What Rights Do You Have If You Are Pulled Over By Police And You Do Not Feel Safe Can You Insist

When pulled over by the police would it help you if you gave them this?

Here is your problem with that.
1. Police only need reasonable suspicion to stop you and frisk you. Yes, they can frisk you without arresting you. Look up Terry Frisk or stop and frisk.
2. all that talk about body fluids gives them reasonable suspicion to suspect you might be hiding something. Don't help them have a reason to arrest you or even harass you.
3.They are not not going to help you speak to an attorney or public defender. Their job is to arrest you.
4. They have to preserve evidence as it is what they will use to convict you with.
Here is how you handle police stopping you. First find out if the state you live in is a stop and identify state. If not you do not have to show I.D. just because they asked for it. In Texas you are not required to identify yourself unless you have been lawfully arrested and then you are only required to give your name, address and date of birth. Check your states penal code, usually under failure to identify, to see what it says.
Always use your phone to record the stop. It is your right. They cannot make you turn it off although they may try. Now, if want to go the route you posted then this is how it should be done.
Ask why your are being stopped. It doesn't matter what they say the next thing you do is say this.
I am invoking my First, Fourth and Fifth amendment rights, I will not waive these rights, please do not ask me any questions and then shut up. They will try to get you to talk but just keep repeating, am I being detained or am I free to go and do not say anything else. They will tell you they can arrest you if you don't answer but there is no law in any state or in the US Code that says you have to talk to a cop. The fifth amendment grants you the right to remain silent at any time, not just when you have been arrested. Use it. If they ask why you're being so difficult, just reply, rights not used are rights lost. Now, if you've done nothing wrong, this is only going to piss off the cop but if you've done nothing wrong he still can't do anything. If you have done something wrong, by doing this you at least aren't giving more info he can use against you later on. Most people get arrested and convicted because they couldn't or wouldn't keep their mouth shut.

My rights when getting pulled over by the police?

A Traffic Officer on duty has the authority to stop any vehicle that is been driven on the road, they DO NOT need and excuse to do so.
If you are stopped and asked to produce your documents you must do so. If you can not prove that you are insured and road legal then the officer has the authority under section 165 of the road traffic act to impound your car.
Some will say you have 7 days to produce your documents. this is not so as if it can not be verified at the time of being stopped that you hold a licence and are insured you will not be able to continue your journey.
You must also comply with instructions given by the officer so if he asks your name and address you are oblige to give it, if he asks you to get out of the car then again you must comply.
Remember driving on the road is not a right, it is a concession. so you must, at all times be aware of the law and the consequences of ignoring it.
As for recording the officers, you are within your rights to record any conversation which takes place between you and the officer, this includes video recordings.

WHY? Why would you? Why make things that much more difficult for yourself and the officer? Is it just to be contrarian?READ THE STORY BELOW and tell me if it’s worth it to be arbitrarily recalcitrant. Why make someone’s day that much harder than it needs to be? Why not simply show the authority figure respect? The guy has probably been through a hell that you couldn't dream of at some point. This is a story about a friend of mine in law enforcement. This actually happened to someone I know and care about. He was called to the scene of an accident in the woods. I don't remember every exact detail, but that doesn't matter. What he found when he got there was a tree that had fallen onto a man and his daughter. The father had died almost instantly, and the daughter was pinned underneath the tree with him. When he had gotten there, there was little he could do but try to reassure and comfort the little girl. This little girl had lain there for however long it took him to get there, by herself, with her father’s crushed corpse pinned under the same tree. When paramedics had arrived he found out that they couldn't move the tree and there was nothing they could do. He held her as she passed, as a result of the extensive nature of her wounds. Often times, after responding to an accident like this, officers will have to go back out onto the streets and continue doing his/her job.Imagine seeing that and having to go about the rest of your day like nothing happened. So then you pull someone over for a broken tail light or something mundane, and the little shit starts giving your lip because he feels like arguing! Why? What good does it serve to act like you’re better than someone who’s job it is to protect you?I hate seeing these kinds of questions because it just shows you how indignant we’ve come.Yes, eventually you will have to comply with the cop. There is almost definitely a just cause that he/she had for pulling you over. Just do what he/she says.

Is it legal to pull over behind a police officer during a traffic stop?

Yes it was legal and if we had the police officer's side of the story it would probably sound much different than your account. The officer's actions seemed excessive to you because you knew that you were not a criminal and were not involved in a crime. The officer did not. Police officers stop thousands of vehicles, some lead to nothing and some lead to drugs, guns, arrests, even shootouts. The driver of the vehicle being stopped always has the advantage because he/she knows what they are doing and what they are about to do. The officer has no idea who you are, what you have in the car and whether or not you are dangerous until after the traffic stop is completed. As you were driving at night and the police vehicle was behind you, it is not possible for you to have been able to determine the officer's speed and if he actually did run stop 2 signs (both of which they can do if trying to catch up to a suspect vehicle, by the way) which tells me that you may have assumed much during this incident. I pulled over a car early one morning and both the driver and passenger had loaded semi-automatic pistols under their seats. Luckily for me, I was assertive and cautious like that officer was that you described.

Do police officers have to tell you why they pulled you over?

He should of ask.

Sometimes they pull you over to get a reason.
If you are a minority or look suspicious to them, they will pull you over, of course they will not tell you that because that is discrimination, but they can say..."well you look like someone we are looking for" If you don't have insurance, license, registration updated or they are expired...they got you. Also, if you are driving in a (HOT area) meaning drug dealing area, prostitution etc...

1- You have to ask your brother, why didn't he ask why was he pulled over.
2- If there was no ticket given, what did they said when they left.

But again the police always have an asnwer, they can give a million reasons why they stop people even if they did not commit a traffic violation.

Next time tell your brother to ask:

Why are you pulling me over?

Hopefully this will help in someway.

Yes - you do. End of story. If they say, "Show me your license" you can be cute and “show” it to them. They will sigh and say, “Will you please hand me your license?” It’s not a game, you are not allowed to play semantic games. If you have this license on your person, expect a less than enthusiastic encounter. This is not a driver's license. You may own it (because you made it or bought it) but it is not going to work and if you flash it the cop will ask for your real one until you hand it over, or things devolve. What many people fail to grasp is ownership. You don’t “own” your driver's licence, or your license plate, just like you don’t own your passport. You have been granted a licence to operate a motor vehicle upon roads and byways. That plastic thing with your picture is simply proof of that license. The actual driver’s license, like your actual passport, belongs to the government that granted the license/passport. That’s why it can be taken away without compensation after x number of points - its not your property. You are not allowed to alter or manipulate the piece of plastic. Unless you turn it over, how can it be checked? It also has a coded bar and/or a chip. Officers have the ability to “run” that licence in a reader and in order to do so, they must have it in their possession. That is but one way to determine the validity of the license. So long as the officer has a legally cognizable reason to request your licence, you are obligated to deliver it. That also means that if you don’t think their reason is justified by the circumstances - well, too bad. You still have to turn it over. You are not a sovereign citizen and I don’t care how many people tell you that you are.I have seen the tricky scams and ideas put out there, and they do not work. Besides - when the office pulls you over and asks for your “license, registration and proof of insurance” what's the big deal? It's a light-switch issue - the switch is either on or off. You either have them or you don’t. There is no third choice.Note - in some states you may think you "own" the licence plate because it goes with the car you own. Sell the car, keep the plate and put it on the next car. But you really don’t.

Can a police officer pull me over for no reason?

that is considered sexual harassment. he violated your fourth amendment of unlawful seizure and search. if he did any of this without your premission that is against your constitutional rights. he cannot search your body if you requested a female officer. and he if did search you it had to be an outer hand search meaning no palms touching your body. he cannot reach into your pockets as well. all the other things he did and said was sexual harassment. you cannot really win a case like this unless you have a really good lawyer [unfortunately they are expensive] but normally you have two witnesses, the camera on the police car and the other cop. the other cop could lie but the camera could not unless they turned it off which i doubt. do you have the officers names or plate numbers? if you do not you are basically going to lose the case.

one officer pulled me and some friends over and proceeded to search the car and us, he told me to put my hands on my head and I said no, then he said what did i believe he could not search me, and i said yes. he then said "tell me where in the constitution is it stated that I cannot search you" he searched me inner palm and reached into my pockets for my phone and cash. I felt the same way. there were two officers and i was traveling with my boyfriend and his best friend. I then went home to search the constitution. I suggest you from now on the carry the pocket constitution or a copy of the bill of rights in your vehicle if you are ever challenged by an officer. by law you are allowed a female officer to search you.

i hope i helped and most cops are pigs anyways. it is best to protect yourself. especially if you are a female.

you can also call 911 and ask if there is a stop in your area done by an officer if it is at night and you are alone and the officer is in an unmarked car or police car. all officers are required to report when they are pulling someone over and why all the time.

edit: an officer cannot ask you to step out of your vehicle for a traffic stop. unless you appear to be under the influence and they have probable cause.
