Can a builder charge both the GST and stamp duty for a flat under construction?

GST and Stamp Duty are 2 different things. As per the GST law the projects under construction attracts 12 % get of the basic cost of the flat . The builder is liable to collect the 12% GST from the flat Buyer of a under construction flat and pay it to the Govt. For a Ready Possession OC received Project there is no GST.Since the GST of 12% is very high and is affecting the overall cost of the flat, and also it is impacting the already slow real estate market therefore many builders are absorbing 5 to 6 % of GST and are charging only 6 to 7 % of GST on the basic flat value as they get GSTn return upto 5 to 6 % of GST refund as input tax on various materials used for construction , which they pass on to the buyers. As far as stamp duty is concerned it is a respective state govts tax and while registering the sale agreement you have to pay stamp duty as per the ready reckoner rates of the respective states and registration charges. Therefore it is builder who charges GST from Buyer and pay backs to Govt. And It is the BUYER who pays stamp duty and registration charges to govt.

Does a landlord's excessive delay in providing utility bills for payment, reduce or negate the tenant's requirement to pay those bills?

Hahaha you are funny, I’ve seen this before from tenants, and they get all tough about it. Now there are 2 proper ways to handle this, both require a bit of give on your part so the landlord does not take. AND TRUST ME I WOULD TAKE.Step 1, politely ask the landlord for the bill as soon as possible and make an excuse for it. this works 99% of the timeORStep 2, tell him you would love the whole bill to come ( mailed from power company) to your home and you will pay your share ASAP to him on rent due date. this does not always workNOW I will tell you what does not work.leases, when done correctly, don’t have a specific due date about those separate bills of when the landlord has to present the bill, but have a specific due date on when you have to pay the landlord period on any bill ( so I give you the electric bill of january 1 on june 1, you need to pay it by july 1 ) …..here’s what happens when you get heavy with the landlord or the landlords rep, Your lease at the end for a renewal is full market, with no discount and if you don’t like it, holdover rate will apply. Why? because you are not welcomed anymore and negotiations have ended.Ever see that 60 day notice on a lease? it’s because the landlord want to know what his renewal status is with you. if people understood what the rights of a tenant are and a landlord are, you both would have better lives. slum lords get a way with bad shit, and mom / pop’s get sues up the butt for being good. Now, recently I’ve come to understand that a landlord can report the late payments from tenant’s. that’s going to move your grace periods from 5 days to 1 day. or soon to zero.

Do I have to file a nil GST return if my business activity is zero? If yes, where?

Every person registered under GST will have to file returns in some form or other. A registered person will have to file returns either monthly (normal supplier) or quarterly basis (Supplier opting for composition scheme). An ISD will have to file monthly returns showing details of credit distributed during the particular month. A person required to deduct tax (TDS) and persons required to collect tax (TCS) will also have to file monthly returns showing the amount deducted/collected and other details as may be prescribed. A non-resident taxable person will also have to file returns for the period of activity undertaken.Manner to file the return:Taxpayers will have various modes to file the statements and returns. Firstly, they can file their statement and returns directly on the Common Portal online. However, this may be tedious and time consuming for taxpayers with large number of invoices. For such taxpayers, an offline utility will be provided that can be used for preparing the statements offline after downloading the auto populated details and uploading them on the Common Portal. GSTN has also developed an ecosystem of GST Suvidha Providers (GSP) that will integrate with the Common Portal.Hope it will helpful.
