Leaving My Apartment And Roommates

My roommate won t stop smoking in the apartment. What do I do?

I am living in an apartment with two other guys. Both of them smoke, but one of them is excellent at not doing it in the apartment. Ever since I found out he smoked, I asked him to keep it out of the apartment, and he did. The other guy on the other hand, even after leaving him many notes and asking him to stop, will still not stop smoking in the apartment. I have contacted management and have a meeting set up for tomorrow morning, but I don t know what to do about the smell since it s already there. I have tried spraying Febreze everywhere to alleviate the smell, but it didn t help. The smell comes into my room, and it s really hard for me to focus on anything knowing that I am breathing in dangerous air. I was told if he continues smoking in the apartment, he will be fined, but I am incredibly worried about just making it through the days that the smoking continues. What can I do?

Do you tell your roommate when you’re going to leave the apartment or do you just go?

I’m looking for another place to move into. I currently have 4 roommates, if you read my previous posts, I have a creepy psychopath guy housemate that I don’t talk to and want him to stay the hell away from me. Beside the creep psycho with mental illnesses, My other roommates know I’m looking forward to heading out. My landlord doesn’t care as long as I tell her a few weeks before moving and follow the contract.

How can I sue my roommate in Small Claims Court for leaving an apartment and not paying rent?

You will need proof of a rental contract between you and her or both of you on an agreement with the landlord (apartment complex). It would be best if it explains that a 30day or some type of notice is required prior to vacating. Her rent would be due up to and including the day she vacated plus what would equal 30days. If there was a lease she owes until the lease ends or the room is re-rented. If utilities are split make sure to bring them and calculate the amout owed listing each item on a sheet with the total amount owed. Generally if there are no binding documents your chance is much lower of winning but it might be worth trying anyway. From this point forward when rooming with anyone CYA with what you both have agreed to. It protects your interest, cash and possibly credit. There's a book in most US states called the landlord/tenant handbook and another explaining your rights. Get a copy. They're usually free through the Dept of Housing.

How should I handle my roommate leaving with 4 months left on the lease?

This assumes you are both on the lease.You are both responsible to the landlord for the full rent. He can go after one or both of you. Your roommate is responsible to you for the remaining time on the lease. You, however, are responsible to mitigate the damage. This means you should try to find another roommate who is acceptable to the landlord. Then your ex roommate would be responsible for any of the rent that is left over that he should have paid.  So, let's say you find someone for all of the time but one month. The ex roommate would be responsible to you for his share of the rent for that one month. If you try but cannot find someone, he would be responsible to you for his full share. If you break the lease the landlord can sue one or both of you for the rent. If you pay half the rent, unless your lease is written otherwise, the landlord can evict you and go after both or one of you for the rent. If you end up sued and not your roommate, you would have to go after your ex roommate for his share. If you are not both on the lease, the person on the lease is responsible to the landlord. You would still be responsible to each other, but, someone might be month to month which would change things.Utilities, unless they are in the lease, would not generally be his responsibility once he moves out. If something is in his name and he doesn't pay it, you will end up with that item shut off.

I live in an apartment with three other girls, and we all share a washer and dryer in the apartment. One of my roommates is constantly leaving her clothes in both the washer and dryer. And I'm not talking about leaving it there for a few hours because you forgot about it or something like that - her clothes are sometimes sitting in there for days at a time because she is too lazy to take them out. And sometimes she even leaves dirty laundry on the floor of the laundry room because she started doing laundry and didn't finish.

I'm a pretty easygoing person and there's not a lot of stuff that really bothers me, but this is one thing that really ticks me off. If you know other people use the laundry facilities, I just think it's common decency to not hold up the machines by leaving stuff in there forever. How do I approach her about this issue without sounding rude or mean?
