What Would Happen If Local Police Incorrectly Seize A Citizen

What would realistically happen if the US government started seizing all privately owned assault rifles?

(Answer containing assumtions. I assume you're refering to 'assault weapons', not 'assault rifles'. Since 'assault weapon' means whatever the person using the term wants it to mean, I assume that you mean that you want to take any scary-looking modern-ish rifles away.)What would happen is massive civil unrest, and bloodshed the likes of which haven't been seen on this soil since the early 1860'sThere are close to 100 million gun owners in the country. Let's make another assumption and guess that 10 percent of them have 'scary looking rifles' of one kind or another. That leaves 10 million people you're trying to take weapons from. Let's make another assumption: at least half those people won't want to give them up. That leaves 5 million people that will have to have theirs taken by force. 5 million people is roughly twice the number of police and military combined. Here I'll make another assumtion: at least a quarter of police and military would refuse to comply, and at least half of those would actively resist. Now (based on a series of assumptions and estimations) we have just over 5 million people on one side, and anout 2 million on the other side. Nobody is going to want to fire the first shot, but as soon as someone does, all bets are off. A civil war will have started. People will quickly take sides. My guess, honestly, is that it will be split about 25/75, with 75% supporting the seizures, because the media will be on that side. But popular support will be less important in the beginning than which side is willing to actually fight. Those against seizure are more likely to be willing to fight than those for it. The last time there was something like a civil war in this country, between battlefield deaths and deaths from illness, nearly 700,000 people died. We have better medical technology now, so fewer are likely to die from disease, and masses force-on-force battles would be rare, so the numbers killed at once will be lower, but the war is likely to linger for much longer than that conflict did.All in all, I'd expect no fewer than a half-million deaths.

Search and seizure rules should be relaxed in favor of police, or Should they be tightened in favor of citizens?

I don't see a need for change, at least if were still properly honoring the intent of the 4th amendment. A warrant for a search is reasonable. The police do not need even less oversight. All a warrant means is that a judge considered the case the police presented and agreed that a search is necessary and approved it. The police are human beings, not godlike champions above human temptation. They already have a great deal of power. Give several hundred thousand human beings the legal right to enter and search our homes as they see fit whenever they desire and the police will become much greater threats than any criminals could ever dream of being.
I think were fast reaching the point that people fear the police more than a criminal anyway. Were not there yet but it's no longer a ridiculous idea either.

What actions can you take against the police if they knowingly file a false FIR against you and if the senior police isn't accepting your grievance regarding this matter?

We often see that Police files FIR without verifying the facts and it become difficult for innocent person who was deliberately implicated in a case.Senior officer can not cancel FIR whether true or false, they can only direct their sub ordinates to carry out fair and impartial investigation. You can get relief only from court , The High Court can quash (annul) the FIR if it think that it is biased/falsely implicated against the justice, for this you have to file writ petition as per Article 227 Constitution of India. The court can also issue stricture against the police officers if found at wrong end.In case FIR is not quashed , the police After completion of investigation of FIR file a final charge sheet before the competent court to take cognizance (action) on the case. In the charge sheet many columns are there which suggest S. No. of FIR , date/time/place of occurrence, details of complainant/accused person(s) and brief facts of investigation and outcome of investigation with supportive documents. There is a column in charge sheet if after investigation it is revealed that complaint was false information there is provision in IPC as per section 182 which sates thatFalse information, with intent to cause public servant to use his lawful power to the injury of another person.—Whoever gives to any public servant any information which he knows or believes to be false, intending thereby to cause, or knowing it to be likely that he will thereby cause, such public servant—(a) to do or omit anything which such public servant ought not to do or omit if the true state of facts respecting which such information is given were known by him, or(b) to use the lawful power of such public servant to the injury or annoyance of any person, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.but this punishment is awarded when investigation established that information was falsely given to police authority.

Should the government be allowed to seize guns from law abiding citizens? Isn’t this in violation of the second amendment? The man hasn’t committed a crime to warrant the confiscation.

Did the OP even read the story linked to this? Shape shifting neighbors, zombie Obama putting evil spirits in his head, accusations of being surveilled by the FBI? This guy is a textbook example of the kind of people who need to be proactively identified by authorities and have their guns taken away before they decide to start thinking about doing something to stop the screaming voices of the evil spirits like - I don’t know - shooting up another school? All that being said, I can see where there’s going to be a lot of potential for abuse of this kind of proactive responsiveness. I’m thinking about kids who will start “swatting” each other, calling in false threats about their classmates supposedly having rooms full of guns and planning some mass murder, then getting the parents' guns temporarily seized for no good reason except lulz or petty-minded anti-gun activism on the part of some child or self-righteous teacher who presumes that any home with a gun in it is an imminent threat to the school wherein they work or study.I’m also thinking about abuses in the family court system; soon-to-be-exes using these new laws to have a former husband’s guns seized on the basis of “He’s crazy and wants to kill me!” until the divorce is finalized, and doing this so moreso out of spite than any legitimate fear for one’s safety. There are going to be a lot of false starts with this kind of enforcement. Law enforcement officials are going to have to learn to be really discerning about these things so as not to be continuously wasting their time or impeding the rights of people who do not deserve these interventions.

What happens if you get stranded in a foreign country with no passport or money?

Unless you have entered the country illegally and lost your passport, you still are nowhere near 'game over'. When you enter a country legally with valid visa or any other requirements you are that countries guest. In case you lost passport, the first thing you need to do is go to a local police station and register a complaint of your loss of belongings including passport. Dont forget to take copy of this complint from the police as a proof, this will be required at many places. Next you need to directly go / contact your home country embassy or consulte to report loss of your passport and at the same time apply for a new passport (In Emergency Category or else you may need to spend weeks to get a passport). Most of the countries have consulte / embassies in the countries frequently visited by its citizen for business or tourism. One final note to remember during such panic situation is to not loose HOPE and tell yourself / family that this is just a unplanned event whcih we will surely / soon come out and continue our journey. This situation was just about to happen to me when i visited Malaysia (Kuala Lumpur) with my wife and kids. We were coming from Petaling Street to our Hotel in Sunaway Lagoon in a local taxi with a chinese driver who hardly understood english. As my kids were already tired and cranky in the taxi, my wife suggested me to keep all our shopping bags in the trunk which i did and almost also kept the bag containing the passports, dont know what stopped me from doing this disastrous thing. Zoom past to Sunaway area just a few blocks from our hotel we saw a indian restaurant and asked the driver to drop us there only istead of the hotel, which he did. In the moment of hurry (night time, kids tired, hunger and all) my wife and kids got down from the taxi and proceeded towards the restaurant and i promptly got down paid the driver and followed my family. Nobody has the slighest idea that we left all our shopping bags in the taxi trunk. Only realized when my son almost screamed that his toy bag is in the taxi trunk, instantly i ran back to see only the fast moving traffic on the road and that particular taxi nowhere to be seen.Phew had i kept my bag contaiing the passport in the trunk, my trip would have been most memorable for all the wrong reasons ;)

Can the government seize property without a court warrant?

Yes, but in limited circumstances.

For example, evidence can be seized without a warrant when it is incident to an otherwise lawful arrest. So as long as the arrest is valid (with or without a warrant), the associated seizure is also valid. Another common exception is contraband (obviously illegal material) that is in plain view, if the law enforcement officer is lawfully in a position to view the material.

There are other situations allowing warrantless seizure based on valid legal actions , but they start getting into procedural technicalities.

JennG is also correct about the power of the government to take real property (real estate) under the eminent domain power, with just compensation as defined in the 5th Amendment.

Can a police officer check your legal status? or only federal worker?

Ive been told that supposedly a police officer could ask you for your social security if your Hispanic like if they stop to you. Because Me and my friends are going to Miami for the summer and i don't think some of them are citizens and that rumor might scare them from traveling from NC to Miami. I really want them to go. I am a citizen. So do police officers have a right or someone with more power can like ICE?
