Legal Rights On A Tree Where Do I Stand What Can I Do

Hunting from a Tree stand legality?

There are no laws regarding hunting from a tree stand in California. As for building a tree stand on public lands you cannot build any permanent structures or reserve or hold public property and anything you place must be removed at the end of the day and taken with you. Whatever you want is fine on private property as long at it is your own land or you have written permission from the land owner.

Placement of tree stands or blinds on public lands in california can be restricted such as you cannot set up with in 100 yds of a water guzzler, or shoot across a road or trail, or be with in 150yds of a building or campground etc.

Read your states regulations as ignorance of the laws are no excuse.

For what does tree of knowledge of good and evil stand as a metaphor?

Adam and Eve were dropped into perfection. Fully educated, yet NO concept of anything bad, evil, foul. Had they stayed - they'd have never had a thought to have a fight. If they had two differing ideas, they'd both sit and discuss them both, choose the best, or combine the two, making it even better. Neither would have yelled, thrown a tantrum, became selfish, became oppressive. They’d have never thought to harm the garden or the animals. It just wasn't in them. UNTIL the knowledge of good and evil was opened up to them. Their eyes were opened for sure!God didn’t want people to follow and love Him because they had to. He wanted to them to want to love Him.Hence, free-will. The choice. Don't do this one thing. There are hundreds, perhaps thousands of trees and bushes that provided fruit and berries - only 1 was not allowed.Don’t we do that in a marriage? I'll love you through everything just don't do this one thing… it will hurt me beyond repair. This is the tree of knowledge of good and evil. They had no knowledge of evil, now we are all touched by it over and over.

A tree on my property fell onto a neighbor's fence and he wants me to pay for it. The law says a fallen tree on his property is his problem to deal with. What should I do?

If a tree that belongs to you falls into your neighbor’s property causing damage, you will, in most cases, be liable. You could even be found negligent for not making the tree stable, or removing it before it fell.If you were a good neighbor, you would take responsibility and work with your neighbor to handle the problem mutually. Now, if the tree leaned heavily over the boundary line, without any prior complaint from your neighbor, then he/she would have to take responsibility for not cutting it back, or working out its removal with your approval to prevent it falling.Fences and trees are a source of great frustration between neighbors. It is better to negotiate a mutually agreed resolution than become enemies over the situation.Your only other option to getting along is to litigate, or stare daggers across the broken fence at each other. Would it not be better to work out a less negative situation?

Can you kill a tree by drilling a hole thru it?

Yes
creating holes in trees can damage them and also kill them, drilling a hole in a tree breaks through the cambium which is the life support of the tree. If you were to cut a ring (known as ring barking) all the way around the tree through the cambium this would kill the tree off because it wouldn't be able to receive any nutrients or water.
The life support system is only around the outside of the tree and not up the middle. So should you cut down a tree/or a limb the living part is what is just below the bark, this is how trees hit by lightning can still survive even though all there middle has been burnt out! (they make great dens)

Drilling a hole in a tree would not cause the tree too much damage to kill it off, however you have now left an open wound for any bacterial pathogens to creep in through, and then they kill of the tree, these happen naturally but creating holes in trees can increase the chance of this happening.

So yes you can kill a tree by drilling holes in it, however unless you are drilling lots of holes or really big holes then you shouldn't have too much to worry about.
But if avoidable then do avoid it, try and build the structure as a free stand structure around the tree, this will make it much more stable (as you dont know if where you are putting that nail is rotten inside and thus wont be a stable anchor)
Also with a free standing structure and the tree going through the middle is a tree house and then they can spread out across the tree more as this can be larger.

If you need anymore info on building a tree house contact me, by adding me as a fan and then contact me.

What are the laws in Alabama concerning neighbors trimming trees on my property?

ran out of words-
Now the branches start about neck high. You can see right through to their back deck. They can see us sittng on our patio. My husband pulled up while he was butchering them and told him to stop.He said sorry- he misunderstood. He stepped on our side and cut off all the low branches clearly on our propery. The spruces that once looked like christmas trees now look ridiculous. He said he was trying to help us out & make it easier for us to weedeat. He said sorry and he wouldnt cut anymore. He then has the gall to cut the remaining trees while we were gone last week. Although not as high, he cut the lower branches off completely on our side of the property to nubs. I have cried about this I am so upset. My husband then confronts him again and he again said he misunderstood. What are my rights. Other than trespassing(there is no fence) what law is broken? What actual damage do I have if the tree lives but looks awful and my privacy is gone? What can I legally do?
