Well, whats the reason why this person would be not attending probation meetings, contacting agent by phone, or by any other means?

Depending on the reason why, this person is an idiot like me and will have a chance to convince the courts why they SHOULD remain on probation and NOT do jail/prison time. With drug addiction as my problem, I have been givin' 3 chances to stay sober, and remain law abiding with probation being reinstated after violating terms of probation.

The courts will 9 out of 10 times give you a chance to better your life if your are trying. But skipping out of probation and hiding/running until caught... are not trying. Trying is turning yourself in when screwing up, going to treatment when not staying sober, contacting agent no matter what!

As easy as it is to say...I am in similar boat.

Except no warrant issued, I was violated for not being honest with agent, admitting to using drugs, and not remaining law abiding.

I have my second court appearance oct. 8th for 3 violations on 3 files.

Ouch. I think I am facing two hundred twenty some months...

...I am hoping to keep my head up, stay on the right path and be honest with the courts about my desire to stay sober. Drugs are killing me and taking my life away. Its too bad its taking so long to see that.

My brother is on probation, but wants to drink on New Year's Eve. Will he get caught?

Alright, let me explain this. My brother is on probation for doing something stupid earlier this past year. Anyway, he's on probation for a year and isn't allowed to do any drugs or drink any alcohol. However, him and I are going to a party on New Year's Eve. Since I'm pregnant, I won't be doing any drinking (obviously), but he plans on doing just that, so I told him I'd be the D.D. I know it isn't smart for him to drink, but here's my question:

Does anyone know how often probation officers give drug/alcohol urine/saliva tests? What are the chances that his P.O. will give him a test directly after New Year's?

My second question is this: if he DOES drink (that is, if I can't persuade him not to), how long would it take for him to flush it out of his system? Could a urine or saliva test pick up that he had been drinking a few days after New Year's Eve, say on the 3rd of January or something? How amazing are these tests -- can they find out that he had been drinking three days in the past even if he only drinks a tiny amount of alcohol? And what if he doesn't even get drunk, just tipsy -- can a test pick up on that?


Thanks for your help, everyone! I'll try my best to not let him drink, but he's stubborn and 21 years old. So what can I do? :P

Breach of probation?

The following applies to english courts:

Well, firstly, the probation service will generally only start breach proceedings against you if it's your second breach. Was last months appointment the first you'd missed?

Secondly, it's not enough to have a genuine excuse for not attending an appointment, you must also inform the probation service within 24 hrs. Otherwise you can be breached on the ground that you failed to inform them in time.

Will you go to prison? Well technially the court could activate your custodial sentence (are you sure it wasn't a 3 month sentence suspended for 12 months by the way because the minimum term a sentence can be suspended for is 6 months!) although I very much doubt they will for a first breach, and given your circumstances.

The court is now obliged to pass a more onerous requirement however so in your case you will almost certainly have a few more months added to your supervision requirement.

Should you report a person who violates the terms of a probation agreement? Is a probation officer even interested?

Yes, probation officers are interested; however, someone calling up and saying an offender did this or that is all hearsay. We cannot act on any of it. If you call and say they've been using drugs, we can do a drug test, but it depends on the drug and how long it has been. If you say they've been drinking we might can do an EtG screening, but that is also based on a limited window of time. If you call and say they broke some law, I will tell you to call the police, I can't do anything without a police report, an arrest, or charges being file; truthfully without a new conviction because they're innocent until proven or they plea guilty. Telling me they are hanging around with so and so, okay but I need proof, are you going to write out a statement, or give your name as the person that saw this. I absolutely won't take action based on an anonymous call, well, depends on what the anonymous caller is saying of course.I will investigate any and all claims, but some cannot be like associating with someone on a certain date, using drugs or alcohol unless a test reveals it, curfew violations, or hunting violations are impossible to go back in time and prove. If you say they are holding someone hostage at their house I will be right there with the police, have a meth lab in their basement, I'm on it. But, if they had drugs a month or two ago, okay thanks, but what am I supposed to do with that? We're not going to take action on hearsay if we cannot get proof. Why would anyone expect us to do differently? We're not going to take someone's freedoms away without some very good evidence, proof.The other thing is just because they violate their probation doesn't mean you'll see anything different anyway. We have several recommendations we make before recommending revocation of their probation. Revocation is at least 3 violations away, very rarely on a first or second violation, unless those violations are based on a new offense, with associated technical violations.

Im depressed and frustrated all the time on probation, what do I do? (No rude remarks, i really don`t need it)?

Also, I forgot to say that last year (Grade 11) I dropped out near the end of the year, so i am struggling to get my grade 11 and 12 classes for the end of the year, and won't be able to get into a college far away because of my a) probation and b) minimal diploma i will have at the end of the year, with only the bare minimum classes set up so i can just complete my grade 12, with not even enough credits.

What happens if you are arrested again before probation starts?

My boyfriend's ex wife was arrested in May for a fight she had with her live in girlfriend, they beat the hell out of each other, police were called. Youth services was involved in that case. She was just sentenced last week, anger management and probation, part of the probation was to stay away from her girlfriend. She had not heard yet from her probation officer, no one has been assigned to her yet. Now, this past Thursday, she was arrested..again at a park , after hours..had been drinking, and her vehicle was searched and the police found pot and other drug paraphernalia. She was with the ex girlfriend she was supposed to be staying away from. As far as we know, she was taken to the local hospital and blood work was drawn, she also took a breathalyzer test. She was apparently let go, her father picked her up and took her home...and then she walked 2 hours back to where she was originally arrested to pick up her car. She did mention she will be losing her license. My boyfriend has 3 children with this woman, and we've been having issues for months with her being drunk, high and just hanging out with the wrong crowd and bringing those people around the kids.They share custody right now. Youth services has been called on her multiple times and they never find the children in any immediate danger. Its killing us to watch these children have to keep going through this because their mother does not care enough to put her children first. Its all about her, all the time. I'd just like to have some kind of idea what we are going to be facing the next few months. I guess I have a few questions.
1. When was her probation considered "started', the date she was sentence in court? Or after an officer is assigned?
2. Is this considered a probation violation? If so, what is she looking at..jail time? house arrest? rehab? She is an addict in every possible way you can imagine..nothing in moderation for her.
3. Is this enough for us to get partial full custody of the kids? She is very manipulative and only tells my boyfriend what she wants him to hear and most of it never makes sense, she talks in circles trying to cover all her lies.
4. Any advice on how to answer the questions from a 7, 6 and 4 year old? I think they should be told the honest truth, the mother does not feel the same..and also expects their father and I to explain what happened..she believes she doesn't need to explain anything to them, she wants to lie.

Probation is generally an agreement with the court that says you don't go to jail (or prison, as the case may vary) as long as you agree to certain conditions. These conditions vary, depending on the crime and the age of the person in question. You can get probation for vandalism that requires you to go to school every day, keep your room clean and be respectful of your parents. You could also get probation at the end of your sentence. Say you get 7-10 years in prison for armed robbery. You serve 5 years with a good prison record, so you get paroled. Basically this is the same type of agreement as probation - you get a chance to be free as long as you agree to certain restrictions on your freedom. For example, you generally can't cross state lines, or, in the case of sex offenders, be seen alone in the company of children who are under 18, near playgrounds or schools etc. Breach of probation, or parole, usually ends up with you going to some type of formal facility - prison or jail, depending on your crime.

House arrest is exactly what it sounds like. You have to stay home all the time. You are not allowed to go anywhere other than school, approved doctors appointments, counselling appointments, and court appearances etc without permission from a judge.

If I break the bond of employment in probation period with prior notice should i pay any amount to company for bond violation?

Firstly, in a Court if Law, a bond does not hold any value. No employer can bind their employee to the org. Having said that, understand a few things from the organization perspective:In hiring you, training you, setting you through an induction program and taking you on board, the org has spent a good amount of money. If your own money was tied up in the org, wouldn’t you want to recover it?The organization ties you to a bond so that through your service, they can recover the expenses they have borne for you. The whole system of bond is more like a deterrent, so that you think twice before simply joining an org and then leaving within a few weeks/months.When you leave without paying the bond or without any information, you will not get any service letters/documents, no final settlement (if any) and you probably will get blacklisted (most certainly in IT/ITES industry).If you go to court, the organization will not hesitate to begin litigation themselves and you have to remember the associated costs that you will have to bear. You may win in the end but it may come at a high cost.In the end, please take an informed decision. Have a good conversation with your HR/Manager. You can request them to reduce the Bond payment or waive it off and if your reason is genuine, they just might.It pays to keep everything communication in written and documented formats and if you have to leave, then make a clean and happy exit. You never know when you may need some help from the org in the future, so it helps to leave on a happy note.

Does my probation officer have the right to stop me working?

I was arrested and charge with assault last year and in the taihape district court judge Ross sentenced me to 1 weeks prison I was released on the 19/11/2012

I am self employed and at the time of release I had a 13 week stand down from the benefit from work and income I applied for doc permits to trap in the remote ruahine ranges and they were signed off on the 13/12/2013 I asked my probation officer could I get the freqeuncy of my reporting changed to allow me to return to work as it is a 35minute chopper ride to where I work and he refused and about 7.5 weeks ago I should have been put on monthly reporting. As a result because the chopper ride is $1450 so to recover cost of the flights I work 3 weeks on 1 week off sleeping in the ruahine ranges I made last summer doing it $25,865 and have bank statements to prove it

I have been on probation 2.5 month's now and I'm not high risk I have lost 90% of my yearly wage and because it has taken me from 19/11/2012 until 05/03/2013 to get a benefit on I have been living in a tarp woodshed and have been homeless for 16.5 weeks now and probation still refuse to change the freqeuncy of my reporting to allow me to return to work

I this a breach of my human rights and is it misconduct on the part of probation ?

Can i transfer my probation to another state?

ive been on probation in new york for 1 yea rand 11 months now. i got 1 year and 1 month left . is there any way for me to go about transfering my probation to another state? my probation officer is a prick and he just says theres no way, but everyone else keeps saying its possible. anyone know how i would go about doing it? i put my name on the lease in my new apt in CT, and i havent been able to live there since i moved in, two months ago! it kind of sucks.
