Whether or not your probation can be transferred depends on what type of probation it is. Was it a serious felony? If so, yes there is a process for transferring. It’s called Interstate Compact. There are many factors states consider when accepting or denying a supervision transfer. Some include; whether or not you have family in the state, or ties to the state; whether or not someone can be financially responsible for you if you do not have a job (although many states require it); whether or not you have a suitable residence etc. The sending state fills out paperwork for the receiving state. The case will be assigned to a probation officer for investigation. The PO will make sure everything you’re claiming is true and even then depending, your case may be denied. The receiving state can impose their own conditions of supervision on you above and beyond what your current probation calls for. You either have to accept that or stay home. And, of course there are fees.States are required to complete the investigation of the new location within 30 days give or take. Some states will find any excuse to deny a case. If you have no ties to the state do not expect your transfer to even be considered. For example, your boyfriend lives in Arizona and you want to live there. A transfer usually requires blood relation.If you have a low level probation case such as a misdemeanor, most states will not bother with a transfer.It’s best to stick it out where you are and be done. How long does it take for someone to transfer their probation to another state?

Very difficult to day exactly, because it us always different. A receiving state/ county can refuse to allow such a move if she does not have family she is moving to and/or a job waiting, that used to be interstate compact rules, they could have changed, but normally when those change they get more strict. I used to tell offenders to expect it to take 90 - 120 days. A lot of that is just the time it takes to work up the chain of command on one side and back down on the other side, then vice versa. Sometimes it was done quicker, other times it took about that long.

Will marriage help out a probation transfer?

All Interstate transfers of Probationers and Parolees are regulated by Federal Guidelines. The Interstate Commission for Adult Offender Supervision is the governing board for Interstate transfers. Should your probation officer choose to complete your application for interstate transfer, being a fiance or girlfriend of someone who has established residence in Florida, would be a discretionary application. Meaning, Florida would have the ultimate choice as to whether they want you in their state. Some states reject 99% of all discretionary requests.

If your boyfriend has not established residence in Florida, having no relatives living in Florida would also be a discretionary transfer. One that would very likely be rejected unless there is a solid job offer.

However, if your husband lived in Florida (He would have to provide proof of address in Florida), this would mean that the transfer acceptance would be mandatory. Of course this would mean that you guys would have to be apart for a while. One of the conditions for a transfer is that once your application is submitted, you cannot visit Florida until they accept your application. Acceptance of an application usually takes 2 to 4 months after it was submitted.

Hello Lauren. As I am reading your question, your fiancee is currently in prison. He will be filling out parole ( NOT probation) papers approximately three months in advance of his tentative release date.

Tell him to talk to his case manager in prison at this time. He can fill out the papers listing the information in Tennessee. The application will go directly to that state, where they will determine if Tennessee is willing accept his case load (which is not a guarantee).

The action that you are doing is called an interstate compact. As an average rule, it takes 3 to 4 months from start to finish.

One other note. You are stating he has a tentative release of January 2011 and his actual sentence is until March 2011. Is he being placed on parole for two months only or do you have your dates incorrect? A two month parole is highly unusual.

This can only be done through your PO. There are requirements to be eligible for interstate transfer. Briefly, you must be a resident of the receiving state, or have family there who will be responsible for your support until you can get a job. If you don't meet these basic criteria, your PO will not even request the transfer, and, if he doesn't, then forget it.
If you have a real need to move (job, fiancee, etc., then present this to your PO.

Can my husband be transferred to a prison closer to home?

My husband violated his parole bc he He owed $2900 in fines & didn't get them paid of as quickly as the pArole officer wanted him to. So he got 11/29 just for that. He got out of prison in January& wasn't able to find a job until June. He asked his parole officer to leave him alone & let him work until sept 1st he would be able to pay the fines off. They picked him up Aug
1st.
