Say I Had My House Searched No Arrest Can They Charge Me Later N How Long Do They Have Before They

Can the police search my house for drugs from a Tip?

Yep.Here this idiot goes again! The cops obviously need a warrant or probable cause…The easiest and most common way for the cops to search your house is for you to invite them in. If they ask to come in, and you let them, all bets are off. They're not just there to talk to you about the tip now, they're in bloodhound mode. But you're smart, right? You know better than to let the creatures from Pandora’s box into your home. It's best if you're prepared for this. Here are a few scenarios. I'm sure you can come up with more:Cops are on your doorstep. They'd like to ask you a few questions. You know you've done nothing wrong, but your neighbors are watching. It's embarrassing. “Can we talk about this inside,” one of them asks you. What do you do? To hell with the neighbors. Let ’em gawk, and repeat after me: “I do not consent to a search. I also have been advised not to answer questions from the police.”The joy division of the professional bullies club catch you with your door open as you're coming out or going in. What do you do? Set the lock, toss your keys inside, pull the door shut, and repeat after me: “I have been advised not to answer questions from the police.” Hopefully you have a spare set of keys hidden somewhere for when they've left. Why toss the keys inside? They don't need unfettered access to your house or car if they arrest you and steal what's in your pockets. Here's a tricky one. They spring this question on you. “Do you mind if we come in?” Notice how “yes” or “no” seems to grant them access to your place? Nicely done, eh? The appropriate response is, “I do not consent to a search.”“We know there's no truth to what was said about you, but we have to look into it. Can we just look around for a minute so we can close this matter and get back to the donut shop?” Uh-huh. They just want you to be a cooperative citizen, and let them in so they can plant their evidence and get back to hardening their arteries. Please don't. Repeat: “I do not consent to a search.”The overwhelming majority of times cops get into places to look around isn't with warrants. Instead, they either lie about probable cause (not much you can do about that), or simply ask you to let them in.Don't let them in. Make sure that everyone in your home (especially your kid) also knows the appropriate answer is, “I do not consent to a search.” Because if you're unwilling to have them in for tea and crumpets, they'll just try with someone else.

If the sherrifs come to your house and arrest your spouse for theft of scrap fence, is it legal for them to?

It depends upon the circumstances of the arrest and the language of a search warrant, if any. There are some circumstances under which that would be a legal search, and others under which it would not.

A key consideration, assuming there's no search warrant: where did the arrest take place? Was the cabinet area within the immediate proximity or reach?

Your attorney - and you should have one - will advise you as to the search issues and any special features of your state's constitutional law.

My house was raided. Why was i not arrested?

the police raided my house found a little weed, a scale, small bags....I AM NOT A DRUG DEALER... i was home at the time of the raid and they tried to tell me i was in possession with intent to distribute...but they didn't arrest me....now i live in a state that under a ounce is no longer criminal. the police tried to scare me into being a snitch for them or i will face charges .....i refuse to work with them cause i know i have done nothing wrong...now my question is if they had a real case on me don't they have to arrest me when they did the raid and took my weed.....and can they just all the sudden come back and arrest me?

if you read about i plainly said WHY i have those items....to make sure i get what i purchase and to make it last me....bags and scale are legal to buy..also adding that the warrant says they have 7 days to produce me and what every they found ...that 7 days is up tomorrow and because i am NOT A DEALER....they can watch me for 20 yrs for all i care ....they wont have anything ...i just want to know if there SOOO sure i am one why was i not arrested....i believe its cause they know they assumed wrong and must not have enough evidence to fully charge me...i was never told i was under or going to be arrested...and the fact that they didn't announce them self as police and i have witnesses to that it make the whole search illegal

If house gets "raided" and nothing is found do you still get arrested? They "raided" for a reason.?

having had my house raided by the local swat team for Meth...but no they found nothing and no one went to jail or was even charged later. The only reason they would raid, Find nothing and take someone to jail is if they had an arrest warant for someone there . Other then that all they do is make you sign a paper saying the search warrent was served and that they didnt take anything out of your home. IN my case they tryed to tell me I had to meet with them at the police station the next day ...I never went and nothing ever happend . On another note its always nice to have a shotgun shoved in your face cause you answerd the door....fun stuff haha not really dont be dumb and dont get raided and if you have anything at your house I suggest you move it off location to a place only you know about.

Can a police officer arrest me later after letting me go on a marijuana possession charge?

Yes, you can be charged later. There is no legal requirement to make the arrest at the time of the violation.

The reason he let you go is because he wants your supplier. He is more interested in getting the person selling drugs than the person using drugs.

Cops took my weed and information but did not arrest me or make me sign papers will i get charged?

I got caught by two cops and I very ignorantly let them search my car they came up with under 7g of pot a vaporizer and multiple baggies and a scale I cooraperated and did a lot of praying. Does anyone know if they can still charge me or if what they might do to me they told me I had intent to sell when I dont sell I was meeting a friend up to give him some and he didnt have anything in his car and they let him go. I was asked if I could rat people out but I dont want to do that. Do you think they will charge me at a later date or am I ok?

Can the cop arrest you if they know you smoke weed or anything?

You must be looking for trouble if you would say that to a cop. In Pennsylvania doing drugs is not a crime possessing them is. So if someone told me that I would eventually find them at a time thay had drugs on them. Better just keep your mouth shut. Instead of smarting off and trying to be a hero.

If the police get a search warrant and they find something that is related to a different crime than they were investigating, can they get another warrant to investigate that different crime?

A warrant isn't needed to investigate a crime. An investigator may ask people questions and study evidence without getting a warrant. With far too many exceptions to get into here, a warrant is needed to conduct a search. If we change your question, then, to "can an officer seize evidence or make an arrest based on something they found while executing an unrelated warrant?" then the answer is "Damn skippy!"The thing is, this only applies to things they found within the authorized scope of the warrant. They can't go searching places not named in the warrant just because they found new evidence. For example, in Mapp vs. Ohio, Cleveland police entered a tenament house allegedly looking for a bombing suspect. They showed the landlady what they claimed was a warrant allowing them to search for the suspect. (They didn't actually have a warrant, but that's not material to the point I'm making here.) In the course of searching this building--allegedly for a person--they found some illegal pornography in a box in the basement. The thing is, there's no way that box could possibly have contained this man they said they were looking for. So even if they HAD had a warrant to search for the man, they'd have had no business opening boxes too small for him to be hiding in. If they opened the boxes anyway, any evidence they found would be inadmissible in court (again, with too many exceptions to go into here). Furthermore, if the warrant said they could only search for a man, and they opened a small box and found evidence of a crime, they couldn't just go get another warrant to search the box. In fact, if they opened a box and found a note that gave the location of a murder victim, they couldn't even get a warrant to go search that location, because their probable cause is based entirely on something they discovered illegally. But if you give a cop permission to search your car for weapons, and he doesn't find any weapons but he does find illegal drugs, he can arrest you on the spot for possession of those drugs. No warrant needed.
