Can a child legally live in a basement when CPS is involved?

Today CPS was called on my brother's ex. His son is 8 and she (the ex) also has a 7 and 5 year olds lving there. CPS drug tested the ex and her husband, and gave them one week to clean up the house, buy the older two proper beds, and fix all of the holes punched in the walls. There is heavy drug abuse, child abuse and neglect going on.

My concern is that my brother is living in my basement and wants to gain full custody. He has a "living room space", "bedroom space", and a "child's room space." There is a full bath but no ceilings. Its clean and set up nice, but no permanent walls seperating the spaces.

He could be placed on the main level and share a room with my daughter but the.space he has in the basement is bigger and he wont have to sharenhis space. His " room space" has a partition on one side for privacy from the rest of the basement. He has a twin sized bed and all of his things set up like a real bedroom. He has no problem with it.

I was just at a family gathering for New Years with family from Ohio ( I live in Michigan) and we got into a conversation about underage drinking. The family member from Ohio stated that there was a law that said that as long as the parent physically hands the alcohol to minors then it is legal. Everyone from Michigan thought that was outrageous and he was wrong.
I've searched for it and the only thing I can find that has anything on that is in reference to Drug Free Alliance. This program appears to only be located in Ohio. We argued for about 20 minutes on this so I just wanted to know if anyone knew anything more about the Drug Free Alliance or if there was a law or anything?

You have to check for your state law in regards to child endangerment. Each state varies.That being said, I always find it annoying when people say “My mom spanked me when we were little and we lived” or “my mom locked us out for hours and we lived”I'll tell you one thing, my mom and step dad spanked me a lot and I lived. Sure, I'm living but I'll tell you one thing, it did some damage such as not trusting her, didn't talk to her much, and it seriously caused a lot of aggression in me towards other people.Many times, I would get mad at people for the stupidest reasons. I was subconsciously imitating everything my parents taught me.The day I changed was when my 2 year old daughter grabbed a marker from my niece’s pencil pouch that was left on the table and she started writing all over the walls. When I saw that, instead of talking to her in a calm voice, I yelled at my 2 year old daughter. Just writing about it or thinking about that day still makes me cry because she doesn't know that what she was doing was wrong but I emulated my parent’s way of dealing with things that children do.Because of that incident that made me realize how similar I was becoming to my parents, I decided to change and talk calmly and teach her that some things can't be done. I'm always told she is very well behaved and that she listens really well. Perhaps, that has to do because when she does something wrong, I talk to her calmly.Sure, locking your child out is different than yelling but what do you or your child benefit from from doing that? Nothing! You're not teaching anybody a lesson.Sure, your child will live but I guarantee you that you're not teaching him anything at all with locking him out for several hours. That's just cruel!

The cops are wrong...this is a case of parental kidnapping....but since they will do nothing, in morning (don't wait a second longer), have your lawyer go to court for an emergency order to get your kids back. The longer you wait, the harder it will be for you to get them back. You could also "drive by" and grab them...there would be nothing they could do. Get going now. Good luck and God bless.

Addendum: When you get them back, have your lawyer request that all visitation from now on be supervised-only in a visitation center as your ex refused to give them back the last time he had visitation.

My Mom Keeps Cancelling My Doctor's Appointments!?

If you are in School, you need to speak to a school guidance counselor. You can also speak with someone at your church. If you have asthma and your mother refuses to let you get your medications, I am sorry but she could be arrested and charged with child abuse, child endangerment, and several other crimes. If you were to end up in the hospital, a report would be written anyhow if you are a minor.
I would let her know that you are going to report her to the authorities if she doesn't allow you to see a doctor. It is one thing to punish someone for not doing what they are told by not letting them see their friends etc, it is another to punish them by not allowing them access to medical treatment.
If the reason is lack of money, she can take you to the county health department or other low cost clinic.
what ever you do, reach out to someone in authority and not just on here as your situation needs to be addressed ASAP

If a child willingly goes with an adult against their parents wishes, can it be considered kidnapping, or is it illegal?

Depends on the child’s age. If the child is a minor and their is a court ordered custody agreement then in the aftermath, the adult with whom the child decided to travel with could in fact be charged with kidnapping. If any formal orders or previous incident between the minor and the adult has been written or documented then it could be kidnapping. Minors can merely make their opinions on cases they are involved in known to the courts but the judge will try to uncover the intent of the person accused. Think about it this way, many children who are kidnapped by and adult go with them willingly because they are tricked or lured in with bait or trickery. Therefore a minor child doesn’t really have the discernment to understand the choices they make and how they might affect them.
