What Are The Doctor-patient Confidentiality Laws In Arkansas

Law: What happens if an attorney knows a client committed a murder but they want to plead "not guilty"?

A lawyer has a moral obligation to give each client the best representation possible. Also, because of confidentiality, the lawyer may not report the client or in any way act as if knowing that the client is guilty.Many law students struggle with this question.  In fact, a good professor of criminal law requires the students to address it.  It might help to remember that a legal system is not about justice, or morality; it is about a predictable system.  Before September 26, 2015, some states did not allow same-sex couples to marry.  The Supreme Court ruled that this was was depriving some gay people of civil rights, and the Court said that all states must allow same-sex couples to marry.  When a court official refused to give a marriage license to a same-sex couple, she was put in jail.Is this about morality, fairness, justice?  No.  It's about following the law.  Now let's move back to criminal law. Is it the job of the judge, lawyers, or jury to decide whether this person committed a crime?  NO. It is the state (prosecuting attorney)'s job to prove beyond a reasonable doubt that the accused committed the crime.  It is the jury's job to decide whether the prosecutor did that, and the defense attorney's job to implant in the jury a disbelief.  If I were a practicing attorney with a client, I wouldn't even listen to my client's confession.  I would ask "what do we legally know?"  If, by my vigorous representation, I prevent the prosecution from proving the case beyond a reasonable doubt, I have done my job as a defense attorney, for my client and for society. The job of a defense attorney is not to protect innocent people from the government; it's to protect ALL people from the government.

Have you ever overheard a conversation in a hospital or doctor’s office that you know you shouldn’t have heard? What was said and why shouldn’t you have heard it?

I overheard a physician complaining about a patient, a woman that I knew as an acquaintance , to a nurse in his office. This patient had dropped off Halloween cookies and candy to his office while I was in the waiting room. She was talking with his office staff when I was called into the examination room by the nurse. I had not had the opportunity to say hello to her. The configuration of the waiting room was an L shape. This allowed me to see who came in the door, but did not allow someone who came into the office the same view of the seating area. When I got into the examination room I heard this doctor in the hallway tell the nurse that this patient had sent him a newspaper clipping about one of his kids athletic awards. It was in the local newspaper. He then said, now she’s bringing me cookies. He told the nurse to throw the cookies and candy that she had brought away. She actually was bringing them for his office staff as a gift of appreciation. She had made trays of cookies also for teachers at her kids school. I overheard the patient say that as I walked into the examination room. Next, the doctor said this patient acted like she thought he was somehow her friend. He told the nurse that he was a doctor, period, and that this woman was acting too personal. He said this patient needed a psychiatrist a lot more than a regular doctor. The doctor then said to the nurse, that at the patients next appointment, she had diabetes, fibromyalgia, depression and other issues, that he’d tell her she needed to find a new doctor. I now knew her medical ailments which was uncomfortable. I am sure the doctor and nurse did not realize that I had overheard their conversation. Yet, I still thought this doctor was a major, insensitive jerk. This doctor did act really overly friendly to me when he came into my appointments. I had found him to be a little creepy and over the top in friendliness. I think this was his doctor, bedside manner. I would never have brought homemade cookies or any gifts to a doctors office or sent a newspaper clipping to a doctor, or to any type of acquaintance. Yet, I found his insensitivity cruel. Please don’t act overly friendly as a doctor. Someone suffering, like this woman, may consider you to be a friendly face. I guess learning boundaries goes both ways, both for the patient and for the doctor. I decided also, then to find a new doctor. This man was not a kindly healer, but a real jerk.

Can a doctor tell your parents if you arent a Virgin ?!?!?

a doctor can tell youre not a virgin if you tell him youre not a virgin, have an std, or are pregnant. other than that, a doctor cant really tell if youre a virgin or not unless he is going to do a close examination of it looking for scars on the tissue and stuff but really its not that serious......

and im sure the doctor knows how stupid it is for a parent to take their child to the doctor only to see if they are a virgin or not...you would probably only get a check up and see if stuff are functioning right and then the doctor will have to explain to them the stupidity the situation is...

and its patient doctor confidentiality. unless its life threatening i doubt he will tell. just bring that up with him about this being private and confidential check up.

but all in all be honest with your doctor. dont lie because when you lie to a doctor about your body and something comes up then they wont know whats the deal because they would have already crossed out a bunch of things. its always important to be honest to your doctor as its your life and the body you have to live with

Where are the free clinics in Little Rock Arkansas.?

Across the street from NLR high school, there is a building (looks like a little house) that has a sign outside that reads "Free Pregnancy Testing" That leads me to believe that they could help out in that field. (I went to NLR high school and saw that sign everyday before and after school)

Also, the free clinic in NLR is next door to the Laman Library (between that and the NLR Community Center) I think that it is on pershing rd. Be prepared to sit.... and wait.... and be patient because they make you fill out a lot of applications/ information, etc. They will give free health examinations based upon your available funds. All of these are always confidential because it is against the law in AR for any doctor to give results for any medical examination/testing for any reason. And, as long as you are eligible (which, if you don't have a good 9-5 job with benefits, you probably are) then everything will be free of charge.

As for Little Rock, I believe the central health unit is on the Pine/Cedar exit. You can see the building from the interstate. (It's on the south side from 630)

I also advise to be safe and careful in your endeavors in the future. It's a rough world out there!

Why does the HIPAA regulations prevent a physician from providing medical information to relatives/spouses of ill patients?

This might sound like a strange concept, but it turns out that not everyone wants their medical treatment or condition shared with their family or spouse, regardless of their illness. HIPPA protects health information like that. It can seem a little inconvenient from a family member or spouses' point of view--but clinical records may be very private for a lot of reasons. Lets just consider something small--lets talk about an easily cured with antibiotics STD. Like Syphilis. You take a round of antibiotics and it is done. Over with. But if your partner told you that they had syphilis, you might have some serious feelings about that. Maybe it was from the relationship just before you got together. Or maybe it was the result of an unwanted sexual experience or a rape or a coercive situation. But you are still like--what do you mean you had Syphilis and did not tell me?!? Could our kids be born blind? What if you relapse? Now imagine that you are a teen and you want access to birth control, but your parents do not approve. Telling them would mean world war III and you still need the pill because you are in a long term relationship. You are nearly 18 and a freshman in college. Should your mom have access to your records with your OB/GYN on campus? You are a teenager and you are pregnant. Your parent wants you to have the baby and put it up for adoption. You want to terminate your pregnancy. Who gets to decide? Or it is the other way around? Your folks want to terminate your pregnancy, but that does not feel like the best choice for you. Who gets to make that choice? You are an older woman, say 60, and you have breast cancer, that has gotten worse quick. You could fight it aggressively and loose quality but gain an extra year of life. Or you could refuse treatment live your life to the fullest and die a life well lived. But your sister feels that you should have treatment at all costs. Access to your medical records means she can go to court and force you to get treatment. Is that ok? HIPPA is in place for a lot of reasons, but the biggest one is to protect you from discrimination by insurance or doctors. But sometimes you don't want you aunties to know you have herpes because you just don't want to hear it at thanks giving. But it they can just get it......
