What are your views on Modi government’s announcement of 10% reservation in jobs and education for economically weak general category?

I belong to so called upper caste and come from a semi urban background. My opinion isPROSThere are many poors in general category who will be really helped by this decision. They also needed help from government which government did.Middle middle class , upper middle class and BPL will be highly benifitted.People from rural and semi urban background will be helped more. Because 66k per month is considered a handsome salary here.If one takes advantage of reservation and get a good job his/her next generation can't enjoy the same privileges.Now generals and OBC are having reservation on the basis of income. So it is a step towards reservation on income basis.( If in future creamy layer may be introduced in ST SC criteria)People of eastern UP , Bihar, Jharkhand, West Bengal,Odisha will be benifitted more because of more economic backwardness and small size of farms. In MP, Punjab, Haryana, farm sizes are bigger.(because>5 acres is also a criteria)A milestone in the journey of Hindu unity. Reservation was the cause of resistance between Hindus. Now I can hope for better situation.CONSNow open category is only 40.5%. little more hardships for well off Generals and OBCs.People employed in unorganized sector may act to be economically backward by showing less income. (But house size and land can take care of that)Overall I welcome this step of government. But I think creamy layer should also be applied to ST SC. This is better but best will be no reservations in education.Friends please tell one thing , antonym of PRO is CON, so what is antonym of PRO -GRESS? Lol. Whats one example of a tort system?

Torts are basically something that someone else does to hurt or damage another or his property in breach of a duty which the law imposes. Compare this to a breach of contract where people agree among themselves what they will do or not do.

For example, one has a duty to drive with due care. If one drives carelessly causing damage to another person or his property, then one is liable for damages caused by that careless driving, unless the person who suffered the damage contributed to the damage. Some states follow strict contributory negligence as a bar to damages, but many states follow the idea of comparative negligence, so that a person who is 30% negligent would recover 70% of the damages suffered because of the accident.

Tort "systems" basically say that the person who causes the harm should pay for it. In Europe, for example, most people have "first party" insurance, where you basically cover yourself for automobile accidents.

We also have the idea of "strict liability" for dangerous or defective products put into the market place. Drug manufacturers and tobacco companies don't like this idea very much and try to get laws passed in Congress to protect them.

This is a pretty difficult assignment. Law students study torts for a year and it can be pretty tricky even for them.

Can a person sue state for unemployment benefits?

You are not being reasonable. First, it is unfortunate what happened to you. If you were laid off due to your disabiltiy, it may be a viiolation of federal law. So are there people who were with the company less than you in the same position who are still there and you are laid off? If so, contact EEOC or your state Commission on Equal rights for the discrimination onthe basis of disability or perception of disability.

Next, you have a right to unemployment benefits. You can receive them. I am not sure if the disability will affect your pay but you can speak to the unemployment office during your interview.

Next, you are not working so you can keep calling until you get through to them or you can send them a letter explaining that you cannot get through on the phone and do not want to be penalized by a rejection when you are eligible. Most people enjoy the phone in service. So keep calling. when you send an email message, copy yourself at the same time so you have documentation of the contact.

You will have to find a freind or someone to make that phone call. If you have a cell phone, you can call on that. Some cell phones can cost as little as $10 or $14.95 a month and be used for emergency purposes. There are few street corner phones anymore, but hopefully you have a friend whose phone you might use or perhaps there is one at church, even if it is a pay phone. Perhaps if you still have internet service, you can get a Magic Jack (see ebay) - though that is a cost especially up front but the purchase of the jack includes the first year's service and after that it is $19.95 a year. You can plug your old home phone into it.

You can't dictate how the EDD handles claims. You have a right to file and should be granted. If denied, you have a right to appeal.

As to the employer, they could have laid you off even on disability leave (unless it is insurance) if it was necessary to cut back people and you were not discriminated against on the basis of your disability. They can eliminate jobs too. they can fire people so long as not based upon the suspect characteristics of race, religion, age, national origin, some disability or perception of it, and gender.

Why do americans complain about a welfare system that doesn't even exist?

There is no social safety net. In the early 90's welfare was ended for most people. People who have kids can get it sometimes still (maybe people who hate welfare also hate the idea of kids being taken care of). The only thing a homeless person can get is foodstamps, and it's not that much. Apparently there are enough people who like seeing poverty and homelessness. There will always be some unemployment, and those who can't work have no way to live adequately, thus, as other countries have seen, welfare is a necessity in a society based on the market, unless you want homelessness and poverty to drive wages down for all (because people are willing to work for less, so everyone pays for no welfare). Sadly ironic, the states pays much more to keep people in prisons than other countries do to keep people on welfare. But too many are blinded by hate, and refuse to see that taking care of people is actually cheap and easy, but sustaining a few super rich people is hard on everyone (which some other countries avoid having, and the majority are better of cuz of it).
