Attorney feels there is sufficient evidence to warrant a federal prosecution they could present to the federal grand jury. If the grand jury finds the evidence sufficient then it would indict the person and the trial would be prosecuted in federal court. Again this would be regardless of what any federal agency did or did not do.It would be a rare case though because, contrary to how the movies portray it, local, state and federal agencies do cooperate a great deal. Most likely the local agency would take their evidence to a federal agency who in turn would adopt the case for federal prosecution.

OK! You can actually beat this pretty easy. You must get a lawyer and get the case to go to trial. Plead Not Guilty fact is trials cost money and if the DA isn't willing spend the $ on "what most Americans have already stated in many polls across America" marijuana, Is a non violent and victimless crime. Marijuana should be legal, and at the very least decriminalized. Americans have spoken and all charges will be dismissed or they will try to get you to plead guilty to a lesser charge, which you will than have to discuss with your attorney and see what works best for you. Now!! If the DA does decide to take on this case, and all current charges, your lawyer goes for a little thing called Jury Nullification. You can find at least 1 juror that agrees this law is just stupid.
