What Does Indiana Law Consider Pre-existing Conditions As Far As Auto Accidents Go

If medical records are confidential, how do insurance companies find out about pre existing conditions?

Normally you file an application. You are asked a lot of health questions in many cases including medications you are on, surgeries you have had.MANY insurers also want you to sign so they CAN legally access your records. For some things it is apparent from the treatment they receive bills for that it is a pre-existing condition. IF you lie on your insurance application, then they MAY be able to cancel your policy and leave you holding the bill because you would have committed fraud.Pre-existing conditions are not the issue with rescission now; it happens less often but as premiums have skyrocketed that may not remain true so I am not sure if you lie if the law changes that you would not have a mess on your hands. Good idea to be truthful anyway. How Health Insurance Policy Rescission WorksAlso more on pre-existing conditions:Pre-existing conditionsHealth Insurance and Pre-Existing Conditions in 2018 | Pivot HealthSo your health insurer might know things because of how long you’ve been insured by them. Or some people have an insurer, change, then eventually go back. If they had you earlier on, they legally have that information.

Got into ACCIDENT, NO INSURANCE, NOT my FAULT?

What will happen now is that if her insurance finds that she was liable, it will pay to repair your car. The fact that she admitted she was at fault, despite what so many people think, doesn't count and means nothing. Why? Because she doesn't get to assess fault, only insurance companies get to do that.
You may be arrested for driving uninsured and without a license but her insurance will still pay for your repairs if they determine that their insured was at fault. (If you account of the accident is accurate, It does sound like she should be found at fault)
Getting insurance now will not help you for this situation. That would be like closing the barn door after the horse got out.
By law you need your states minimum liability coverage.
This is a helluva time to be thinking about buying insurance. You apparently weren't worried about it before?
Park the damn car until you get a drivers license and insurance. Remember what my Dad told me once when I got in driving trouble.....................:

To prevent speeding, why don't they manufacture vehicles pre-installed with speed governors or limiters?

To prevent speeding, why don't they manufacture vehicles pre-installed with speed governors or limiters? This would be insane unless there was a switch to override it.A lot of people don’t live right next to a hospital.People do get injured, they get heart attacks, strokes, they suddenly start delivering the baby..There are many different kinds of reasons to exceed the speed limit in special circumstances.Last but not least, I live where there are a lot of tractors and other slow vehicles. While technically you’re not supposed to be speeding, in theory temporarily exceeding the speed limit can facilitate a safer passing of another vehicle on the road. This is because you need to spend less time on the wrong side of the road - on the side with incoming traffic. But above all, if it’s 4 am, someone is dying on the passenger seat and you’ve got 40km to the nearest site of medical assistance - even if they had sent an ambulance to meet up with you, you can save someone’s life by speeding. No other cars on the road, you can hit 180kph on the straight stretches to buy precious minutes. But you couldn’t if the cars were built so that you couldn’t exceed some speed limit. And this is one of my concerns for the automated cars of the future. Can you somehow disable the autopilot and speed limit when human life is in danger?Emergency does not go by the law.

Why is it considered illegal to not have health insurance?

How do I avoid paying for Health insurance in America and still be legal? In the U.S. it is NOT “illegal” to opt out of obtaining Health Insurance.Your choices as an alternative of securing “essential health benefits” are:Pay the Tax PenaltySeek an ExemptionThe Tax Penalty for 2016 is 2.5% of your total household Adjusted Gross Income, or $695 per adult and $347.50 per child to a maximum of $2,085.The tax/penalty can be considered an opportunity cost of purchasing your health insurance. In other words, you are foregoing the $2,085 (savings) off the cost of health insurance if you chose to secure coverage.Though not a huge incentive, in your example, $1,500/month or $18,000 per year would actually be net cost to you of $15,915.No doubt, that is a lot of money. Yet your exposure to a catastrophic loss because of unforeseen medical expenses to you or one of your family members is exponentially higher.

Do I need car insurance to test drive a car? If the dealer does hold insurance, are there any requirements on the deductible? In other words, how much would I be liable for if there was an accident, before the insurance kicks in?

Yes, dealers hold "garage policies" that cover test drive liability (as well as many other forms of liability). Specific dealer to dealer insurance requirements of shoppers for test drives depend on the insurance policy of the dealership, which is affected by the state in which the  dealership is operating, and may be affected by the manufacturer. Generally, dealership insurance policies are set up so that your insurance is primary, and the dealer's insurance is secondary. In other words, if you get into an accident that's your fault, you're on the hook, and if your policy gets maxed out, the dealer is usually on the hook regardless of what their release of claims states. However, there's one common exception that comes into play if you don't have insurance. Many dealerships (particularly dealerships that sell non luxury brands) are set up to supplement uninsured motorists for non negligent damages up to state minimum requirements. For example, you're an uninsured motorist, you get into an accident during a test drive that is your fault, there's no negligence involved, you cause $10,000 in damage to the car, and the state minimum in damage coverage per incident is $25,000. In this scenario, many dealers have policies that would cover the cost of repair.

Are car insurance claims filed even if there is no damage done to the car?

Ideally, you should report all accidents to your insurance company, even ones where you are NOT at-fault. If there are injuries (to you, your passengers or the other party), you definitely need to file a claim (even if there is little or no damage to your vehicle).Depending on the requirements of your policy, you must report an accident within a specific time period (usually anywhere from 7–30 days) in order for certain coverage to be applicable. By not reporting the accident, you could forfeit your coverage against an uninsured or under-insured driver (if you have UM/UIM). More commonly, failure to report an accident can nullify your insurer’s ‘duty to defend’ if you are sued by the other driver! That advice is based on my professional experience as an independent agent since 2009. Personally, I think there are situations where you must make a judgement call. If it’s a parking lot accident with minimal to no damage and no police report, it’s probably not worth reporting. But if there’s any chance of injuries or a future lawsuit, it’s simply not worth the risk of not reporting it!Unfortunately, it has been my experience that the vast majority of insurers report every claim (including claims where nothing is paid). Some even report coverage inquiries (for example, if you call to inquire about glass coverage because your windshield is broken, they’ll record a claim even if you don’t file a ‘claim’). Roadside assistance claims are also reported by many companies. I advise all of my customers to buy a membership to AAA (if they don’t have coverage from the vehicle manufacturer).Almost all (99+%) of insurance claims are reported to LexisNexis and compiled on a report called a CLUE (Comprehensive Loss Underwriting Exchange) Report. Your auto claims history is saved for five years and virtually all insurers use that information during their underwriting process. So you don’t want a $0 claim to be reported that could cause a rate increase or non-renewal in the future!
