If you elect to do nothing and it somehow comes back to bite you, your defense to never showing up is that you were issued an improperly filled out summons. Argue that the summons was not valid as it wasn’t properly filled out to include the date. Explain to the court that if they’re going to be as to set a TIME OF DAY to appear, they need to be specific as to what DAY to appear, as you have things to do which would preclude you from showing up every business day at 1:30 p.m. hoping it’s the right day.

Better make sure that it doesn’t say somewhere on the ticket something to the effect of: you have x number of days to make an appearance at 1:30 p.m. any weekday!

Can you recieve a reckless driving summons without being pulled over?

I recieved a reckless driving summons without being pulled over. I was at work on a saturday and came home to a summons on my door explaining that friday night I had been spotted driving recklessly and was due in court a week later. It had no other details, no speed, and no speed limit. I'm unsure what I actually did wrong so I'm not sure what to even tell a lawyer. When I spoke to the officer on the phone he asked me where I was Friday night and told me to come down to the station to discuss the summons. After I refused he became angered that I wanted to "make things difficut" I really don't know what I did wrong and the only think I can think of would be speeding. I don't want to spend the money on a lawyer but it looks like I'll have to. Any advice or similar experience?

Call the number on the back of the ticket, tell them all the information you have and that you can't read the date on the ticket. Since this is your first offense, go to court and see if you can have the charge changed to Unsafe Operation. It will reduce I believe all of the points but you'll have to pay a lot more in court, about $150 on top of what you'd have to pay originally. Chances are they'll do it for you.. Don't kill yourself over this though, happens to everyone eventually. BTW as long as you stay below 6 points, you won't get the DMV surcharge and your insurance will stay the same. And remember, they drop 3 points for every year that you have no offenses. Just saying that to let you know that you don't HAVE to go to court. 2 points isn't much. Hope this helped.

Also, don't listen to the other guy about "don't speed"... just get a radar detector. Life's too short to obey the low *** speed limits like those in NJ.

Pay or don't pay a pink summons from NYC?

I got a summons in NYC for an open beer in a paper bag. I didn't provide ID but I gave the officer my real name & address.
My summons is full of errors.My license # & expiration is not provided,missing date of offense,description states "open container alcohol". No description of type or brand of alcohol,doesn't state containing more than .005% alcohol by volume. I didn't sign the summons.
In reality someone else could of been there and gave out my personal info.
The ticket is only $25.
What's the best solution?
