Its a private residence, if they show up do not let them enter. Kill loud music, open door slightly and step outside to talk with them, closing the door behind you. Drinking in a private residence and not causing a disturbance should not garner police attention. Police officers may use terms such as "mandatory search of the premises" to gain entry, without a warrant or cause (such as visable illegal drugs, extremely loud music, someone screaming, etc) they have no right to enter. Politely inform them you will keep noise to a minimum, apologize and ask them to leave. Oh, and if you choose to run from police (for ANY reason), that can be felony evasion, failure to follow direction of an officer, assault (with weapon if you have anything on you), and a few other charges. NEVER run from a police officer, it will only make things severely worse for you if caught. Do those charges sound crazy? Well the simple act of disobeying a police officers request to speak with you followed by running can rack up all of those.

It depends on what your parents decide they're going to do to you when the police call them and tell them they need to come back to town and pick you up at the precinct. As a minor with no adult to take immediate charge of you, you'll almost certainly be taken into custody until a parent or other family member is available to come get you.

On top of that, your parents will be the ones who will be stuck with the legal ramifications. Any criminal charges or fines will be their responsibility, because you're a minor.

You also sort of have to realize... you'd be hard pressed to have 45 drunk adults at this party and not have them completely trash your house and everything you own. Having 45 drunk minors is just utter stupidity. Even if you somehow managed to *not* have someone call the cops on you, the odds of you being able to clean up the mess before your parents get home are slim to none. Have fun cleaning up the puke, the spilled liquor, and the feces (because someone *will* poop someplace they're not supposed to).

So I really can't say would would happen to you. If it were me at that age, I'd have a sore backside for a week, and wouldn't be leaving the house or seeing my friends outside of school until I was 18. Assuming my mother didn't just kill me outright... LOL!

i was at this party and people under 18 were drinking there. the neighbors called the cops and they came to the house, wanting to speak to the 16 year old boy that the house belonged to. the officers told him that it was too loud and how much trouble he is in and wrote down his information from his driver's license. at the end, they said that they will give him a warning. does this mean he is off the hook and they will not mail a ticket or call his parents the next day (cuz they didnt do it that night). also, the cops so no alcohol cups or cans and did not ask if the boy was drunk.

iv been at many partys that got busted for underage drinkibg. Cops will come in and tell everyone to get on one side of the room. people who run other cops will chase them and automatically take them to jail for fleeing. he will see whose really ****** up looking and prolly take them to jail and throw them in the drunk tank til the morning. He will smell everyones breathe and clear for those to go. People who didnt drive will be forced to call there parents. I ran through woods when this happend in a rich gated golf community neighbor hood. a group of us was outside and we saw the cop talking to everyone. i saw black people run so i jeted with them hahaha. noone got cought running or went to jail. Bumch of people called sisters, aunts, uncles, ect. so they wouldnt get in trouble i hitch a ride with a friend who was cleared to leave.ANd if uinderage and no parents the cop will imediaty call your parents, if they dont care tell them to act like it so they wont get in trouble.

It really depends on the town and what you are doing. State law prohibits minors from purchasing alcohol, and consuming alcohol in a public area (e.g., park, restaurant). There is no state law against consumption of alcohol on private property, but many towns prohibit a minor from consuming alcohol unless their parent is present. If you tell me what town this party is in, I can tell you if the town has an ordinance against underage drinking on private property.

The other issue is whether the police can enter your house. There has to be evidence that a crime or violation is taking place. Don't blast the music, and there won't be a noise complaint, and it's far less likely that the police will come to the house. If the police do come to the house, I suggest telling them that they cannot enter. If they enter anyway, often any criminal charges have to be dropped because it's considered an illegal search.

Depends on officers discretion. I once was at a party with under age drinkers and a cop showed up ( hince: cop not cops ) and he spoke with the resident of the house and said he knew there was underage drinking going but he would let it slide just this once. He asked for everyone to stay inside and if he were to return again, then he would begin to take action.



If everyone is in your house drinking and someone starts beating on your door, dont open it automatically. Check to see who it is and if it is the cops and you do have underage drinkers, hide all visible alcoholic beverages ( Plain Sight Doctrine ) and have people get out of sight whom might seem to be underage to the officer(s). Depending if you own your own property determines whether or not you should step outside your residence, because depending on the officer(s) they can charge you for P.I ( my experience ) for example you reside at an apartment verses you owning your own land and house.

If anything, just dont open the door. You have no obligation to open the door for the police.


Edit: Dont kick anyone out. What friend would have people at his house and drink then send them on their mary way? Bad manners. Plus, odds are the cops are keeping an eye on your house, and waiting for people to leave so they can bust them and get PC to return to your house and enter the premises and arrest people.

I disagree with Owen Miller somewhat. When called to an underage party, multiple, and I mean multiple officers show up. They surround the place for anyone that tries to run. Then an announcement is made for everyone to file out the front door with ID’s or drivers licenses in hand. Anyone who is underage is pulled to the side where an officer with a breathalyzer is waiting. If they have alcohol in their system they are arrested. If they don't have an ID they are put to the side in cuffs and later will be asked for info so they can be run in the system to see if they are over or under 21. If they are 21 or over they are free to go. Anyone who runs out the back or sides is arrested. When everyone except those still sitting in cuffs(which is usually a lot of people) are gone, the owners of the house or whoever is in charge(like the parents own the house and their kid is running the party) is dealt with accordingly. That would mean under 21 and they will be arrested for multiple crimes and parents will be called. If they are over 21 and it's their house multiple citations are issued and some officers may choose to arrest. A paddy wagon(transport van) is then called for the multiple multiple people that have been arrested. Now remember my answer is reflecting upon a large department that has the resources. If it's a small department then I would have to agree with Owen Miller to just make everyone scatter, but then the person who owns or lives in the house would receive multiple citations.

From the cop perspective:We would park a ways away and walk up to the location. When we encountered wandering drunks we ascertained if they could make it home, and most often they were sent on their way. If they were too drunk to walk or drunk and disorderly we arrested them. They could be charged with Disorderly Conduct (expensive) or Public Intoxication (less expensive). If they were under 18 we called their parent to come get them, and cited the kid for minor in possession of alcohol. Using this walk up technique would give us a better idea of how disruptive the party was. By the time we made it to the door, the walkers we sent home had usually called or texted someone at the party and told them we were coming. On numerous occasions this caused the party to quiet down without us doing anything.If someone answered when we knocked and announced we would find out who was in charge of the residence. Inform them that their party was too loud, and tell them to turn the music down, close the windows, and keep everyone inside to take care of the noise. We would promise them that they would go to jail and incur several thousand dollars of charges for every violation we observed, if we received another call about their party. We would recommend that they voluntarily shut the party down now as it would be free, or have us shut it down when we get called back, when it would result in huge fines.Then we left. If called back, there was zero tolerance enforcement. Most of the time, the party giver was smart and did the prudent thing and sent people packing. On occasion they did not take advantage of the non enforcement option, and went to jail when we returned. Everyone under 21 was either cited / arrested, parents were called if they were under 18 to come get their little darling. Nothing warms a parents heart like a 2am wake up call from the cops. KEGS were seized as evidence.A good time would be had by all.

This is going to depend upon the age of the violator and the law of the state and/or community. Remember that this offense can be committed by a juvenile or an adult (since one is an adult at 18, but alcohol laws generally apply to those under 21).For example: In California there is no state law making it illegal for a person under 21 to drink alcohol. What is illegal is for a person under 21 to purchase alcohol, or to possess alcohol in a public place, on the street, in a vehicle, or in a bar. That offense is punishable by a fine and mandatory community service. The more important consequence is that conviction carries a 1-year driver’s license suspension, whether a vehicle is involved or not. Also, if a vehicle is involved and is registered to a person under 21 it can be impounded for up to 30 days (which is horrendously expensive).There are also some local city laws which make it illegal for a person under 21 to drink alcohol, whether in public or private. The ordinances I have seen are all infractions, punishable only by a fine, but I cannot claim to have read every one of them. (I have a vague recollection of a statute which concerned open containers in vehicles in public garages but I cannot find such a statute at the moment and may be mistaken.)
