Ideally, you should report all accidents to your insurance company, even ones where you are NOT at-fault. If there are injuries (to you, your passengers or the other party), you definitely need to file a claim (even if there is little or no damage to your vehicle).Depending on the requirements of your policy, you must report an accident within a specific time period (usually anywhere from 7–30 days) in order for certain coverage to be applicable. By not reporting the accident, you could forfeit your coverage against an uninsured or under-insured driver (if you have UM/UIM). More commonly, failure to report an accident can nullify your insurer’s ‘duty to defend’ if you are sued by the other driver!That advice is based on my professional experience as an independent agent since 2009. Personally, I think there are situations where you must make a judgement call. If it’s a parking lot accident with minimal to no damage and no police report, it’s probably not worth reporting. This is true, technically they should compensate you for the depreciation of the value. However, good luck. I have known a few people who fought this battle before. Usually takes a lawyer and months of back and forth dealing when you might possibly get a small check in the end that you will have to give to the lawyer. Insurance companies are out to turn a profit, and they have time and money to get as much out of you as possible. Good luck.

There is no such thing as a "fair settlement" amount. There is no "Chart", there is no "formula" to determine what, if anything you may receive. I wouldn't put one iota of faith in such a site as "injurycalc". How in the he** do they get to that number? Who made them the "expert"? The paying insurance company typically makes an offer, you can counter it if you like and then negotiate from there.
The amount of coverage the other person has should NOT be the determining factor in a settlement amount. If you think the injuries are worth, say $165,997.03 then that is what you should settle for. If the settled amount is more than the policy limits, it is up to the liable person to pay the remainder.
Because you may have to have surgery in the future, you should ask that the person that hit you (or his insurance company) pay for that future surgery.
BTW; Stay away from a lawyer for this if you possibly can. If you hire one, he will end up with most of the money and you will get nothing but the crumbs.

Yes, dealers hold "garage policies" that cover test drive liability (as well as many other forms of liability). Specific dealer to dealer insurance requirements of shoppers for test drives depend on the insurance policy of the dealership, which is affected by the state in which the  dealership is operating, and may be affected by the manufacturer. Generally, dealership insurance policies are set up so that your insurance is primary, and the dealer's insurance is secondary. In other words, if you get into an accident that's your fault, you're on the hook, and if your policy gets maxed out, the dealer is usually on the hook regardless of what their release of claims states.
