was woundering. If it would turn into a lawsuit, how much can he get. My husband and I barely make enough money to pay the bills now, and i'm 7 weeks pregnant, and our health issurance doesnt cover maternity. We also have hardly anything in our name, we live in his parents house, our truck is in his dads name still, so would he be able to get anything?

If you threaten to sue, do you have to follow through?

My husband says it's illegal to threaten and not do it. He says you can be sued for not following through. He says when he worked in collections if you threated a dead beat with action you had to file within 24hrs or be sued.

My brother says that's not true, lawyers threaten to sue all the time and don't follow through. He says it's standard operating proceeder.

My husband and I are in Colorado, and my brother is in New York, but I doubt the laws are different.

Does anyone have "the" answer?

When is threatening to sue someone extortion/blackmail?

Call their bluff. Anyone can threaten to sue. Let your attorney and their attorney work out a settlement deal. If the amount is small or if you don't have the monetary resources or insurance, their attorney won't touch it - not enough money in it.

It could be blackmail or extortion. Don't settle without the court's blessing.. If you keep getting harassed for a settlement, file a police report.
