Can a person be arrested for the same crime twice?

They could be arrested as many times as necessary for the same crime, they just cannot be tried in court or punished for the same crime more than once.

Is there a difference between an arrest warrant and a bench warrant?

Yes. They both will generally end the same way, but how they are obtained is different. An arrest warrant is written by law enforcement prior to making an arrest on somebody, in many circumstances, law enforcement does not need a warrant to make a warrantless arrest, but sometimes probable cause is established and a warrant need be issued. Usually a police officer rights the warrant, swears in before a judge that all information is correct, and then the judge will either grant or not grant the issuance of a warrant based on their belief of probable cause being established. In many areas, it is also common that law enforcement will actually submit their case to the District Attorneys office, and then the DAs office will file for a warrant, not the police agencyA bench warrant is when somebody fails to show up to court. Instead of a police officer filing for a warrant, a judge issues the warrant when that person isn't in court when they are supposed to be.Both warrants however, are executed the same. They both command any law enforcement officer to arrest said person and bring them before a magistrate (Judge).

Can you in the US be arrested twice for the same crime on different dates and given two different trials? Have evidence to clear it too.

It can happen.  Let me explain.  Let's say you robbed a store.  You get arrested for it and charged with robbery, but the evidence is weak and the prosecutor loses his case.  But then new evidence comes to light to implicate you in that robbery, say a video of you breaking the window of the store and entering it.  You've already been tried for the robbery charge, and they cannot try you again.  It's called double jeopardy.  But with the new evidence they can find a different crime to charge you with, say breaking and entering.  Now you'll be on trial for the second charge, even though it's related to the one crime.

Arrest warrant, wrong person?

My brother has been arrested or investigated on various occasions by different law enforcement agencies for another person’s arrest warrant issued by a court in Los Angeles County. The only thing in common is their names. My brother has appeared before the same judge more than once only to find out he is the wrong person. The first time he was arrested the victim said he was not the right person.

This problem has been going on for more than 10 years and he does not have the money to hire an attorney to fix this mess. Should the court who issued the arrest warrant do more to help him out? The only thing they did for him is give him a document were it says he is not the person in the warrant. Yet every time he is stopped for a traffic ticket or crosses the border into the US he is questioned excessively for hours. Can anyone tell me what I can do to help him?

Can a person on house arrest can he or she be around another person who also on house arrest?

The only time I could see that happening is if the persons were related and normally living in the same house.

Can a person be arrested for the same exact crime and have two different court dates?

In the US, if the criminal activity is a crime at both the state and federal level, the person arrested could be tried by both the state and the federal government. The trials would be on different days. They would not be simultaneous. They would be one after the other.Note this isn’t common. Typically, the feds or the state would prosecute but not both. But if the case is weak and the crime heinous then often the state prosecutes the state crime and if the accused is acquitted, the feds prisecute on the federal crime. (For technical reasons, the state goes first.)

Difference between Consensual Encounters and Detentions?

What is Consensual Encounter.?? Is that when a police officer aproaches you with no reasonable suspision.??? Let's say im at the festival and suddenly a cop stops me and begins talking to me ... and with a consensual encounter do i have the right not to answer or talk to the police officer.??/

and Detention, is that the same as Arrest.??? like both of them the police officer has to have suspicion, right.???

Can a white police officer arrest a native american person?

It all depends on where these two people are at. It is not the color of their skin that is an issue it is what ground they are standing on. Indian reservations have their own law enforcement and laws that govern their land, and when they are not on the reservation they must obey the laws as everyone in the US must do. But if a police officer enters their reservation his authority doesn't hold much weight.
