What Authority Does A Neighborhood Watch Commander Have

My dog attacked the neighbor's dog on our property. Neighbor demands we get rid of her or she will report her?

So I get home from work this evening and my wife tells me our dog attacked our neighbor's dog. The neighbor's son came over to return a toy to our son. When my wife answered she partially opened and blocked the doorway keeping the screen door closed. But as she opened the screen door slightly to retrieve the toy from their boy their dog came up into our front yard out of nowhere, and not leashed. Our dog saw theirs and pushed past my wife in a flash and tackled/pinned their dog down in the middle of our front yard. My wife chased out after her and was able to pull our dog off of theirs (both medium sized dogs) and then secured ours back in the house. She didn't see our dog bite theirs but inspected their dog as best as she could given the situation and didn't see any immediate serious injuries.

Later this evening, with my wife at work, one of the neighbors came over to speak with me. She said their dog was bleeding all over the place and on inspection noticed that her front leg had a small chunk taken out of it and a wound to her ear, possibly even more injuries as well. She demanded that we either get rid of our one dog (attacker) and/or she will report her to animal control. I get the feeling they may/could even press for vet bills as well.

Here's the thing... They let their dog run all over the neighborhood off a leash (I've never seen her on a leash) and she comes into our yard antogonizing our dog with her presence, peeing and pooing all over the place almost every day. No one watches the dog. They leave her outside alone all the time to run around the neighborhood, and have even told me that if she won't come home when called then she'll have to stay out all night. If their dog were to get hit by a car down the road somewhere or attacked by another animal or person they wouldn't even know it.

So, are we liable for damages to their dog even though they were (and have been) negligent in keeping their dog out of our yard or even on a leash at least? If she were to file a complaint against us for the attack on her dog can animal control take our dog away and euthanize her? We're distraught over this, especially our son. She's been part of the family for 8+ years.

BTW we live in California. Thanks in advance!

Was the arrest of Raub Brandon politically motivated by the Obama Administration & DOJ?

A Sheriff Department, Secret Service and FBI arrested this guy over his Facebook posts that were non-threatening, but political, he was very critical of the government. He was arrested for "terrorist threats" or "Terrorist in nature" and "resisting arrest".

Interview with his Mother

Some of his Facebook posts:
"The Revolution is here. And I will lead it."
"The Revolution will come for me. Men will be at my door soon to pick me up to lead it. ;)"
"This is the picture of the Pentagon, right after our leaders shot a missle into it." (Arial photo of the destroyed section of the Pentagon posted)
"The people responsible for posioning the America people from the sky will be held accountable. And there is going to be justice."

Howling Neighbors dogs?

Get a couple of them barking things, Bark-Off I believe is the type I have. I got 2 of them along the fence thats between my house and the neighbors who have dogs that used to bark like crazy. Good part is they never know about it being used. They do not have a huge range is why I got 2 of them, but they work pretty good now. My wife said to me "Thats cruel, doesnt it hurt their ears" and all I could reply to her is "Well its cruel that my ears have to hurt from hearing their constant barking all the time". Anyone who says they are doing their job by barking at every silly thing is mistaken, sure part of a dogs job is protecting the yard, but that does not include barking all day at every useless noise or sight. Especially in a neighborhood backyard.

Neighbor is provoking my dog to bark?

Call the police again and tell them what animal controls said. I would try and talk to the mother as it seems like you haven't had any problems with her before this. I would make it a very calm conversation. Say something like, "Hi. I just wanted to ask, have my dogs been bothering you during the day? If so I'm really sorry." Then you can branch into "Well your son was in the yard the other day and said some pretty nasty things and said the dogs were being a nuisance". Maybe if you approach it like this with her then she can smack some sense into him. Remember, just because he feels that way, doesn't mean she does. Heck, she may not even know he is doing it. He sounds like a nutcase to me.

A security camera would be a great idea. I would not leave my dogs in the yard unsupervised either. The instant he tries to provoke your dog again, get right on the phone to the police. Tell them you want this under control and for him to stop teasing the dogs and sticking his hands and objects through the fence before your dog bites and it becomes YOUR problem.

You can try getting some yard posts and winding some temporary fencing around it a few feet away from the fence line. It isn't pretty though. LOL...Or run a hotwire across the fence....that might make him think twice. (nah...pretty sure you'd get in trouble for that one...if he could prove it was still there...)

I'm sorry you have to deal with this. Some people are idiots unfortunately. Maybe he will start taking his crazy drugs again and be a normal human being...

Why do people not realize Zimerman was told to stand down?

Those people simply do not care.
They simply refuse to let the facts of the case...the fact that Zimmerman followed/chased/harassed Trayvon Martin until the point of a deadly altercation was reached, where he killed Trayvon ...they refuse to let these facts sway them for their opinion.

For all Trayvon knew, Zimmerman could have been chasing him waiting for other Klan Members to show up! Zimmerman and Martin obviously did not know each other, so Trayvon Martin had no reason to feel that his safety wasn't being threatened by Zimmerman.

Zimmerman was CLEARLY CORRELATING HIS MOVEMENTS to Trayvon Martin...and that is an Extremely Common PRE-ATTACK INDICATOR as taught by self-defense professionals!!

If Trayvon Martin was REALLY a Glock-totin', AK-totin', or Sawed-off-Shotgun-totin' Gangbanger...Zimmerman would likely be dead because of his actions! Considering the fact that Zimmerman was armed with a firearm...Trayvon Martin could have legally Stood His Ground! Its just too bad he wasn't armed :-(

And yes, the Stand Your Ground law does not require the Defender to have a gun...Trayvon could Stand HIS Ground with his fists alone and be protected by the law!

Florida's Stand Your Ground law doesn't excuse Zimmerman's actions.
That was made clear months ago by the Republican lawmakers who created it:

Dennis Baxley, a Republican state representative and co-author of the 2005 self-defense law, said Zimmerman negated his ability to claim immunity under the law by chasing Martin.
"This law is for innocent, law-abiding citizens who are under attack by a perpetrator," Baxley told The Huffington Post. "Anyone who is out pursuing and confronting people is not protected by this statute."

When was the "well-regulated militia" clause deleted from the 2nd Amendment? How does this phrase endorse civilians owning and carrying military-grade weapons?

THE SECOND AMENDMENT MILITIA IS “WE THE PEOPLE”In the 1939 Supreme Court case U.S. v. Miller 307 US 174 we learn what the Second Amendment was about. In order to suppress a military coup that overthrows the government, we must be able to show up on the battlefields with weapons equal to the military, in order to take back our government. If you are prohibited from buying weapons equal to the military, then you do not live in a free country. Some people like to argue about the word "militia" in the Second Amendment. They argue that the right to bear arms is only for the organized militia, or that militias are government agencies with government weapons, or that the militia is only State National Guards. BUT JOHN ADAMS WAS THERE AND HE NEVER HAD SUCH THOUGHTS. President John Adams (signer of the Declaration of Independence, and former Congressman of Massachusetts, and who was one of the two Americans who signed the peace treaty with Britain that authorized the United States to exist) in his October 11, 1798 letter to the officers of the First Brigade of the Third Division of Massachusetts: "An address from the officers commanding two thousand eight hundred men, consisting of such substantial citizens as are able and willing at their own expense completely to arm and clothe themselves in handsome uniforms, does honor to that division of the militia which has done so much honor to its country."That’s right. Almost 7 years after the Bill of Rights, and 18 years after Massachusetts was a state (by the way, John Adams wrote the Massachusetts Constitution) the militia consisted of citizens willing to completely to arm themselves at their own expense. Don't be fooled into believing that this has changed. The Constitution does not change. Those who swore to defend it must perpetuate it.For more information read my essays at www.NotFooledByGovernment.com

How to find comfort after being scared from a peeping tom?

First of all, you have done the right thing. You contacted the police and you have purchased drapes.

Locking the doors at all times, is always important. Also be sure you have a deadbolt and a chain lock. be sure that all windows and sliding doors have dowels/broom handles or 2x4's placed between the slider and the frame so that unless you remove them the door will not open.

Make sure that you place a request for increased patrols from the police department. Make sure that for the next few weeks you only leave and return to your house during day light hours, and it would be a very good idea to introduce yourself to your neighbors and let them know the situation. One they can watch out for you, and two, they may have the same problem, and can report it also... more likely he'll be caught that way!

Good Luck to you, you are in my prayers.

Do you think cops take advantage of their "power" ?

Of course they do, RANDOM traffic stops are unconstitutional and can be fought he just walked over you and if he has a dash cam and you fell you were wronged then you need to pursue it because that is the only way to stop certain cop from abusing the authority we grant them. Take time and look up the laws online for where you live and which one will most commonly affect your life, many police officers don't even know all the laws they are to enforce and wrongly try enforcing what they think is the law. before you start an issue with a cop be sure you believe you are in the right then take down the cops badge, car/unit number and ask to speak to the usupervisoriser or watch commander even go so far as to go immediatly to the police station and complain And ALWAY'S and i mean ALWAY'S remain calm an polite NO MATTER WHAT! a dash cam can save you *** on this and show a bad officer up in front of a inquiry

In the United States, can a state trooper give you a speeding ticket within a city's limits?

In the United States, can a state trooper give you a speeding ticket within a city's limits?Every state trooper in the US has the authority to ticket speeders anywhere within that state. Every Sheriff’s deputy has the authority to ticket speeders anywhere within that county. Every municipal police officer can ticket speeders within the boundaries of their municipality. In pursuit means that if you cross a boundary line with the officer in pursuit, the officer can follow and ticket you. There are rules they have to follow, but the ticket will be valid. They can also pursue you onto private property, so running car into your garage and then trying to get into your house when you are being pursued by an officer intent on ticketing you is not a good decision. In some rural areas, you may find that a town doesn’t have its own constable or police officer. The county sheriff and/or state patrol take turns running through the town.Generally, state troopers will patrol US and interstate highways, Sheriff’s deputies will patrol state and county highways and roadways and city officers will patrol city streets. But, if the interstate runs through the city, the city officer has every authority to patrol and ticket on that piece of interstate. A highway patrol officer can give a ticket in a residential neighborhood.
