Since your from India you'll probably be looking for an H-1B visa. Assuming that you have a good employer with a good legal department, and they premium process it, it will run the hiring manager's department around $5000 for everything (filing fees, PPS fee, attourney fees for drafting up the paperwork). Keep in mind that H-1B is a lottery these days, and you only have about a 30% chance of being selected. If you do not get selected, only $2000 or so of that $5000 will be returned to your employer. So from their point of view it is like buying you a $3000 lottery ticket to see if they can hire you. So I hope you have enough skills, experience, and education to make it worth their while :) There are also several Indian outsourcing firms (like GCI) that will basically sponsor your H-1B and inconspicuously take the fees out of your pay for the next 2 years. The client pays the consulting company, who pays the Indian outsourcing firm, who then in turn pays you. It is highly illegal for your employer to work your visa filing fees into your billing rate like that though...so I don't know how those operations are still even allowed to be in business. If you see "corp-to-corp" or "Statement of Work" in the job offer, I would suggest staying away from it. You want to be highly exploited for the next 3 years, working 60+ hours per week and only being paid for 40, probably not worth it. You will not be able to make much more money in USA than you can in India if you have 2 layers of leeches sponging away a percentage of your pay every month.

well, you ran into one officer who didn't like your story. it's possible that a different officer will feel differently. so, if you reapply, stick to your story. it's in the record and if you now say something else, you'll destroy any chance of being approved as no one will trust you. Canada may well be easier for now.if you take the exam there, it won't affect a future student visa application to the US.

You would have to apply to a US school or university and be accepted before a student visa could be considered. So, the question is not would you be considered for a student visa without the GED, but rather, would an American university accept you as a student. The school would have to send you an I-20 and register you in the SEVIS database before you could apply for a student visa. Whether your student visa application would be approved is another matter. Hard to say.

Yes, she does sound like she will qualify...she needs to bring documentation of her business and home ownership and her bank records when she goes in for her interview. She will need to make an appointment for her interview at the embassy in Mexico City as it is the closest place. There is no consulate in Veracruz. Good luck to her.

No, it' not legal to "work in the USA" on a B1. A B1 is a "Visitor for business purposes". The visit must be to further the individuals business OUTSIDE the USA, not to perform work while here. So an engineer, for example, can enter the USA on a B1 to visit his clients, have meetings and talk about a project, make sales calls, stuff like that. He can't legally enter the US on a B1 to go around to clients sites repairing their equipment. You can report Visa violations to ICE, and the violator will be deported. Visa fraud is also a basis for denying any future Visa applications, so they won't get back in either. Richard
