Rights To Having Company While Renting A Room Out Of Somebody S House In California

Renter/lodger in California help please (5 points if you can answer each Q)??!?

I moved into my friends house with his mother in June 2012 after he went to college.
I did not sign any rental agreement of any kind, lodger or otherwise.
I paid for the first month ($300) and she handed me some bed sheets (I also use her towels, which qualifies me as a lodger, but I pay for/make my own meals and clean up after myself, which are more renterish responsibilities; all amenities are included, as she pays for the water and power, we both live together and use the same facilities, so Im not sure if Im a lodger or a tenant, by definition)
In January 2013, she upped my rent $400 after the house sustained some damages thanks to some friends (stupid me).
Not too long ago, I overheard her discussing some things with some kind of realtor, such as: turning her house into a rental house
In order to avoid being thrown out without any rights (no rental/lodger agreement = no rights) here are my questions:
1. How can I, If Im a lodger, become a renter so that I can draw up a rental agreement?
2. Where would I get a rental agreement?
3. Pose the idea of a rental agreement to her (I was thinking of saying that it would be to build my credit) so that she and I can sign it?

Roaches Apartment LBC California?

I moved into a place that when I came and viewed saw no bugs. Now that I'm living here I see roaches all of the time. The landlord had the maintenance man come and spray.. the bugs went away for about two weeks. I came home the other night and there were 4 roaches just in my small bathroom and 2 in the living room. I see them all the time. I'm a neat freak and keep my house **** and span. I mop my floors, take out my garbage and wash my dishes right away. I CAN'T live with roaches. I live in a house like apartment.. there is a basement and 3 other apartments connected to mine.

Is he by law supposed to hire a professional?
Is there a way to get out of my lease?
Should I contact somebody with the state?

Any other info would be great.

Neighbor called the cops on us for smelling weed?

OK so the neighbor has called the cops on us for smelling weed. this crazy lady lives above us and i had never seen her in my life until she knocked on our door screaming saying shes smells weed in her apartment. my bf talked to her through the dead bolt and she was flippin out and i shut the door and we got our stuff and bounced. this wasnt the only time, The other night it was her who called the cops on us, but we didnt know it then, and we went out to eat, and left some drunk friends there who said the police knocked on the door.

Can the Police enter our house while we are not there? Can they do anything to us, or could she try to get us evicted over this??
im at a loss for what to do and kind of in shock because i have never seen this lady in my life.
what rights do i have?? can the police enter my apartment right now while im not there and search it?

Unfortunately, what we have here is the result of the greedy people in our country
suing other people, companies etc etc for every little thing to make "free money".
Your landlord is PARANOID.
I see it all the time. Everyone who owns anything in this country is a target for getting sued.
My boss constantly does( because he owns many properties).

Although your not the type to do this, your a victim( and the little guy) of our system and the people
who ruined it for the innocent.

This is why Europe and the rest of the world, laugh at our judicial system. We can sue anyone for anything.

Hope it all works out for you. I wouldn't fight it and cause more grief, but I would keep trying to talk to them. Maybe a contract saying there would be no law suit if something happens due to a fall from anything you put in the yard?
maybe they would do that?

Is it legal to rent out a house to pay the mortgage?

As others have mentioned here, it depends when the house becomes a rental. If you buy a house strictly to rent it out, then you MUST inform the mortgage lender, and they will charge you a higher rate. Also, they may not take the proposed rental income as qualifying income if you have been a landlord for less than 2 years.Now, if you buy a house and live in it as your primary residence for a while, and then decided to rent it out, it's a bit easier. You should inform your mortgage lender and they may charge you a fee but probably won't raise your rate or deny you.One small wrinkle. If you are still living in the house but decide to rent out a room or two while you are still living there, this is OK (though you should get some extra landlord's insurance), but should you wish to refi the mortgage you cannot use rental income from your primary home to qualify. You can use the rental income to pay the mortgage, but it can't be counted as qualifying income for a new loan on that house.

How long can you typically go without paying your apartment rent if you got a 3 days notice to pay the rent or get out?

I assure you that not paying your rent is one of the worst decisions that you can make. Your life will not be the same after an eviction. It can be a very traumatic experience.Every state is going to have slightly different eviction laws but here in Ohio my company has a very large rental portfolio in the Cleveland area and this is how we handle tenants who do not pay rent.Rent is due on the 1st.Rent is late on the 2nd.We call tenants 3x day from the 5th through the 10th.We put up 3 day notices on the 10th.After the 3 day notices we file for eviction. Once we file we will no longer accept rent. At this point the non paying tenant can't pay or get out of the legal ramifications of their actions.We win the court eviction and get a write to regain possession of the property. The eviction remains on your record for life. It will be incredibly hard if not impossible to find another landlord willing to rent to you.We send in the bailiffs (guns drawn) to the home. If you do not open the door they kick it in and forcibly remove any occupants living in the home.Everything that the tenant owns is placed on the curb by a moving crew. They can clear out an entire home in about 2 hours. They are not vary delicate with your possessions. Everything stays on the curb until 5pm. Scrappers and thieves usually come by and steal anything of value. At 5pm we bring a dump truck and load up everything that is left and take it to storage. After 30 days in storage we take it to the dump.After all of the above a non paying tenant can also expect the following to happen.We take you back to court and sue you for back rent, legal costs and damages.We garnish your wages until all debts are paid off.As you can gather from everything above being evicted is a terrible experience that is 100% preventable by you. Can a tenant install is own security cameras on the outside an apartment building?

I live in a 6 unit apartment and one of the tenants has install 2 cameras outside the entrances. Only the tenant can view the monitors. He put up the cameras then told the landlords after but they never did anything. Now there is a total of 8 security cameras install by the tenant covering every inch of the building inside and out. If you walk around the building outside you'll be on camera. There has to be some kind of law saying this is an invasion of privacy? The other tenants and surrounding neighbors don't want the cameras at all but the landlord won't do anything. The tenant who install the 8 cameras watches the monitors all day, he doesn't work he stays home all day. He claims he was robbed that's why there is cameras (but i think it was fraud). Is there some type of privacy law or other law to take down the cameras??????? I live in Pennsylvania

Need help! Roommate Not on lease left without paying rent!?

OK. I was living with a roommate for 2 years. He was never on the lease with me. After a year, he didn't like something that I said about him n one of his friends n started ignoring me n my girlfriend n would simply hand my girlfriend the rent when due. After a year of ignoring us, he missed two months of rent that I had to cover. Eventually he paid up what he owed but was told he had to leave for not abiding by house rules because he was purposely leaving the bathroom door wide open so my dogs would destroy the garbage in there after I told him to keep it closed. There was even a sign on the door that he repeatedly ripped up. Stuff started coming up missing n broke so I called the landlord n he gave him 15 days to leave but the guy still owed $300 from April n $300 from May n was refusing to pay AND move out. Eventually I took his bedroom door off the hinges n by the next day, he completely moved out while I was at work but still owed $600 in rent that I had to cover. He knew my gf n I are expecting a baby in 2 months n was already trying to get us in trouble before he left by illegally downloading copyrighted porn on his computer. The day he moved out, he also broke a window. Can I take this to court n win even though he wasn't on the lease? He still stayed n slept during the months he didn't pay. His AC was still running along with his PC. The rent he didn't pay was money he knew I set aside for my new baby girl. I can't afford to lose $600 while my daughter is almost here Somebody help please
