What happens if the cops are called on a parentless party you're throwing as a minor?

Well if you’re the minor throwing the party, just pretend you are one of the guests and leave with everybody else. :) dont take the responsibility if you don’t have to.But what would happen legally if you were caught having a party with underaged kids drinking? Depends where you are located. But possibly arrested and taken in and fined. He could be charged for underage drinking and supplying alcohol to minors- and also the parents could be charged. It is a misdemeanor though in most states I believe.If some kids were caught at the house drinking they could get arrested for underage drinking. As long as no one got in an accident those are probably the only charges. If someone gets in an accident and dies, then the parents would be charged with some kind of criminal negligence, because they’re supposed to know what is going on at their place of residence. The penalties get worse if there is more to it than just underage drinking.id like to add that when I had a party that got out of control, i had already prepped my house for it so there were no valuables. I tried to get everybody to leave once I realized people had to park a mile away because my entire cul de sac was filled with parked cars. Eventually the police were called and everyone scattedred thru my backyard including myself. I didn’t care to lock up or anything because there were already 100s of people in there and House was prepped. My dad, aunt, and brother were all attorneys at the time so I always acted like a spoiled brat ass hole and got away with murder usually. I live in New Jersey though, so I think that the police don’t take house party calls as serious as other states. NJ can have uber rich folks and a half mile away be an apocolypto ghetto. So they have other things to worry about at least in this area.

Neighbor called the cops on us for smelling weed?

OK so the neighbor has called the cops on us for smelling weed. this crazy lady lives above us and i had never seen her in my life until she knocked on our door screaming saying shes smells weed in her apartment. my bf talked to her through the dead bolt and she was flippin out and i shut the door and we got our stuff and bounced. this wasnt the only time, The other night it was her who called the cops on us, but we didnt know it then, and we went out to eat, and left some drunk friends there who said the police knocked on the door.

Can the Police enter our house while we are not there? Can they do anything to us, or could she try to get us evicted over this??
im at a loss for what to do and kind of in shock because i have never seen this lady in my life.
what rights do i have?? can the police enter my apartment right now while im not there and search it?

What to do about neighbors smoking weed? Already called cops. Citizens arrest? DEA?

If you don't like the laws, then work to change it. Frankly, I think you need to quit whining and worry about your own family. They aren't hurting you.

You can make a citizens arrest, but all that means is you detain him until the police arrive. But you can't go onto his property, that's trespass (the assumption being that you would not have permission). So he could file a complaint with the police as well.

The DEA has more important things to do than worry about a college kid smoking a joint. Like going after drug cartels.

Why don't you go ahead and move out. It sounds like nothing will make you satisfied. Why the hell do you want to ruin people's lives when they are harming no one. You already called the cops. He already got the infraction. What more do you want?

Next time you pay a tax bill, think about how much it will go up if the cops spent all their time going after pot infractions. And when you need a cop for a real crime, don't complain because they are busy going after guys smoking a joint and can't help your wife or kids when they are being robbed or something.

Sometimes yes we can. It all depends.Back in January, 2017 a neighbor called that she could smell the odor of burning marijuana emanating from her next-door neighbor’s apartment. We responded to the location. It wasn’t my call. I was acting as the cover officer. As soon as we got out of our cars we could smell the marijuana. Last January was very cold and snowy and everyone had their doors and windows closed and the odor was still very strong — that’s pretty impressive. So we made contact with the calling party and she directed us to the right apartment. We knocked on the door like the gentlemen we are and, incredibly, the door opened.We were slammed in the face by a wall of marijuana smoke. I could barely see that there were three men in the room behind the homeowner who had thoughtfully opened the door to us. They were smoking a couple really pretty, and expensive, glass bongs (Oregon is next door and there is a head shop just a little ways across the state line). They were all in their late fifties and just kicking-back watching the NFL AFC Championship game (New England Patriots vs. Pittsburgh Steelers), smoking some grass, drinking beer and eating pizza.The responsible officer explained to the occupants why we were there and asked if they were indeed smoking pot. They said yes they were and let us into the apartment when we asked if we could come in (the other officer and I are big believers in the soft approach first). We confiscated the bongs and pot, and the primary officer issued them a summons for possession of a controlled substance. The homeowner also got a ticket for possession of drug paraphernalia (the two bongs which he stated were his). They were all nice guys and it was obvious they were very experienced pot smokers. I kept the door open since the air was so heavy with pot smoke. It was making me a little sick actually. We thanked them for their cooperation (I felt like we were British cops) and left. The whole call was very civilized.

Can police enter your house for a noise complaint?

Every situation is different and much actually depends on the individual officer and what he can articulate.

First off, ignore every answer that states, "they need a warrant"..a little knowledge is a dangerous thing.

Typically for most cops noise complaints are not a big deal. If the party folks treat us decently, we will try to do the same. I have never written a noise complaint ticket to folks who come to the door and act decently. Nor have I ever written a MIP (except while in field training) to underage folks who acted decently.

Party folks refuse to come to the door, or slam door in the face of the officer. Most officer's would be able to articulate an officer safety or exigent circumstances to FORCE entry to the residence. In my world everyone gets a ticket, peoples cars that are parked out front get impounded, folks go to detox etc. If its a rental property the landlord gets a notice from the city.

Now in your situation, if you refused me entry, much depends on what I can see and hear from the door or windows. If anyone looks as much as underage, I have PC in plain sight of a crime...no warrant required, as the evidence of the crime (alcohol) is easily removed (whether down the throat or down the sink).

If you were try to interfere with my investigation...you would have been cuffed, and earned your buddies a ticket.

If I couldn't articulate a reason to go into your apartment, and you refused my entry I would cut you a $300 noise complaint ticket, and we would be done. Maybe if I was bored and vindictive enough I would roll by later in the night (or earlier in the morning) and see if I could catch myself a DUI leaving.

Well, first off I am in Canada. This question is appearing for me on Yahoo! Canada Answers... so I don't know exactly but, my experience with protesting and activism and the police? They have a LOT to do and if they are going to bust someone for dope (seriously, they have more important things to do- I believe marijuana possession is still a criminal offense in the US? In BC, where I live, it's been decriminalized but is not legalized). Anyway. I think you are being paranoid.

If something was going to happen, I am 99.9% sure it would have happened already. Now, for the paranoia and the slamming window. Quite possibly the guy did smell your pot and the smell bugged him. Not everyone likes the smell of pot. Maybe he was having a bad day and the slamming window had nothing to do with you? Either way, I highly doubt your neighbor is going to phone the police on you for a doobie, even if he did realize your were smoking a joint. If he didn't yesterday, I don't think he is going to today, or a week from now or a month from now. People have their own lives to live.

In the future, try to smoke in your room. Or make pot brownies or cookies if you are too paranoid. Or give up pot.

(And yes, just so you know, I find the laws regarding marijuana in most of North America utterly nuts and hypocritical).

Demand to see the evidence (which you smoked up)? Phone the police long after the "evidence" is gone (he would look like a troll and the police would ignore him, imagine how that conversation would go:

"Hello, police? I would like to report my neighbor. I think I saw him smoking a joint..."

"Are you sure it was marijuana sir? Was he selling it? Do you have reason to believe he is involved with a grow-op?"

"No, but he's a teenager, so I think he was smoking a *joint*. And he was smoking. It stank. So I closed the window. Arrest him."

Dude... nothing is going to happen. Chill out. Watch some TV.

Can a cop enter your home if they smell marijuana?

It's complicated. Really complicated. Far more than this non-lawyer understands.Some ground rules:1. If they have a search warrant, it doesn't matter if they smell pot or not. They're coming in.2. If they don't have a search warrant, the smell of marijuana is one piece of information among a "totality of circumstances" that the police are considering. If that's the ONLY reason they're at your door and you refuse them entry, that's one thing. 3. If they followed you to the door for other reasons or if they think there is a violent crime or felony in progress or that you're destroying evidence, they may well claim probable cause and enter. That's the focus of the court case you mention in the question details.4. And yes... depending on the circumstances, they may well just be looking to nail you. Sorry about your luck. If you're the kind of person that knows you are "bustable" and/or you live in an area where the cops have a reputation for not respecting the community, you should probably think twice about hotboxing your home.Whatever the situation, a doorway confrontation with police is NOT the time or place to adjudicate the law or your rights. That's why we have courts and judges. Express clearly that you do not consent to a search, cooperate with reasonable officer instructions, and wait for your day in court.At that point, it's probably all about how good your lawyer is.
