Were My Rights Violated

Have my civil rights been violated?

Since this seems to have been answered primarily by conservatives who are by definition ignorant I will give you an answer. First civil rights are not something which are earned. This is an authoritarian view, which is what conservatives believe in. Civil rights are endowed upon people solely by existing. The Constitution in the U.S. recognizes that all men are created equal, and have these rights at birth. The Constitution of the U.S. aims to protect these rights from infringement. You are allowed to use your freedom of speech to talk negatively about someone's origin if you are ignorant enough to do so.

Title VII of the Civil Rights Act of 1964 states, "It is unlawful to discriminate against any employee or applicant because of the individual's national origin." If you look at this basic link on the law it states, "Harassment on the basis of national origin is a violation of Title VII. An ethnic slur or other verbal or physical conduct because of an individual's nationality constitute harassment if they create an intimidating, hostile or offensive working environment, unreasonably interfere with work performance or negatively affect an individual's employment opportunities.

Employers have a responsibility to maintain a workplace free of national origin harassment. Employers may be responsible for any on-the-job harassment by their agents and supervisory employees, regardless of whether the acts were authorized or specifically forbidden by the employer. Under certain circumstances, an employer may be responsible for the acts of non-employees who harass their employees at work."

So despite what the jingoistic conservatives on here will tell you, most likely you have been discriminated upon. To me it sounds like they may have been joking, but you wouldn't call a person a ****** at a meeting (unless you were a racist, which again means you are most likely a conservative) and expect to get away with it.

How can I find out if the DYFS has violated my rights?

That depends on what state you live in. Many, but not all, states have their own agencies, with varying names, such as Human Rights Commission, Department of Fair Employment and Housing, etc. These are almost invariably overseen by a federal agency that subs out the actual investigations of alleged violations to the state (or sometimes city) agency. Yours would be a complaint of denial of or inequitable treatment in the provision of Public Services, which I believe would fall under the Department of Justice. You can find them in the Government pages at the beginning of your phone book or online under Federal Government. If the agency blows you off, entirely possible in this administration’s world view, then you should try your local county or city Legal Aid service for assistance. They will tell you whether your case is valid and if they can help you or not. Good luck with this.

Were my rights, as a motel guest, violated?

This is a touchy subject, first let me say that "constitutional rights", common sense, and your feelings are all different things.

the 4th amendment has nothing to do with anything in your statement above.

going into your room in the middle of the night: absolutely sucks. There are a lot of reasons why something like that happens, wrong room being checked in on the computer, incorrectly keyed, all kinds of things, it does not make it suck any less, but still not a rights issue. You are provided with secondary locks, either a night latch, or a deadbolt. While the deadbolt can be overridden, it does not sound like you used either.

While most hotels have a policy that the maids knock before entering, it is not a law. Perhaps she knocked and you didn't hear it.

Porn is available in lots of hotels, from fancy to sleazy. It is not our concern what you decide to watch. Were you charged for it?

Putting flowers in your room: Again, pretty common. Things are delivered for guests, we put them in the guests rooms. We don't want them hanging around with us all day. Still not a rights issue for you. The 4th amendment guards you against unreasonable search and seizure, now the hotel is not law enforcement, so that is silly that you would even equate one to the other.

The key thing: sure it's a risk, again most hotels have a policy about who can walk in and get a key, if you are recognized as a guest, and can provide enough information most will cave in and provide a key. While perhaps not the smartest thing to do, it's still generally a matter of internal policy, now had something happened the hotel could have some liability in that, but there are too many details and not enough info from you to really explore that.

Oh.... a do not disturb sign really is no more than a request. It is still not your property. I have to agree that it's a bit odd that this happened over a year ago and you are asking about it now.

Check your local innkeepers laws, they should have been posted somewhere in the room. Renting a room is not the same as renting an apartment, the same laws do not apply. While you do have some rights, it is far from a constitutional issue.

What options do I have if I feel my rights were violated when I was involuntarily committed to a mental hospital for 20 days?

As has been a patient myself, in a similar situation, my best advice I can give you, (even if you don't want/want medication) is stay the F out of those places. If you can, stay the F away from psychiatrists, as many are incompetent. They are people, too, NOT god's. It is not an exact science, and that is one reason why many people do not agree with it and make fun of it or the like. They go on observation and many diagnoses of psychosis can be explained in medical science, even if it is a physical abnormality of the brain, not observation alone. I used to be on the psychiatry's side to help my problems until I noticed they had ridiculous diagnoses in DSM IV.I would also say, whatever they thought was wrong with you, research it and/or research what you know is going on with you because you know your own reality best. No, I am not a scientologist. I am not religious. I am just someone who has been through that experience, and has not only been treated unfairly but has seen others treated unfairly while in a hospital. This answer like a few will probably been hidden or rated low.Someone said Fake IT. I say once you get what you need (meds, therapy), yes, fake it and get out. Whether you got what you needed or not, let me be one to say there are MANY incompetent hospitals out there. I can refer you to reputable articles of hospitals that have illegally abused AND killed patients. It only requires a high school diploma to be a mental health tech in many states where some technicians have been incarcerated/jailed before applying to be a MHT. The thing is, the more low class the hospital, the higher percentage of patient abuse it is more likely to have because they detain people who do not have insurance and/or family to help them, like the homeless, etc.People are not, not, not kidding when they say mental hospitals get away with ill-treatment of patients. Try to sue them and the first thing they will employ on THEIR case is that you were mentally incompetent at the time.

Are my rights being violated if my probation officer, is being demeaning and calling me names like, crazy, stupid, and addict in an aggressive and threatening manner?

Are your rights violated? Most certainly YES.Why: Firstly it is disrespectful and we are in the 21st century not the Victorian times.Secondly the Probation officer (PO) has a responsibility not to be judgemental or act in a manner to bring disrepute to the organisation is a Public service. As a Public servant you have the duty to serve which includes been polite and nice to people. You choose to be a PO and who do you think are your potential clients .Yes people who have broken the law and have done their time be it Community service,Home detention or prison. They should not be treated badly full stop. The PO is in breach of their own policies and the law on Equality and Diversity. You can take action against the PO by asking politely to speak to their superior and to put your complaint in writing thus ensuring this does not happen to others. Society as a whole can be cruel and narrow minded towards an ex- offender, so for an officer of the Community Probation Services /Attorney-General Department /Department of Correction it can be considered to be down right unprofessional and unacceptable behaviour. I have worked as a PO in New Zealand ,Australia and the UK thus my reference to the Westminister system and not the US practices.A PO is an examplary person who represents the office with total professionalism and integrity. There is bound to be some rotten apples but in general I like to think the experience you share is an isolated incident with this particular PO who is probably “burnt out”.Ask to change your PO and it certainly helps to have a dedicated and committed PO on your side to make your Rehabilitation and Court ordered sentence run smoothly.

Were his rights violated and what cases support this?

Coorections officers at the main gate receive a report that a fight involving twelve prisoners has broken out in Cellblock C and that the corrections officers in Cellblock C are unable to break up the fight. Seven corrections officers run down the corridor from the main gate toward Cellblock C. As they round a corner they practically run into an inmate who is mopping and waxing the floor. One officer grabs him by the shoulders and throws him aside while saying, "Get out of the way!" The inmate falls into a wall, dislocates his shoulder and later files a lawsuit against the officer by claiming that the rough treatment and resulting injury violated his rights.

How could I present a case in which my human rights were violated by the US government?

Since you don’t give details, it’s hard to propose the correct venue. This article suggests international courts are likely to be less effective that federal courts in the US.Dutch still wincing at Bush-era 'Invasion of The Hague Act'In 2002, Congress passed a law enabling United States forces to unilaterally storm into peaceful Holland to liberate American soldiers held for war crimes.

Were my childs civil liberties/civil rights violated?

Our civil liberties are taken away every day. It started with employers being able to randomly search the body through drug testing. It is entering the school system with unlawful searches of children's lockers. when these first started and people were interviewed about these new procedures - the answer was always the same " If they have nothing to hide then they should allow it" - Each time a right is removed from our Constitution -IE freedom from search and seizure without due process of the law we lose a piece of our Countries forefathers intended ideology.

Yes his civil liberties were violated and yes the search was unlawful, however we Americans are asleep at the wheel letting it happen.

Each small law that takes away a guaranteed right leads to creating a Government with greater power over its citizens.

One day if we do not wake up I see a Government that will be allowed to enter our homes at random. Many would disagree, but one need only look at other countries histories to see similarities as rights were slowly lost - One to mind Nazi Germany.
