Is it possible to charge a false domestic violence case against a husband?

In India, the woman who files the false case will in most probability go away scot free in the judicial system, unless the man is willing to waste another decade or more of his life trying to convict the woman for perjury in court ( which apart from murder cases really doesn't have sufficient punishment vis a vis the crimes the woman might accuse a man of). PWDVA (Protection of Women from Domestic Violence Act) is a really strange law in India, apart from being gender biased (only a woman can file the complaint...that too if a mother-in-law wishes to file a complaint against her daughter-in-law under this act...tough luck. Apparently, Indian law doesn't consider elderly mother-in-laws as befitting of benefiting from women biased laws), it practically seems to be made for wives to blackmail hubby's/in-laws for money. Strangeness of this law is, that it is a civil law which follows the criminal procedure code and makes the respondent liable for criminal punishment in case the court's orders are not followed.

The state may charge the person who accused you falsely under certain circumstances.If the person knowingly lied to the police, and a police report was made naming you as a suspect, the person might be charged with making a false police report.If the person may have had reason to believe you committed the crime it is highly doubtful the accuser would be arrested/charged.In any event, it would be up to the police and prosecutors, not you, to determine if the crime of making a false police report occurred. (In CA, a misdemeanor under PC 148.5)

A2A.Based on age and consent, no legal charges can be made against you per se. However, if your bride's parents hate your guts (which they seem to be), they can file FIR against you for Kidnapping / Outraging the Modesty of Women etc. against you.If they really really hate your guts, then they can get a random girl and make her file a false Rape charge against you.What you can do as a prevention measure is to seek protection from the Hon'ble High Court in your jurisdiction. You can show those protection orders once the police comes in to apprehend you.

Can you press charges if someone steals your car?

You're not really pressing charges, - you're simply agreeing that you did not authorized it, - and are willing to be a witness for the prosecution.

If you don't follow-thru with being a witness, - I would hope that YOU'd be charged with filing a false police report.

You could sue them in small-claims court with proving that the loss-of-use of your car caused financial harm, - like lost hours worked, damage to your car, etc.

Should I press assault charges against my brother?

I'm a 32 yr old male... I was driving my car on the freeway with my 28 yr old brother in the passenger seat. I had two beers in my system (under the limit), my brother had about 4 1/2 beers in his system, was drunk, but not especially drunk. I said to him, "I don't think that girl at the club would have gone for you anyway because I don't think you're her type". He was shocked at what he considered an utterly insensitive comment. I said I disagreed that it was an insensitive comment. He thought I was being self righteous in my insistence that it wasn't and was being even more insensitive by insisting so despite his feelings about it. He was yelling, being aggressive, and cussing me out. Then, still on the freeway, driving about 65mph and probably looking at the road, he punched me hard in the face. I have multiple orbital fractures, multiple displaced nasal fractures, a deviated septum, a scratched cornea and my nose is permanently very slightly disfigured unless I get surgery. I could have been knocked out, lost control of the car, killed one or both of us, killed people in other cars, etc. He is remorseful but kind of thinks in a general sense that I had it coming. I don't understand what I did. At present, he's furious with... get this... ME! This isn't the first time he has assaulted a sibling.

Can you press charges against a client in a disabled adult program?

I have a coworker that has a client I also look after in her home, and she is known in the program for being a compulsive liar, and gets very upset when she doesn't get her way. She recently became violent and hit my coworker repeatedly with a heavy lamp, and then falsely accused my coworker of biting her (she bit herself for "evidence") and the administration ended up believing the client and suspended the employee for three shifts. The employee had to go to the hospital and has medical bills that are a bit hefty (the insurance through the company is 30/70) and is wanting to press charges. Can she do this? I have to work with this client today and thought it would be a good thing to know before going into work, as this has been an ongoing problem with this client for a few weeks now.

Can i press charges for someone falsely using my address?

i keep getting things in the mail for this woman that i hate with every fiber of my being. i will address the mail with the post office monday (being that it's good friday today) however, one day i got a letter in her name from charles penzone (hair salon) i didn't open it but did call them to tell them she never lived here EVER. the lady told me it was for a bad check this woman wrote and she put down my address as her's. so today someone from rent-a-center came by to collect merchindise she owes for and has not paid for. she again gave them my address. i had to show them id that i wasn't her and also explained she never ever lived here. what can i do about this? can i press charges? i know with the post office i can make sure she doesn't recieve mail here ongoing....i'm just tired of her giving out my address as her's. it's also very embarrassing to have my neighbors see rent-a-center pull uup demanding ther items back (that i don't even have!). thanks for any advise.

Do i have the right to press charges for False accusation in this situation?

okay, so pretty much, a friend of mine, 17, got arrested for driving with weed. Of course, since he's 17, the police just told his parents and he's most likely just going to pay a fine or what not..but the point. The kids father is accusing ME of selling drugs to my friend, when i am not. He is doing so simply because i hang out with his son, but he is planning on telling the police that i am a drug dealer when I am not at all and I do not know where to get drugs, other people i'm with do it. DO i have the right to press charges against him for false accusations if the police do get me involved? By the way, im 18.

Can you file counter charges if some1 makes false police reports against you?

My brother and his ex have been going through alot of issues surrounding the children. About 1 month ago, she was physically attacking him and broke his car window and side view mirror with a club. She then called the police and said my brother attacked her. The only thing that saved him was the childrwen telling the poilice what happened. The police told him to leave and give her space. He filled a report for his broken window but he didn't didn't want to press charges bcuz of the kids. Then on this past Monday she filled a report and got restraining order for breaking and entering eventhough he has a key to the house. They have to go to a hearing and his lawyer said the chrges will most likely be dropped.
However, I told him needed 2 file some kind of counter chrges bcuz she has made two false reports and he's missing work bcuz of this stuff. Anything he can do?
