If I rent an apartment and sublet a bedroom to someone else, does this sublet rent count as income, and is it subject to income tax?

The income would be sublease income and taxable to you. You would be able to offset the rental income with an allocable share of rent paid, together with utilities, insurance, etc. Effectively, you have created a subet. One aspect you may want to investigate is whether your primary lease permits a partial sublet, many residential leases do not.

I'm the owner of a two bedroom apartment, my tenant has been illegally subletting my property since 2012. What are my options?

I presume you have a lease with the original tenant.  Is there a clause in the lease indicating a prohibition against subletting?  If so, and you are not happy with the subtenant, then you could evict your tenant (and their sub-tenant) for breach of contract.  However, many leases have a procedure whereby the owner has to approve a sublease.  If the owner approves the subtenant and the sublease rental rate is higher than the original lease rate, the owner and original tenant typically share the additional increment in rent 50-50.  You may be able to recoup back rent if this is the case.  There are also many other potential permutations of this situation that I have not addressed.  In the end, if the subtenant is taking care of the property and your tenant are paying rent on time, it may just be best to be cool about it and continue to collect your rent and boot out the tenant at the end of the lease (and the subtenant).  Evictions are time consuming and obviously costly.  Good luck.

Sublease apartment?

Sublease apartment. I would like to sublease an apartment for the month of June and July, is there any way that I could pay 50% of the rent for August and the person with the lease pays 50% since I would be there for the 1st half or August and they would be there for the 2nd half? How would the landlord get paid? She would have to OWN a property and be a Sec 8 landlord in order to accept a Sec 8 voucher and get paid by the Housing Authority. Only a property owner can be paid by the county for renting.

You CANNOT have roommates on Section 8. Only family members, possibly a domestic partner but depends on the Housing Authority. A renter who occupies an apartment using a Section 8 voucher must have the lease in his name. It cannot be sublet from your mother.

Only the owner of the property can lease to a Sec 8 tenant. A single person cannot rent more than a 1 bdrm apartment because Housing wont pay the landlord more than that. Roommates and unauthorized people on a Sec 8 voucher are cause for EVICTION and LOSS OF THE SECTION 8. There are strict rules about this.

I dont know the rules for VASH. Contact the case worker at Housing Authority. If he has 2 bdrm voucher, isnt that large enough for two of you assuming your HA will allow domestic partnership. If you and your friend get married you can live together. Simple.

Details in the OP's comment to the question are critical:Subletting is prohibited.There now are more occupants than the lease permits.As you noted, the landlord can terminate your lease; then, if you do not leave, you  can be evicted.Your only realistic approach is to discuss this matter openly and honestly with the landlord to determine how closely your desires can come to the landlord's requirements.The good news is that the landlord (apparently) is not threatening to terminate the lease, i.e., wants to keep the apartment occupied (I'm guessing because the rent has been paid regularly on time).The landlord holds all of the legal cards. Your behavior as a (reasonably) good tenant is all you have going for you. Show the landlord that you are sincere and honest and want to do what is best for everyone.I wish you good luck.

since you since you are a foreign National, you have to worry about your countries tax rules and also the u.s. is IRS rules.As a general statement the IRS is very against a company having Revenue transactions with the owner of that company. Having a roommate means that both you and the roommate are on the lease. Subleasing is only you on the lease, and the landlord has no legal remedy to deal with your roommate sub leaser. It’s going to depend on the individual landlord, but personally I would prefer to end your tenancy agreement and create a new agreement with the new tenant.If you are subletting to get out of a lease early, then there is no losses to me, so no extra costs for you.It gives me much more control over my property, which is something as a landlord you want to always ensure. It means I can run my normal checks on the new tenant, ensure they are aware of important terms in the lease, and deal with issues much better.If they sublet instead, if I have a problem I have to get you you to take action which will delay and obfuscate things.

Is it legal to sublet an apartment at a higher rent than what you are paying?

Read your contract carefully.  Normally, outright sublet of a rental for a higher price is disallowed - after all, why would landlord throw away potential revenue.  However, there maybe a loophole if contract you signed is old or poorly written.  Specifically, if you rent out your apartment furnished, you may get away with charging more, yet remain contractually compliant with your landlord.  This is because, at least in theory, you are selling "an improved or modified product", in which case higher price is justifiable.

In California, Can Someone on Section 8 Sublease a Room in a 2 bedroom condominium?

A Friends of Mine is on SSI and has a job but also has a section 8 Voucher where his brother owns a 2 bedroom/2 Bath condo for which he resides alone. However, The Contra Costa County Housing Authority Says that he cannot have anyone living with him as a roommate (but a domestic Partnership is authorized). However, I cannot Find anything on the Contra Costa County Housing Authority Web Site that says a Section 8 Voucher Holder Must Live alone at all times.

If anyone Can Provide any State Law or Ordinances that Allows someone on section 8 to allow someone to live with them without requiring them to be domestic partners, please provide any information that is available that I cannot find.
