Can i sue for a dog bite?

short: my son 5 yrs. bit at park by one of 8 dogs being walked on 8 ft. leashes! not the first time this has happend one of those 8 dogs has bit two other people in my home (didnt report those bites) she paid for the dr. on duty bill and offered to buy me food (i declined the food) i am sure those dogs have bit others in the neighborhood! everyone is telling me to sue her home owners insurance but i feel a little uncomfortable about sueing someone! i just dont see how i have a case and i am wondering if i do! has this happend to anyone else and what did you do?

Does it still hurt to get bit by a dog in a bite suit?

Does it still hurt really bad to get bitt by a dog if you're wearing one of those dog bite suits the trainers wear? I was watching fear factor and this girl was wearing one and her whole body was covered but still she was whining and like almost crying ? So does it hurt? And if so what does it feel like?

yes, but it depends on why the dog bit them to determine whether they would have a good chance of winning or not.

What should you do if a dog bites you?

Is it your dog or someone else’s dog? Check to see if the dog has it’s rabies vaccination. If that information is unavailable, the dog will need to be put up for observation for 10 days. Doctors may recommend starting the rabies series on you. If the dog is vaccinated for rabies or not, most doctors will usually recommend a tetanus booster unless you recently had one, and antibiotics for to prevent infection from the wound. The wound itself can be treated with, anti-bacterial soap and hot water, then hydrogen peroxide and anti- bacterial ointment. Deep puncture wounds are usually left open to drain. I’ve been bitten before while breaking up a dog fight, between my dogs. All my dogs had their rabies vaccinations, so the tetanus booster and antibiotics were the treatment I received. If the dog bite is from a strange dog, and vicious in nature (not something you brought on yourself by teasing the dog), then report it to law enforcement. Many medical facilities will do this when they treat a dog bite.

Do you have any witnesses to the neighbors laughing and joking and saying they overreacted? Have you discussed this with them yet? They may have fallen prey to a smooth-talking attorney who has assured them they'll be suing your homeowners insurance company and it won't affect you much at all.

It seems really strange that they would turn around and decide to sue you, but greed is a powerful motivation. You could discuss it with them, and ask if they will drop the lawsuit if you rehome your dog. That is, unfortunately, likely your only option.

You should discuss this with an attorney, and if he feels it wise, discuss it with your neighbors. Meanwhile, get everything and everyone you can that can demonstrate your dog is not dangerous and that this was an extenuating circumstance. The neighbors probably hit a rough patch financially and decided to take it out of your hide after all, which is utterly shameful, but people will be people I guess.

Realistically they can't sue for anything more than this whole thing cost them. But given the dog's breed, logic flies out the window and a frightened nip becomes a vicious mauling. People won't care about the details, they only care that a pit bull jumped into the neighbor's yard and then bit the property owner.

Get in contact with an attorney, perhaps you can work out a deal with the neighbors. Again, it will likely mean relinquishing your dog, but at least you won't go bankrupt and lose your home, too. Maybe rehoming the dog will appease them if this is an emotional issue for them. But I doubt it is, I'm sure a smooth-talking lawyer fed them some half truths and "moral" justifications for pursuing their greed.

It is the wrong question. You can "sue for" billions. What you will win depends upon the facts and the law.

Many states have a "one bite free" rule. You do not tell us your state.

IF the facts and the law support liability in your jurisdiction, the value of a scratch will be for a jury to determine, based upon ALL the evidence, not just your post.

Edit: Louisiana does not have a "one bite free" statute, per se, but the dog bite statute does require you to have actual or constructive knowledge of potential for harm, which probably ends up being the same thing as a practical matter.

I would not worry so much about this. I don't think a lawyer will take her case.

Someone is suing my family for injuries from a dog bite. I know my dog doesn't bite, she's the friendliest dog ever. but we didn't even know that this incident even happened because there was no notification. Can he still sue?

How fast it travels depends upon the location of the bite, the severity of the wound, the quantity of the virus in saliva etc. Normally, if the bite is on legs or hands, it takes longer time than a bite on face, throat or chest. The clinical signs may appear as early as 3–7 days or as late as a few months and in certain cases even after a year or more.The protection from vaccination is also not instant, After a series of injections, antibodies to rabies virus are developed at the end of the week and satisfatory immunity may be obtained by 15–20 days if the vaccine is of good quality.Hence it is suggested that even if one is bitten very lightly, it is better not to take chances, and get yourself vaccinated even after one month. Better late than never.
