Then you’ll have to hope the perpetrator shows-up for court, prove that perpetrator did it, and if successful hope the perpetrator actually complies with the order and pays you back. If not then you’ll spend more money to try to force them to pay. However, you can’t get water from a dry well or money from a perpetrator that doesn’t have any, and if the perp is going to jail he’ll have no way to earn that money either.Long story short the private impound lot benefits from a stolen vehicle and the victim gets victimized twice (once from the original theft and then from the law enforcement agency and private company that impounded the vehicle once it was located).

Depends on the rules for the state, and the policy in place at the tow yard.

Disclaimer, my answer is based on policy for my business, and Oklahoma law. Most state law is similar, but may not completely answer for your location.

You are notified when the car is towed, assuming the DMV has your correct mailing address. If you have moved, and not notified the DMV as required by law, that's on you, you can't claim "I didn't know".

If you go immediately, with proof of ownership and current insurance, you pick up the car at the lowest possible rate, because there is a daily storage charge.

After 30 days (minimum) I send you a certified letter that, unless you get your car, I will sell it at auction. Again, all I have to prove is that I sent the letter to the address for the owner on file, not that you got it. 10 days after that I can get a clear title on your car and sell it. By now you have over $650 just in storage, plus the costs of the original tow. If the car is in poor enough shape that there are no bids, I will tow it to the crusher, adding the costs of the second tow to get it there, and my labor for preparing it for the crusher who won't take vehicles with fuel tanks or batteries. Scrap prices are down, so chances are that will add to the bill.

If it sells at auction, I'll take that off the bill. The owner still owes the balance. In either case, I send a final bill, with a note to contact me if there is any question that the bill is not correct. 30 days later if I haven't heard from you, the bill is assumed correct, and I send it to collections. Most of the time collections gets me paid in a short time.

Yes, when you ignore collections, they do take you to court and add costs of court and attorney fees.

What happens when your car is impounded and never picked up?

I would think it would be wise to call them and see what you can work out. It would have been best if your son had had the car towed to your house instead, but he didn't, so you can't fix that. They might be able to "forgive" some of the fees and work a payment plan out for you. You don't need them suing you, and you don't need anything going against your credit just now. The longer you avoid this problem, the longer it will stress you out and you also don't need to be adding more stress to your life just now either. My credit is all I have, so I personally would be working with them to do whatever I need to do to save my credit. Maybe they need your permission to sell the car for parts, but you are not going to know until you call them.

If you don’t want the car and don’t need anything out of it you can just leave it with them, depending on it’s value they will eventually obtain Garage Lien papers and offer it for sale or if it’s value is too low they will sell it to a savage yard for it’s scrap value (usually $100–$500 depending on the price of metal at the time) Most towers will not pursue the charges with you but some do. Be careful, if your license plates are still on the car and the state that the car is registered in requires that you return them then you should discuss this with the Police and see if they will give you the plates or a suitable receipt for DMV. It can hurt to talk to the tow operator, depending on the cars value they may negotiate the charges or accept the title in lieu of the charges.

Well chances are they would call in your plates, or they would contact the dmv with the vin, either way the car will be traced to you, and you will still have problems. If you want to get rid of it free of charge donate it and you can write it off on your taxes.

Not really. What they will do is put a lien on the car for the impound fees. In CA anyway, it depends on the estimated value of the car as to how long they wait until they lien sale the car (sell it at auction to recoup their towing/storage fees). Higher priced cars are sold later than “cheap” cars. Your best bet if you don’t want to get the car out of impound would be to contact the towing concern and see if you can work out a deal. For example, you could sign the car over to them and stop the daily storage fees. If they sell the car for what you owe for example, you’re breaking even.

If you ignore that, they can offer it at auction. Since you say it's wrecked, it will probably only get a bid from the crusher. The towing company will add the costs of preparing the vehicle for the crusher, which would include removing all fluids and disposal, removing the battery and gas tank, and towing to the crusher, then subtract the amount they got for scrap metal. You will be billed for the balance. If you still don't pay, it would depend on the rules for the state. In some they can revoke your license for non payment. At the very least you will be turned into collections.

Best thing to do always is call the tow company early and tell them you don't want the vehicle. They may allow you to give them the title and drop charges at that point. Even if they don't, it will be much cheaper early than late.

Yes they can and will! They keep your property unless you pay their impound fee and towing fee. If you don't pay they keep your belongings.

It won't do any good to sue them cause you wont win. Cause legally they have the right to you car and anything that was inside of it at the time of the impound. If you want your car and or your belongings back you will have to pay them. Might I add the longer you leave it in there the higher the price goes.
