However a couple of additional comments, your girlfriend has to satisfy the Immigration Officer (that is the wording of the legislation, and it means just that) that she is coming to stay as a visitor for a limited time, can support herself without working (for any work, paid or unpaid, she needs a work permit before she arrives, and a visa), and will leave at the end of the period (she would normally be required to produce a return ticket to Mexico if that is where she currently lives, not just a Eurostar ticket to Paris!). Otherwise she would probably be refused entry to the UK and sent back to the last port from whence she came (e.g. Miami, where she could have more problems if she did not have an appropriate US visa).I might just add that you should take this very seriously, as, if she is refused entry to the UK, she stands a good chance of being unable to come to the UK for a considerable period, unlikely to win an appeal against the refusal to enter, or subsequent application for a visa (after she returns home in both cases), and though I haven’t kept up to date, might not even be able to come should you marry in the future!! You would have to prove that the marriage is genuine, and you have lived together as man and wife for several years (abroad, of course). Tough, isn’t it?

I wont her to stay here in USA so we can have our Family. here work Visa runs up sept 20. and We have an immagration Lawyer and she wants 1,235 dollars for a vistor Visa . What should we do ? is there an easier and faster way for her to stay ? and cheaper way ?

Additional advice:
• just apply for a single entry visa, Canadian visa officer tend to refuse first time applications for multiple entry visa
• your girlfriend should leave her child behind in Thailand with her mother since this would be an additional prove of strong ties to Thailand which will make her leave Canada as stated in the visa application. That's actually the main emphasis of visa issuing officers.

I'm so sorry that you are feeling so hurt and confused.

I'm afraid that I have personally been the one that has done the breaking up and my boyfriend was mortified. He kept getting really upset, wanting to hug me, touch me and then saying that he would leave me alone, which he did for all of 3 days, after which he started getting upset again. The truth is, I am a nice person and he was a nice guy. I didn't want to hurt him. I just didn't want to be in a relationship with him anymore. Telling someone straight outright to their face that you don't love them anymore is really hard, if you're a nice person, so I tried to break it off gently and agreed to see him when he got upset. It was a mistake for both of us, because it made him think that there was a possibility that I would change my mind.

Your girlfriend seems to be doing a very similar thing to what I did.

The thing is, she wants to break up with you because she doesn't want to be in a relationship with you anymore. I don't know her reasons why, because I don't know her, but the fact that she has ended it, means she doesn't feel the same way about you.

You can't make her feel something that she doesn't feel, so please don't hurt yourself any more by trying. Tricks and tips won't work here. You could ask her directly if there is any possibility of her changing her mind and see what she says.... but please be prepared for the answer "No".

Your only option is marriage and after only five weeks, you are going to have a bit of a struggle convincing UK BA that this is a genuine relationship.

You cannot marry on a visitors visa. It is an express condition of the visitors visa that you do not intend to come to the UK to get married. An ordinary visitors visa prevents her working, receiving NHS care other than for emergencies and she will get six months leave to enter the UK at most in a 12 month period provided she can prove that she has the funds to support herself for that period of time.

There is a marriage visitors visa which allows you to come to the UK to get married if you don't intend to settle in the UK. She could stay six months and would not be allowed to return within six months on another visitor visa. She could not work on this visa and would not be entitled to any NHS care for her pregnancy or any subsequent birth.

You could marry her outside the UK, but she cannot travel to the UK without a spouse visa. She would be extremely unlikely to get a visitors visa after marrying you as the risk of her overstaying would be judged to be very high.

You need to both be over 21, have met and have adequate accommodation in the UK and be able to support yourselves without recource to public funds i.e. benefits. From what you say, your main hurdle will be persuading UK BA that this is a genuine, albeit, rather hurried marriage. Spouse visas are currently taking about 60 days to process in Ho Chi Minh and 30 - 90 days, but could be shorter, in Hanoi. Marrying in Thailand would not help with the UKBA visa as she must apply from her home country unless she is legally resident in another country.

She could apply for a Fiance visa to join you in the UK to get married and settle here. Based on the shortness of the relationship, I would consider this a risky route to take.

I am a US citizen in Brazil with my girlfriend, a Brazilian citizen, who is now pregnant. Any advice?

I see a mixture of good and really inaccurate information here.

First off you child will be a US Citizen wherever born as long as you acknowlege him as yours and you have yourself lived in the US a number of years after the age of 14, I believe 5 years total residence is required at least 2 after 14 but may have that wrong.

Second yes it will be difficult to get a tourist visa if they find out the situation. IF... and you can't lie or you damage your chances to get in ever.

Third marry her there or in the US either way she can fairly promptly get a green card, but it you do it in the US she can stay under most circumstances while she waits for the paperwork. It will probably take at least 6 months if she is in Brazil.

Fourth the only way I can think of to get her insurance is to marry her, assuming you have insurance. No one will voluntarily issue an insurance policy to a pregnant woman that will cover pregnancy.

Normally your (work provided) insurance will automatically allow you to add her to your insurance and those insurance policies have to include her pregnancy and usually preexisting conditions as well.

Unfortunately they don't normally offer any but emergency services outside of the US if that. And pregnancy would not qualify. So you need to get her to the US and marry if you can.
