I've been caught a few times by police smoking a joint. First they'll ask you if you have more on you, its always a better outcome if you don't. So don't carry around a bunch of it with you. Basically if all you have is a joint or a pipe, they take it from you and send you on your way. Luckily most police officers in canada realize that a person who smokes recreationally isn't someone to plug up the legal system with, they are more focused on actual criminals here. If you are driving and smoking, you're gonna get burnt. While alot of officers are tolerant towards small amounts of marijuana,driving under the influence is a big deal and wont be ignored.

About all they can do is take your ciggies away. But to provide an underage person with tobacco is illegal, so that person could get into trouble.

As some of the other peeps answering this Q have stated - it varies with each situation. Being 18+ I've been 'caught' several times with weed or in the act of smoking and have never spent a night in jail. Being under 18 I imagine the chances are greater you'll face some trouble with police. The absolute best thing to do, imo, is be completely honest when the cops ask you about it. Being honest with a cop has gotten me out of DUI's on a number of occasions (even though smoking and driving is nothing like drinking and driving) and several other possession charges. Just be smart.. 3 years from now it'll probably be legal everywhere anyhow.. of course you still wont b able to smoke it outside/publicly.. legally that is =)

I live in California but do not have a medicinal card. What are the consequences if I were to get caught in private (ex. my neighbors call to complain about the smell or something)? What about in public? People have told me its only a fine of up to $100, I can not get arrested, and it will not go on my record. Is this true? How are the consequences/laws any different for someone who does have a card?

Haha okay this still makes me laugh!I'd been smoking weed since I was around 11. I was about 13 and while I was looking for sand paper for a school project, I stumbled across a random seemingly empty coffee can. Curious, I peaked inside and found a rolled up sandwhich bag with green stuff in it. I unrolled it to check out it's contents and found an 8th of weed! I was so excited because at the time I didn't have any. So I dipped in and took a good size nug and put it back before I got caught!!I continued to randomly take some here and there. Making sure I didn't take a noticeable amount, and rolled it up how I thought it was. I did this for a few months, thinking how sneaky and awesome it was…Well one day I ran out so I want into the garage as usual to dip into my parents stash can. But this time, the lid had in black bold sharpie: “Gotcha!!!” and the coffee can was completely empty. I was so scared, I want out the side door and went for a very long walk to think of what excuses I could give them. Nothing was really going to work. So I get back home an hour or 2 later, hoping things would just be left unsaid. NOPE. Haha they were in the living room waiting. My heart was racing, my mind about to explode thinking of my punishment. Starting blushing and sweating. Finally after what seemed like hours of silent parents staring me down, they finally said:“we always roll the bag up differently everyday so we figured you were taking some when the roll wasn't right… you need to ASK us next time. Can't stop you obviously from smoking, so instead of STEALING it from us just ask please.”I sighed a huge breath of relief. “Yes! I'm off the hook!” I thought.“Oh Megann, by the way, your also grounded for 3 months… “Damn… haha almost! They couldn't have been more mellow and nice about it. Surprised the hell out of me that's for sure! They could've done locked me up and thrown away the key for WAY longer then what I got, so that was pretty cool.The same scenario played out almost exactly the same when I got caught stealing their cigarettes too. Haha after I got a job at 16 my mom agreed to just buy me my own pack as long as I payed for them myself.

I was with a friend who had a small bag of weed he says he didn’t realise was in his toiletries bag, about 20 grams in think. He didn’t seem concerned when he walked past sniffer dogs so maybe he didn’t know about it. The Dog walked up to him and just stood at his feet next to the bag and looked at him at which time the handler came up and asked if he could examine his bag, asked if he packed it etc etc.they took him aside and went through his bag, opened his toiletries bag and found his weed. His eyes opened like diner plates and they asked him if it was his and he said yes but he thought he lost it. They separated us and took him to a room and asked him some more questions but didn’t ask me much. He came out about 15 minutes later with a warning and was allowed on his flight with me.

I t depends on the courts. He may go to jail and let him out on his own reconq. However since this is his first offense they will take this in effect and just make him pay a fine.

Either way, if a cop stops you and you don't have ID on you, he can just run you through the computer using your name and date of birth or Social Security Number. Finally, if you don't want to get a driver's license, at least go and get yourself a state ID card. If you ever get arrested for something more serious, you are guaranteed to spend a good amount of time in lockup while they try to verify who you are if you don't have ID on you. A state ID is usually around $25 so there is really no excuse not to have one.
