When A Summons Is Told To Be Served In Case Of A Private Company In India.

How do you find out if you have a court summons filed against you?

Technically, once a case has been filed against you, the court will issue notice directing you to appear before it on a specified date. In case the address that is provided by the Plaintiff (i.e., person filing the case against you) is incorrect and the notice doesn’t reach you, the Plaintiff has the option of other modes of service of notice/summons to have it held sufficient that the notice has been served on you, although you do not receive it personally, which includes paper publication and affixture. And if you would just want to confirm if any case has been filed against you inspite of there being no notice served upon you, then, you can check it online by entering your name in the court which you suspect the case might have been filed. I just got served with a Civil Warrant, whats gonna happen to me?

It's civil, not criminal. You can never go to jail for something like this, so put that worry out of your head. At the very least, respond to it. Look at the amount that they say you owe (you agree you owe something, right?) and make sure that it is correct. If they've added fees and so forth, you can dispute that, and the judge may or may not go for it. The judge won't rule that you owe more than that amount (except for court costs, maybe). Also, pay attention to the language in the complaint; a refusal to pay (which is what they've probably accused you of ) is different from a failure to pay.

The judge is going to rule that you owe them, it may just be a matter of how much. ALSO you are now in a good position to bargain with them, believe it or not (if you are in financial shape to do so). You can try to strike an agreement before they take you to court. They'll act like it's nothing to see you in court, but the truth is, they're no closer to getting their money once they get a judgment and they get to pay legal fees (and you could turn around and declare bankruptcy and then they get nothing on top of that.)

ALSO if you choose to set up a payment plan, make sure you are doing so with the original company with whom you made the agreement, not some collection agency. Be firm about this, the only way you won't be able to is if they've actually sold the debt, which is very unlikely. Do not give anyone your private bank account information either. Get the terms in writing if you choose to go this route and get it signed.
