What Can The Cop Do If I Refuse To Do What He Said

If a Cop tells me to do something, and I refuse can he do something about it?

For Example:
I'm driving home late, and I'm getting sleepy, so I pull over into a parking lot, turn off the engine, crack my windows, lock my car, and lean the seat back. I then fall asleep. 2 hours later, I awaken to some idiot knocking on my window, I look up, it's a cop. He asks the most stupid question, What are you doing? I say sleeping.

He tells me I can't sleep there(in a Walmart parking lot), that I have to leave. I tell him, I'm too tired to drive, he says, go get a Hotel, (well no ****, *********, I would if I had the goddamn money, economy is bad, so I don't.

And he's like, Not my problem, You need to leave.

NOW, if I told the SOB to piss off, I'm not going anywhere, could the SOB do something about it?
Is there a law that says the cop can do something about it?
You would think that driving sleepy might dawn upon him as dangerous and for him to leave ya alone, driving sleepy might cause me to veer over into oncoming traffic and have a head-on with a family of 6, and kill everybody in it. Hopefully it would be that dumb Cop's family, then the retard would feel like a retard for messing with me.

He cannot. It is against the 4th Amendment. He has to have probable cause to search your car without a warrant, which he did not have. Speeding at 8 mph over the limit is not such probable cause. If there was no marijuana in the car, and you were not coming from a place where people were smoking marijuana, and you don't smoke marijuana at all (and thus, there is no way he could have smelled marijuana), then he has absolutely no basis for his belief that there was pot in the car, and he loses.

I hope you got his badge number and his precinct, and know a lawyer if he does try to. Any lawyer would RIP into that so quickly.

Please IGNORE the advice given you by kxaltli! OMG, I do not know how to stress this enough--DO NOT EVER SPEAK TO THE POLICE WITHOUT FIRST CONTACTING AN ATTORNEY! NEVER. Even if you're innocent. No matter what the police officer tells you, NO MATTER WHAT HE SAYS, never EVER cooperate with the police without first contacting an attorney.

First of all, if the police had enough evidence to charge you with a crime, THEY ALREADY WOULD HAVE. You'd have received a summons or have been arrested. The only reason they want to talk to you so bad is because they do not have enough evidence to charge you with a crime, and they are hoping you will incriminate yourself. THAT IS THE ONLY REASON. Police are very good at making people say what they want to hear--do not attempt to outsmart them, do not engage in any conversation with them whatsoever.

The idea that not cooperating with the police will somehow hurt you is a BOGUS, absolute absurdity perpetuated by the police themselves. Keep in mind the police have absolutely NO influence in whether or not you are guilty or innocent at your trial, nor does cooperating with the police or not cooperating with them have any bearing on your possible sentence if found guilty. They will make many promises--promises they cannot keep. The notion that if you have nothing to hide, you should cooperate is BOGUS--the police obviously think you're guilty, they've made up their minds, but they don't have enough to charge you yet, and the only reason they want you to talk is to get a confession out of you, or force you to incriminate yourself. DO NOT FALL FOR IT.

Let me stress again--IT DOES NOT MATTER HOW YOU "look"--the police can think you are guilty till they are blue in the face, it doesn't make it so. COOPERATING NEVER HELPS YOU, it CANNOT HELP YOU, you are only giving them additional evidence to use against you. DO NOT COOPERATE WITH THE POLICE. People who have nothing to hide OFTEN HIDE ANYWAY, why? Because it's your right. The police do not have the right to force your confession or force information out of you or compell you to implicate yourself. Do not listen to the advice given you by most people here because they falsely believe the lines straight out of the police playbook--the police count on the public's ignorance of their rights to nab them. Do not be another statistic.

Where do i go when the cops refuse to make reports of crimminels?

a investigater resently phonrd me and confermed that my unlisted phone number is being used from another address in this town. this is illegal whoever thay are are probably cops & have no right to be doing this. i am doing nothing illegal at all i am trying to get people arrested for cromes that thay do to me. cops that commit crimes or neibers or acoitaces. whoever commits crimes. i need a lawyer never well i be abel to pay for any lawyer. investigations of all the crimes that have happen to me cost so vary much & go up in price constently. every year. i have been on the cops black list and well be there till this city is taken to court. social workers do not know what to do wnen everything requires a lawyer legal aid has to be taken to court. thay have denyed all service always. 2 years ago committed $39.000 worth of crimes with my insurance money when my house was arsened and tell me to take legal aid to court for what thay did. think this is funny. who can do that? how? imposabel..

Can a cop search your car if you say no?

They have to ask permission. If you do not give it to them, unless they have reasonable suspicion/probable cause (i.e. smell marijuana, alcohol, saw you throw an empty container out the window, see weapons, etc...), they can not search. Minor traffic violations do not qualify. If they arrest you, they are permitted to search the passenger cabin and glove box, but not your trunk, unless they have probable cause to do so (like reasons above). They need a warrant to open up any locked boxes, or at least last time I checked they did.

However, they can install GPS tracking devices on your car without your knowledge and without a warrant.

You still have rights in your car, but your right to "expected" privacy is somewhat less than, say, in your home. Where, by the way, police can now perform sneak-and-peek searches without your knowledge... in rare circumstances one would hope.

Response to OP edit: Correct, if you are just speeding, and they have no probable cause - you can refuse. A routine traffic stop/ticket is not an arrest and does not qualify a search in and of itself. However, it is in your best interest to comply with all other reasonable requests made by the officer, and to do so without resistance and in a polite manner. Being confrontational will arouse suspicion and perhaps contempt, prompting the officer to take further steps to try to pressure you.

If he asks you to step out, do it, and close the car door behind you.

In the US you do unless you are are on parole or out on bail awaiting trial and a judge has ruled that your conditions for parole or bail are that you must submit to a search of your person/home/vehicle. However, if you refuse a search, the officer is likely to assume you have something in your vehicle that you don’t want them to know about. They will get a warrant by phone most states while you wait…and wait. They can call for backup and if drugs are suspected they can call a K-9…while you are waiting; perhaps in handcuffs.If you have a little dope and you don’t have a record, aren’t out on parole or on bail, you’d be better off admitting what you have and/or permitting LE to search your vehicle. If you have something, you might get nothing but a summons to go to court and pay a fine. You might avoid having your car towed/impounded and spending the night in jail. Depends on what kind/how much funny stuff you have.If you are somebody who isn’t supposed to have a gun, you had REALLY better own up. The consequences will be worse if you say you aren’t carrying and LE finds a firearm.
