What does "justify your actions" mean?

Which one of those three words are you having a problem with? 'Justify' means to prove or show to be just, right, or reasonable. 'Your', I believe is self explanatory; but just in case you're having a problem with it, it means of or relating to you or yourself, especially as a possessor. 'Actions' means the manner or method by which something is done or accomplished. Put them all together, and it means that you can prove that something you did is correct and/or reasonable, by thought and common sense.

I ask because if push comes to shove when those children are claimed, the person with the higher AGI "wins."

Some people get the stupid idea that whoever files first gets to claim the children. It's actually a case of the children qualifying both of you. You can each claim 1, you can claim 2 or she can claim 2--and if you both AGREE, the IRS won't argue. If you can't agree, the IRS uses a tie-breaker that says higher AGI wins.

As others have said, depending on income level, you may come out best with MFJ or roughly the same with 2 MFS returns, one child each. If you were used to claiming EIC, you MUST file MFJ to get it.

If she lies and claims single or HOH, she will be audited. It's highly unlikely you have a legal "separation agreement" (which is virtually a divorce and involves alimony) since you'd know it. You were still living together into November, so HOH is out. If she claims one of those anyway, she will discover that ignoring the rules bars her from claiming EIC in the future.

(And, you may want to mention this to her, being deployed is considered a "temporary absence" by the IRS and cannot be used to justify HOH in any situation.)
