It's not good to let a car sit undriven for long periods of time. Your mother may be doing you a favor by driving your car. Long drives are good for it. That gives it a chance to heat up and dry out any condensation that occurs in the engine. That condensation can turn to acid and erode the engine from the inside.

But as for her using your gas, maybe she's putting gas in it and figures since it's her investment she's not really taking anything away from you. She doesn't give it back and say go fill it up so I can drive some more; does she? But as for the smoking thing; I think you should ask her not to let her friends smoke in your car because the smell makes you ill.

But your parents don't OWE you anything. They've given you everything up to this point, INCLUDING A CAR. What if you had to buy it on your own? And you're complaining about gas money? Still, parents should respect your car. Even if THEY gave it to you.

Soon the cast will be off and you'll have your car back. Till then don't sweat the small stuff. Love your mom and allow her to use the car. Just ask her to respect your wish about smoking. Oh, and I hope YOU don't smoke. That'd be like the pot calling the kettle back.

Yes. AAA covers the driver, not the car. Just be in proximity to the car when the tow truck gets to its location.

I'm 18 and my parents took my car keys?

I'm 18 and still in high school with a few months left. I have complete ownership of the car and paid for everything, even my drivers ed that my mom made me buy the most expensive package which was $600! The title of the car is in my name and the reason why they took them was because I was lighting a cigarette while leaving my high school parking lot and one parent driving in saw me and went and told the principal who told my parents. Is this legal? and could I have the police just come and ask them to give me my keys back?

Okay so, long story short I was on juvenile probation. My mom kicked me out called my po on me, took my keys so I took off walking to my familys house. My po came got me did a drug test, and my mom wanted me home my po told me I didnt have to go home if I didnt want to so I didnt. My mom moved my car inside of her fenced in yard and blocked the exit with her truck. I called the police took my title and tags down there my mom lied and said her truck didnt run so she couldnt move it, and that she didn't have the keys. I want to sneak out and go to my gf's house when my mom is asleep. My gf's house is 7.7 miles away. I could either try to take the car and be there in like 20 minutes or i could try to ride my bike but it would take a couple hours...i also wanted to maybe call a taxi but thats too expensive and idk where the nearest bus stop is so what should i do? How many times do you get your car towed per year?

I've had it happen twice: once I got an SUV stuck in the snow while trying to pull another car out, and another time I had my car in the garage when the village was doing road work and created a giant ditch between my driveway and the street. In both cases I only needed the truck to get the car over an obstacle, then I could drive it again. So, my average works out to something like once every 4 or 5 years. Semi-related: I had my mom's car towed when it got stuck in the snow and the battery died and wouldn't take a jump start. I also had to pay a towing company to take my girlfriend's car and scrap it after it got destroyed in an accident. Since the police called the towing company I got charged for it, as opposed to calling a scrap company to come take it away for free.

The repair shop is liable for the security of your vehicle while it is in their possession UNLESS he has a written policy (which you would have signed) that exempts him from any liability to damages that occur to your vehicle while it is in his possession. Is there a sign posted anywhere at the repair shop which says, "Not responsible for damages to customers vehicles left on property"? Hopefully, this is not the case. If so, you are out of luck.

Hopefully the shop has insurance that will cover the theft of your vehicle. But, even if he does have insurance, they are only going to pay you for "fair-market" value of your vehicle based on the condition of your vehicle at the time it was stolen, or they will pay to have it put back together, whichever is cheaper for them. Considering your car was in dis-repair when it was stolen, your value just dropped considerably over a similar vehicle in pristine condition!

You say your car is worth 12-15K.. that's a big spread in value, and I'll assume that is what the car cost when you bought it. Chances are your car's current fair-market value is only half that amount, even less since it was not running at the time of the theft, so expect a low-ball settlement.

Not having insurance on the vehicle should not be an issue unless your state requires you to have insurance on a vehicle that is not running or in the process of being repaired. My state does not require insurance on a vehicle that is "not in condition to be driven on the highway", so check your local laws regarding "required" insurance. Also, if you owe anything on the vehicle, you violated the terms of your lien by allowing your insurance to lapse, which means you're liable for the full amount of the loan pay-off. Any settlement you get will go towards your lien first... you'll get what is left over, or worse, still owe the balance of the debt if the settlement doesn't cover the loan.

Lawyer? I doubt you'll need one. If the owner is not liable, you can't sue him. If he is liable, he has insurance to cover the loss so you'll have to negotiate with the insurance company for yourself. A lawyer is only going to work up any settlement the same as you can for yourself (maybe a bit better), and then take 25-60% of the settlement in fees.

How can we get personal items out of an impounded car?

Your mother has to get insurance, pay the tickets she received for driving with no insurance, and pay the impound fees. They will then release the vehicle.
They will not allow her to get her personal items out of the car while it's impounded.
