Out of Court Settlements Admission of Guilt?

I was just curious about the opinion of the more legal minded members here:

Is it generally safe to assume that when a person or organization attempts to settle a case out of court and includes a gag order, that the person or organization was essentially admitting guilt, and was just trying to avoid what they knew would be a loss in court?

Or simplified:
Should a person or organization who has settled out of court be assumed guilty by the public and media?

Out of court settlement for date rape?

I posted a question earlier but there was a misunderstanding on my part.

Basically I am a victim of a date rape and i have taken all the necessary steps (police report, medical examination) and for many reasons (financially, emotionally time wise - the fact that I am leaving the country in few weeks and I dont want to fight for this for years) I have decided that out of court settlement will be better.

However I am not very sure with the procedure.. what happens in out of court settlement, and what do I get from it? What will happen to the suspect?

“Out-of-Court” Settlements can often be quite beneficial for both parties.Depending on the type of case, there are many benefits to settlement of a legal dispute or lawsuit, for instance:Expense. Trials involve attorneys, expert witnesses, extensive depositions during the discovery process, travel, and time. If a case settles before going to trial, many of these expenses can be significantly reduced or eliminated altogether.Stress. Settlement may reduce some of the stress that a trial can bring on. Besides the anticipation of the unknown result to come, both sides of a lawsuit might fear getting on the witness stand and telling their story to a judge and jury, then being subject to cross-examination by the other side's attorney.Privacy. Details of a civil case can be kept private when settled. When you take a case to trial, the court documents become a public record, and anyone can look at them, unless the judge orders the records sealed. When you settle a case, most of the details are kept out of the court documents, and aren't a public record. Many settlement agreements also incorporate a confidentiality clause.Predictability. Any trial lawyer will tell you that a jury's decision isn't the easiest thing in the world to predict. By contrast, you can dictate the terms of your settlement agreement, or at least work with the other side to come up with a deal you can both live with.Finality. What does it mean to settle out of court?

In plain English:  "Settling out of court" is when both sides in a lawsuit -- the plaintiff (who is suing) and the defendant (who is being sued) -- call a truce.  And the lawsuit is over. The truce can be whatever they agree it to be.  They can be identified by the last document on the docket, the Stipulation, signed by both parties, and the case is dismissed by the judge.  And that's that. If the plaintiff was a fired employee of the defendant, the defendant can say:  How would you like your old job back? And the plaintiff's lawyer says:  Sure.  And I'd like you to pay my legal fees and pay me for all those months I was out of a job. And the defendant's lawyer says:  You must be joking.  How about this?  I'll give you your old job back, and you promise to get treatment for your bipolar disorder.  Plus you can have free parking for the rest of the year. Deal. Or Macy's says to the famous black actor who they said was shopping with stolen credit cards, How would you like to settle with us, instead of spending all that time and money on a trial? And the actor's lawyer says:  How much are we talking here? And the Macy's lawyer says:  Big money.  Ooodles.  But you can't tell anyone.  And we're not saying we're wrong.  We're just going to pay you not to talk about it and go away. The actor's lawyer says:  That's really going to cost you, Macy's, because what you did was terrible.  C'mon.  I bought a $3500 watch and you accused me of identity theft.  I would have been arrested if your Clinique rep hadn't recognized me from TV.  And you've done this to a lot of people of color -- Indian, Middle Eastern, Spanish, and Black.  Show me the money. And it's settled. Most cases settle.  Because trials are expensive.  Only rich people, pro bono clients, legal aid clients, and lucky people who cut a contingency deal with a sharp lawyer like Kevin Mulhearn in Orangeburg, N.Y., can afford trials and depositions and expert testimony and lawyer fees.  So they settle... for less.

What are some disadvantages for out of court settlements?

You always have to sign an agreement to end further prosecution.

Is money settlement outside a court tax free?

It depends on what you were settled. If it was a claim for unpaid wages, yes. If it was a claim for life insurance benefits, no. There are hundreds of different things that go to court, and the rules are different for each one.

Are out of court settlements seen as 'admission of guilt'?

It depends on who is doing the seeing. In a settlement negotiation, the parties and their lawyers will typically include language saying that the defendant does not admit any liability or wrongdoing. In some cases, though, the plaintiff might insist that the settlement agreement contain an admission of wrongdoing. I have only ever heard of that happening when the plaintiff was a government agency in a civil lawsuit. I suppose it’s possible that the parties could negotiate for that in a private dispute, but I have never heard of it.In any event, in the typical private settlement, the parties agree that the defendant has admitted no wrongdoing. So this means that as far as the law is concerned, nobody has admitted or proved that the defendant admitted liability. Why are out of court settlements confidential?

A settlement is a contract. It’s a private transaction that two or more private parties enter into — in many ways, no different from your written agreement to purchase a car from a dealership, your contract with your cable TV/Internet provider, your divorce agreement, or your insurance policy that you bought from a life insurance company. In the case of a settlement agreement, rather than selling a car or life insurance, the parties are just agreeing on a particular way to resolve a dispute that they’re having.Why would any of these be public? They’re just agreements. There is no obvious, inherent reason why any of them should be a matter of public record, inspection and criticism.There are more important reasons, too: we very much want to incentivize people to enter into settlements (they are better for all involved, and they reduce court congestion), and one of the great benefits of settling is that (usually) you can keep things out of the public eye. That in itself is one of the strong reasons why people often enter into settlements. So one reason to keep them confidential is simply to encourage people to use them.

How do I start out of Court Settlement for GTA 5 online?

I am Rank 55 on the game so I know I'm high enough to do this. When I call martin I get "Death From Above" which I don't want. When I go to the Start Menu-->Online-->Job-->Host Job-->Rockstar Created-->Missions it's not in that list... or any list under Host job.... I would like to be able to do this mission so any help would be awesome?

What is a standard attorney's fee if a settlement out of court is involved?

It depends on what side you're on. If you are the defendant (the one who got sued), you'll almost assuredly be paying your attorney hourly. Depending on what part of the country you live in, that could vary from $200 per hour up to $800 an hour. Though even in new York or San Francisco you can find REALLY good attorneys for $300 to $400 per hour at kick ass small law firms. For most cases this works fine as you rarely need specialized securities attorneys in most law suits.As for how much the settlement cost… well that depends on how fast you settle. You're paying hourly after all.Here could be a typical cost at 300 per hour.Review lawsuit, meet with client, draft and file answer… depending on case 10 to 20 hours;Work with opposing counsel and get scheduling order, discovery plan, and other introductory items resolved… 5 to 10 hours;Dtaft and serve initial discovery…10 hours;Settle case, draft settlement agreement, court dismissal papers, get money transferred, file everything…10 to 20 hours.That's 35 to 60 hours or $10,500 to $18,000. And notice that no discovery was actually answered, a mediator wasn't used, and no court hearings happened. The chances of something wrapping up this quick are VERY small.I always tell my clients if they get out for under $20,000.00 they got lucky and hit a home run.This is why nuisance suits exist. Unethical lawyers and clients (which cover at least half of them) will file absolutely bs cases and offer to settle for five or six thousand knowing that doing so is the smart business decision.I could write multiple posts on why this is ridiculous, how easy it would be to fix, and so forth, but the question was on costs and I answered that.
