I am currently seving overseas and have been "over there" for about 6 months now. My son Cameron was born about 5 weeks ago and, obviously and regrettably, I was not there to sign the birth certificate. While certain laws may differ from state to state, in my case- because my wife and I are married, I was assumed to be the biological father and my name was placed on the birth certificate without my signature. In the case of an unmarried couple, if both parties are present for the delivery then it would be the father's option whether to sign or not. In a case where there is doubt as to whom the father may be, it is my understanding that the mother can request (but not force) the father NOT to sign pending the results of a paternity test.

Furthermore, and I know this goes beyond the question you asked, in the case of an unmarried couple, just because the father signs the birth certificate, it does not mean that he automatically assumes his full fatherly responsibility for the child. Well if the father should only have his rights terminated under exceptional circumstances.
he should have the right and responsibility that comes with being a parent. that includes seeing his child and paying child support.
the idea of the courts in the child is the "best interest of the child", which they usually don't think includes termination.
my suggestion is you take him to court to establish paternity, possession and access along with child support. ask for a stair step visitation. where until he has established a good relationship, he doesn't get her over night.
each state will have its own idea of what grounds are for termination.

I do not know about the birth certificate thing , but I do know that he can get parental rights if he goes to court and ask for a paternaty test. I am not on my sons b/c but due to her needing help from the state , she had to ask for test, and get me for child support 4 12 yrs she denied me father hood, then i was able to start a relationship with my son,(did not know till court order asked for test)
whaen he reached age 12.
I think the child at least needs to know his fathers name and you will need this also for any kind of state support for the child.

I feel very bad when I remember of this type of moment happened with my mom which my dad suppose to do same thing.I was tolerating this from past 3 years then my limit of patience have crossed then I've taken action against this. Then after hitting him I took my mother to local police station to give a compliant of this so we will be secure of giving first compliant.Then after giving compliant when I back to home he was not in the house went out even I grabbed his mobile phone cause he will call unnecessary people in middle of this fight. After this my dad never hits my mother. Then he felt guilt that my son hit me cause I made a mistake and did over.This was my experience which I shared with you. Dude it feels really bad when we see our mother is tolerating this. When we are still alive to safe them. Get up and raise your voice and take action. Don't get afraid of relatives and other people's they are just to have fun and watch action and nothing else. Please give me update if this works.
