Renting a Home: Should you sign a lease on an apartment if the previous tenants still live there?

I think it depends on two factors - (1) what's the rental market like in your area, and (2) how badly do you want to live in the place.I would say I've probably been about 50/50 when I was renting - about half the time the place was empty when I signed, and about half the time it was still occupied with an end date at least two weeks prior to the start of my lease.  When I signed while there were still tenants there, it was both because the market was nuts and because I really wanted the places.Also, I would make sure that the unit(s) that you do see are reasonably representative of the unit you are actually going to occupy - in large buildings, it's not unusual for the landlord to show you a unit directly above or below the unit that you'll be renting, if for some reason they can't show you the exact unit.  As Bruce Feldman mentioned in comments to his answer, if you do this you should ensure that there's a clause in the lease stating that the unit you occupy will be "the same or substantially similar" to the one you've seen. What I would be very careful of is if the date of the current tenant's lease ends right at or just before the date that your lease will start - that's just a recipe for disaster, plus you want to give the landlord sufficient time to inspect, repair, and clean the place before you move in.
