Single Mom Filing For Full Custody Any Advise

Child custody question, moving out of state, PLEASE ADVISE!!?

I just had a baby girl in February. I was never married to the father, and he didn't support me at all during the pregnancy. He wanted me to have an abortion, then in the beginning of the pregnancy, he got furious with me and threatened to take the baby. I didn't hear from him at all after my 3rd month. My daughter is 6 weeks old, and he has never even seen a picture of her. I was in the middle of filing for sole custody, and due to a family emergency, I now have to move out of state. I called my lawyer, and he said if I move out of state, the father has a bigger chance of getting custody (I guess he meant joint). I don't understand how this is possible! Is he maybe just saying this because I'd have to stop paying HIM money? This is what I'm hoping, because I HAVE to move. I would think since he's never supported me, any court would let me keep custody. I will be able to make a great life for her where I'm moving. He's not even on the birth certificate. Can't I file in ANY state?

What are my chances of gaining full or primary custody of my child as a father?

You're not going to get primary physical custody unless you can prove that it's best for your daughter. Ask yourself these questions:If daughter is ill or injured, will mom seek proper medical care? Will you?Will mom feed daughter enough nutritional calories to maintain life? Will you?Will mom make sure daughter gets to school? Will you?Is mom's house a safe environment? This does not mean "perfect house in the burbs,” or however you define perfect. This means that there are no obvious defects in mom's residence that would endanger a child living there. Is your house safe?Is mom abusive? If you say yes, do you have reports from police/school/social workers/medical personnel that you can use to substantiate the abuse? If you don't have such reports, it's going to be very difficult to prove mom is abusive. Court personnel have heard everything from angry parents who will do anything to win, even behave dishonestly. Are there any such reports that mom could use to prove you abusive?Will mom provide adequate clothing for daughter? Will you?Ask yourself those questions honestly. Those are the kinds of things that courts examine when making custody decisions. If both you and mom will provide adequate care, with regard to those basics, then you are unlikely to "win" primary custody. There is no magic wand." I feel like I cannot live without missing part of my child's life." That feeling is about you, and not what is best for your daughter. Further, it is objectively not true, and so makes you sound overly dramatic. You will continue to be alive if you take care of your own safety, continue to consume food and water, and don't contract a fatal disease.How you and your ex care for your daughter should be about what's best for your daughter. Your child needs and has a right to care from both parents, assuming her parents can both provide that care. My guess is that both you and your ex can most likely do so.

I want to file for FULL custody for my daughter?

You need a lawyer. I know it's pricey but you need one. There are womens shelters in your area that may be able to refer you to someone with a sliding scale. Dealing with the court system is confusing and stressfull but know this: You Have Rights! Her dad doesn't have to like you. His girlfriend doesn't have to like you. But they do have to respect your rights and a court can enforce those rights. The police cannot enforce anything if there has been no court ordered visitation which you can and will get, but you do need a lawyer to help you through this.

Since the child is infant the custody will be with mother, unless proven that she is not able to take care of the child. The custody will go to mother irrespective of who files for divorce. You will get visiting rights. Once the child is of 7yrs you can again file child custody petition and battle it out. Also there can be various possibility which a lawyer would be able to guide you the best.If she is well educated and can join some job and earn than you might not have to pay. But you will be asked to pay an X amount for the child support. If she is filing for the case and if you have a good lawyer he can turn the table around and can make sure that you dont need to pay. Also alimony depends on your earnings and not the whims on fancies of your wife or her lawyer. They can ask for anything they want and they will do as more the money the lawyer is able to get to your wife the bigger chunk of commission is taken by the lawyer.If you love your wife and you want her to stay my only suggestion would be talk to her no matter how influence your mother in law is. She is your wife and now the equation have changed that you need to make her understand. Go for marriage counselling and try to sort it out. Try and make your wife understand that for your child sake. It will be traumatic of the child later on.Also if your MIL is causing the trouble rest assured if you get divorced and she marries someone else the same thing will happen there as well.

How can I be a single mom and raise my child without my ex’s help or decision? He’s crazy.

If he has joint custody or visitation, he will be in your child’s life. If he’s crazy, try not to provoke him. If he’s truly crazy, I wouldn’t let my kid around him a lot. Don’t ask him for anything. He should be paying child support, if he isn’t, don’t go after him for it and he will stay away. You will have to be able to support your child on your own though. How does your child feel about his father? If they are close, don’t try to destroy that. Your child will grow up resenting you and in the end you will lose. Don’t use your child against your ex. It’s not fair to put the kid in the middle.

Single Mom joining the Navy Reserve?

You have to have a valid family care plan showing who will be taking care of your children while away at training etc.

No in reserves you just need the family care plan you don't have to sign away custody. If you go active duty yes you would for the duration of your first enlistment.

Your recruiter can give you the paperwork you need to fill out etc.

For Navy enlistments, the waiting period is six months and the court-order must make it very plain that the transfer in custody is permanent if you want to go the AD route.

Can a single mom join the Navy fts (full time support)?

For those, such as marine 5, who don't know, FTS is part of the Navy RESERVE of which single parents CAN join. My question, marine5, is not if I can join the Navy full time, but if I can join the the Navy Full Time support. (once again, marine5, it is not the same as being in the Navy full time) big difference, FTS helps prepare Navy reservist for deployments. You obviously have issues with single parents, but I am not looking for "a social program" I am interested in serving my country once again. I am interested in raising my children with pride and respect for this great country.

Military move out of state custody???

i have a friend who is filing for divorce and has 4 kids. if she has joint custody with the military father having physical custody and the divorce decree says he cant leave with the kids from the state of fl can the military orders to go to another state or country override the divorce decree? she wants the divorce but wants to remain in the same town as them? she is very scared he will try some humanitarian thing ang get the ok to leave the state with them. i say as long as its in the decree he cant, he cant unless the judge changes it and gives permission. any suggestions?
