Our Landlord Keeps Neglecting His Responsibilities

Is it my landlord's responsibility to get the dryer vent cleaned, or do I have to pay for it?

We've been living here for almost three years. The lease says-"The lessee shall make all required repairs to the plumbing, range, heating apparatus, and electric and gas fixtures whenever damage thereto shall have resulted from Lessee's misuse, waste, or neglect. Major maintenance and repair of the leased premises, not due to Lessee's misuse, waster, or neglect shall be the responsibility of Lessor or his assigns." There is a maintenance man who takes care of all the townhouses in our section, but I'm not sure if this is something he can take care of, or if someone would have to be hired to do it.

Can the HOA tow my car (tenant) if my landlord has been neglecting to pay her dues?

I live in NJ and my landlord has not been paying her HOA fees for some time now. I believe the house is being foreclosed, and I received a letter the other day from the HOA. The letters states that I have lost all privileges to the pool. tennis courts, and parking. It says they can tow my car at any time without warning and it will be my responsibility to get it back from the towing company, as they are not held liable. Is this legal? I have been paying full rent to my landlord, since she never notified me that she wasn't paying the fees. Thank you!

Now the issues are:How do you define neglect, andWhat does your lease say?The lease may be clear-cut, depending on the issue. However, your definition of neglect and your landlord’s may be quite different. Without knowing the details, I can’t offer an opinion (and neither can anyone else).Can you sue your landlord for raising your rent? What does your lease say? If you’ve got a valid lease, your landlord is bound by the terms and conditions of the lease, including the rental amount. If the lease has expired, he can ask for whatever he wants. If there’s no lease, he can ask for whatever he wants.If your landlord committed in writing to making repairs, but hasn’t done so, then you can sue him for not complying with a contractual obligation he agreed to. If your landlord orally promised to make repairs, that isn’t enforceable. It��s legal, but it can’t be enforced. Is my landlord responsible for stolen property after a break-in if the door lock was faulty?

You would have a very hard time getting a court to find liability on the landlord’s part for your loss.The only possible chance is if you can establish negligence on the part of the landlord. You’d need to have have clear proof that the lock was not in this condition when you executed your lease, that after the failure you had made the landlord aware of the condition, and that the landlord had failed to repair the lock in a reasonable period of time. Even then, claiming negligence is shaky.If you can establish negligence, you would also need to prove that access was gained through the door because the lock was faulty. Unless there is this proof, it would be very easy to establish reasonable doubt by arguing that someone could have tailgated someone else into the building, it was propped open when someone was moving, or maybe it was another building tenant that stole the property.Lastly, you were encouraged, if not outright warned, in your lease agreement to insure yourself and you failed to do so. I suggest you get it because it’s generally under $10/month and the most important aspect will probably never be insuring your property, but the liability protection it provides. If you make a mistake, like leaving a pot on the stove and causing a fire, you could find yourself with 100s of thousands of dollars worth of liability for destruction of other people’s property.There may still be hope:I’m going to make an assumption that the thing that was stolen was something that was delivered by the USPS or other package delivery service and left in the entry hall. If you didn’t sign a release authorizing them to leave it without signature, the delivery service is likely to be liable. How would you know if it was left and subsequently stolen or if the delivery driver lost it? Contact the shipper and try filing a claim against the delivery service for your loss.Good luck, I hope you get some resolution.

What should I tell my landlord who keeps asking me to clean the house? I don't have enough time to clean and I think it's none of his business

If you don’t have time to clean the house yourself you hire a cleaner and you can inform the landlord that you will start having the house cleaned as of some date in the near future.And if you don’t want it to be anyone’s business but your own on how clean the house you live in is then buy a house. As a renter it’s your responsibility to look after the place your renting and keeping it clean is apart of that. If you want your lease renewed clean the place if you want to look for a new place to live then ignor the landlord and hope you can find somewhere.

Does anyone know that if the trees dying, is the tenant responsibility? I am the landlord.?

I think you could only hold them responsible if you could prove negligence on their part. That may be difficult to do.

If you were to get in an arborist who could determine the cause for why the trees were dying and it was due to tenant negligence then you may have grounds to sue.

There is also the issue of the lease agreement and what was agreed to in regards to maintaing the property.

Personally I think it would be a tough sell to pin it on the tenants unless you have evidence that they did something that resulted in the trees dying.

If they neglected the trees by neglecting to follow a specific maintenance program which you outlined, if they were cutting into the trees etc then you might have an argument.

Is the landlord or tenate responsible for repairing a garbage disposal?

Probably LL, unless the Tenant broke it, by putting wrong stuff down, not running water with it, etc. You broke it, you fix it. That's why most LLs won't give tenants garbage disposals, although I do. And many tenants are idiots with them.

Can I get my security deposit back from my landlord?

I'm in Michigan! I am currently withholding rent from my landlord and have been for a few months now for neglecting major repairs. I am now moving out and am afraid he will not return my security deposit. Are there any laws that would require him to give me my security deposit for neglecting major (and hazardous) repairs? I should be fine, but on the off chance he's going to give me a hard time about it, I'd like to be prepared.

We leased the house in October, and I believe I agreed to cut the lawn. It hasn't been an issue yet as it is early spring. I just wanted to know what the standard was and to make sure I wasn't being taken advantage of. Also, my landlords live nearby and are nice people who would probably do it if I insisted and I don't want to take advantage of them either
