If i'm not convicted, will this CPS incident still stain my record?

What state do you live in? I only know about CT and IL, two states in which I've interned at their version of CPS. A lot of this depends on the worker that has been assigned to you. From what you've said it seems like you are listed for "neglectful supervision" because you expressed that you knew of your son's father's refusal to take his meds (and therefore knew he might not be able to watch your son in that capacity). I agree that not taking anxiety meds would not make most people unsuitable to watch your children, Can you explain what the concussion has to do with this? For the most part if you are honest and comply with recommendations, the allegation will be unsubstantiated or nulled and will not affect your future plans. Depending on the state the record will probably stay in the system, but if its exactly like you say it is, it shouldn't come back to haunt you.

And yes, people do successfully appeal "findings". Chances are you won't even have to go to court.

A couple of things in general:

Not all CPS workers are social workers with a degree. They have different training (some have criminal justice backgrounds). This means that they are coming from a law enforcement perspective and may act more like a cop than someone who is trying to help you.

If you are having problems communicating to your worker, ask to speak to a supervisor, but be polite. If a typical CPS worker has 20 cases at a time (estimate) and a supervisor oversees 10 workers, that is 200 cases. But as someone with more experience, if you explain your case, they are often willing to help you out (even transfer you to another worker or unit!)

I know it must be hard to feel like someone is making you feel like you did something wrong. But you didn't, and be confident in that, while understanding that Child Protective Services wants your child to be safe. Just like you do.

Oh and another good source of help is your Ombudsman. There is probably an Ombudsman just for CPS, and you can most likely contact them through your state website. They will take and act upon complaints of worker misconduct and really anything else that just irks you about CPS.

How do I handle if me and my family are convicted in 498a case?

If you are right you will not be pronounced guilty.But, this section is special one .Here you have to prove that you are innocent unlike other sections where prosecution has to prove guilty beyond reasonable doubt.Another thing is that people generally have references of traditional laws /customs for justifying their innocence while our country is run by most modern constitution of the world where gender justice is at par with western world and sometimes it is in favour of female sex citing traditional situations. Here I am not sure how you are judging her and her family.To make sure you may tale help of women grievance cell at local police station and a have a balanced view of her complain and your actions. They will give you practical overview of the case.Now I come to your last part of question .What would you do if convicted? Since it is a case u/s 498 A whose maximum punishment is 3 years ,it can be granted bail in District Session Judge court on same day of judgement even if moved suitably.Condition worsens if 307 IPC is added to it which might attract higher incarceration than 3 years to Life which will be given bail only in High Court .Hence Convict has to spend the time in Prison till their petition for bail is heard and considered.

What EXACTLY does "convicted of a felony" mean?

My husband recently got arrested. In a car that was not his with items that did not belong to him inside. The car was seized and he went to jail. If i were to fill out an application of whatever sort what should i put under "Has _______ ever been convicted of a felony?"

Does this mean arrested, charged? One of the charges have been dropped due to lack of evidence (fingerprints) but they have made a plea bargain.

The plea bargain is if he enters a plea of GUILTY he will be off with probation and whatever withheld judification and what not. Which means nothing to me because no matter what you do it will show up in a background screening and on the internet for anyone to see. Also he is not guilty.

What should we do, the case is still open we have to make a decision in about 13 days, and we are sucked dry of money from the lawyer. Although the lawyer says he can fight it but we dont have the money and if we dont take the plea bargain it might be worse.

Anyways its been hard to get a job. What exactly is conviction and when does is happen. and are you convicted even though you plea not guilty?

Mississippi Gun Laws for Convicted Felons- ?

possession of ANY firearm in Mississippi by a convicted felon gets you 3 years and/or a 5000.00 fine..the fact that it doesn't fire means nothing...why doesn't it fire?...Firing pin removed?..it can be put back..see?...wont wash...the only thing that will work for that if it is a replica gun..if it is a real gun...too bad..and the statute is for WEAPON possession by a felon...97-37-5(possession of a weapon by a felon) says "possess a firearm,or bowie knife or dirk knife,butcher knife,switchblade knife,metallic knuckles,blackjack or firearm silencer"this implies that if it is a firearm it doesnt matter if it is a non working firearm....only that it is a REAL firearm...

Will a no convicted misdemeanor show up on a background check?

In June 2013 I was arrested with a misdemeanor of petty retail theft by association. I had a court date, pleaded not guilty but had to pay some fines and do community service which has all been done and now I'm just waiting for my next court date to completely dismiss it. I have not been convicted again I pleaded not guilty and I want to work in a retail store but am unsure if it will show up. I know many applications ask if you have felonies/convictions and I know I can truthfully answer no but even so I'm worried my arrest will show up if they do a background check. Does anyone have an idea of what could and could not show up? And any retail stores you know don't run background checks? Thanks guys!

I have been convicted of rape twice in my life. I have served 9 years in prison. Should I make my partner sign a contract to prevent it from happening again?

As Lauren Campbell said, making her sign such a contract won't help you get away with another rape.Do you have any mental problem? (I'm serious) Are you addicted to sex? Or are you just a bad person? It's difficult for people not to judge you since that question itself is pretty strange. I just want to make you conscious that it's absolutely NOT normal to ask that question. As you're not sure whether you can live without doing that, you're just afraid of being sent to prison again.Have you told your partner you've convicted of rape twice and served 9 years in jail? If you haven't, please tell her. She has the right to know.Have you even asked her if she would sign such a contract?
