What does it mean when a house a warranty on the foundation?

Obviously, there has been foundation problems. The owner has had SOME work
done. The repair company has given a warranty for THEIR work until 2018 as well
as an agreement to either give $200. or some further work, worth $200. when
further repairs are required. Your concern now, is that you need to realize that
there is an existing foundation problem, that has had a fix job that lasts for 2 years.
The problem remains. It has been fixed only for now.
Do not be intimidated by realtors and the owner who just want to get the house sold. This is a serious problem which will continue. If you have unlimited funds
to continue shoring up a foundation, then buy it. Learn the hard way.

When you buy a house do you always have a one year warranty?

If you are buying a NEW home from a builder or having a home built to your specifications from a builder, the workmanship is covered under a warranty for 1 year. Some items like foundations, you may have 3-5 years in some instances.

If you are purchasing a home from an individual seller, there is no implied warranty unless it is stated specifically in the seller's disclosure statement or in a purchase agreement signed and agreed to by the seller.

When you purchase a house and suspect a problem with something like a leaky pool or basement, you can ask that the seller specifically warranty these items. The seller can choose to or choose NOT to. It never hurts to ask, especially when the housing market is this slow. It is a buyer's market and seller's need to give a little more in order to sell in most cases.

The worst thing about Real Estate in India is that it isn't regulated so far. So there are no uniform guidelines pertaining to defect liability periods post possession. In absence of any such mandate, it remains to whims and fancies of developer to have  or not have the said period in the sale/construction agreements/sale deed. Some conscientious developers do have it for 1 year post possession. So eventually it's your due diligence to find it out, to demand for it and to demand for a longer period!  Edit: with latest real estate regulation bill passed in Rajya Sabha on 10th March 2016, developer's liability for structural defects (if any) has been fixed upto 5 years from possession. That's a good news.

What is an average warranty on home plumbing?

My wife and I just bought a new house (built in 2009, we were the first to purchase it - have lived in it since May of 2010). It's two stories, with 2 bathrooms upstairs and one on the first floor.

Last week, almost any water in the house, be it shower water, sink water, dishwasher water, toilet water, or tub water, would back up into the downstairs toilet. We had a sewer unclog company, RotoRooter, come out last Wednesday, then the problem persisted, so they came out again on Friday (happy Christmas Eve to us). The problem has started occurring yet again.

They said they think it's a rough piece of pipe causing our plumbing to clog up too easily, so they reccommended we contact the builders of the home. The builders immediately referred me to the plumbing company they worked with on our house. The plumbing company is blaming it on RotoRooter for not clearing out pipes out completely, while RotoRooter is blaming it on the plumbing company saying it's probably a piece of pipe that's settled or gotten scraped up somehow and is clogging very easily now for some reason. Neither company wants to accept any responsibility for fixing the problem.

Ultimately, if it turns out to be the plumbing company's fault, is this something they should cover under some kind of warranty? I know it varies from comapany-to-company, but what would be a typical warranty for this type of thing? 60 days? 6 months? Years? I don't have any warranty information documented from them since they worked with the builders of course who we bought the house from.

I feel like I'm getting jerked around here by both companies. Any suggestions?

The company should have a copy of the warranty if you mailed it into them. If not, afraid you could be out of luck.

What is a General Warranty Deed?

Wow...looks like it's been a long time since some posters have went to real estate school.

The keyword in the term General Warranty Deed is "warranty". It is the most common instrument used to transfer title by fee simple (complete ownership) in the USA.

What the General Warranty Deed states, is that YOU are GUARANTEEing to the new buyers, that you had 100% legal right of ownership, 100% exclusive right to sell. Not only that, but you also guarantee that you had these rights...forever, as long as the new owner owns the property, and that no one before you has the right to come and interfere with the title transfer.

In contrast, there is something called a Special Warranty Deed that is most common with foreclosures and commercial property transfer.

A special warranty deed, they are guaranteeing the property ONLY for the time that the current owners owned it, but they are NOT guaranteeing that someone else before them could come back and make a claim on title.

Land has the same general or special warranty that a house does, because what you are giving is essentially the land with everything attached to it.

Used car warranty, repair denied had car 1.5 weeks?

Speak with the manager, or General Manager, of the dealership. Bring the warranty paperwork with you. Tell him you feel you were scammed, by buying a vehicle with a 60-day warranty...a warranty that conveniently "doesn't cover" the repair you're needing. Try to work something out with them before seeking legal advice. There may be fine print in the warranty that you didn't see. If it says ANYWHERE in there that they have the right to approve or deny any repair for any reason, you're screwed...might as well find a repair shop that will do it cheaper. Usually, if they're a chain and you threaten to go above them to get someone to resolve the matter, they'll cave and fix it. Nobody likes negative pressure from their boss.

Foreclosure/No Home Warranty?

No, it's not a bad idea. A lot of lenders are offering homes they foreclosed on in "As Is" condition, because they have done nothing to improve the property after the former homeowners moved out.

You should definitely ask to do an inspection (paid for by you), and walk through the property and check if anything is missing, damaged, etc. The foreclosure victims may have removed all the copper piping, for example, but you won't know that without checking. On the other hand, they may have done nothing to the house to damage it, but the bank simply doesn't care enough to make sure everything is as it should be.

If you are getting a good deal on a foreclosed house, then consider taking some extra money and putting it in the bank, in case you find out suddenly that you need it. A roof might start leaking right away, or a piece is missing from the furnace that was taken by the former owners, etc. It's a good deal because no one is quite sure what they're getting, so plan for the worst.
