If someone leaves before the police arrive on a domestic violence call will they still be arrested?
My husband and I had an argument that resulted in him hitting me in the mouth. He left the house and I called the police. They said they would arrest him that night if he returned to the residence or if I knew where to find him. It's 24 hours later and he has still not been arrested. I searched for warrants and there is nothing listed under his name. Is he going to be arrested at this point or are they going to leave the prosecution of the case to the state attorney? They did not ask me if I wanted to press charges, they said that would be up to the state attorney to decide what would happen with this particular case. The police were called one night last year during a domestic disturbance and I left the house before they showed up. My husband and the neighbor filled out reports and the police supposedly told my husband they would arrest me if they located me that night...it has been over a year and I still have no arrest warrants.
