Where And What Do I Need To Correct My Last Name On My 2 Daughters Birth Certificates I

I want to put my daughter two last names on her birth certificate but my question is which one goes first?

Does mine (the mom) last name go first and then the father's last name? Will she have to use both last names in all paperwork like school,job,i.d?? Im confused.

How do I fix this? My daughter's birth certificate has all the wrong info!?

My daughter was born in 2005, and I've always known her birth certificate had the wrong info, but it didn't matter much to me, because her Certificate of Live Birth has all the right info, and most places that needed it have accepted the CoLB instead. Now that I'm enrolling her from a public kindergarten to a private elementary, though, they *insist* on having the BC but are throwing a fit because the info from her transfer paperwork doesn't match. What can I do?

To detail just what is wrong:
A. Her last name. Her CoLB has her father's last name, but her BC has mine because the office where we live insisted it had to be, since we're not married.

B. Her date of birth. She was born 31.10.05 at 1:39a.m., at home with a good friend of ours who was a training but not yet certified midwife. The office here said that since there wasn't "qualified medical presence at time of birth", they could only go by the first date and time they knew the baby to be in existence, which because we waited nearly four weeks to file anything was 27.11.05 at 2:12p.m.

C. Her birthweight. Her CoLB lists her weight at birth, 6lbs. 13oz., but by the time we had her BC exam at the Health Dept., she was 8lbs. 11oz. They said the same thing.

D. The fact that she was a twin. I lost her twin in the cusp of viability, which the state I was living in at time of loss considered a pre-term birth, but the state I had moved to by the time of her birth only considered a miscarriage. My (uncertified at the time) midwife was able to confirm that there had been two babies carried at one point, so her CoLB lists her as 2nd of twins. Again, they told us the same thing... "You only have one baby to show for this birth, and it's too late to examine the placenta. She's a singleton.", and her BC lists her as first of one.

As you can see, it's ALL mixed up. How do I fix this?

Can a child have two birth certificates with different fathers name on it?

The only instance I know of for that to happen is an adoption. Our kids are adopted. When they were born, the initial birth certificate showed the names of the biological father and mother. My wife and held took guardianship of the babies as foster parents during the 7–8 month period when the bio parents could have changed their minds. When their adoptions were finalized, new birth certificates were issued showing my wife and me as parents. I think the initial birth certificates are locked up in some government office. We were not given copies. Thus, both kids have 2 birth certificates but only the latest is the legal one.

Can my husband sign my daughters birth certificate and legally become her father?

Your child is 3 and doesn't already have a birth certificate? You can't just haul it out of storage and have someone sign it, you know. That doesn't make it legal.

So to answer your question, no. Your husband can't just sign the birth certificate. Whether you like the guy or not, the man who helped you create your daughter is her father. Him taking off and not paying child support for the past 2-1/2 years makes him a bit of a sleazebag, but it doesn't erase DNA. Your daughter's father would have to sign away his parental rights before another man could become the legal father to your child. Trying to bypass the middle man (i.e., the kid's natural father) could cause a whole heap of trouble for you, including charges of fraud and possible jail time.

Contact a family law attorney tomorrow and find out what you need to do to make your husband the child's legal father...if you must. Just keep in mind that even when hubby's name is on that birth certificate (a new, amended one; not the original one she left the hospital with), it still doesn't change her DNA. Tell her the truth about her father in a kind, age-appropriate way. Don't ever try to pass off your new husband as your daughter's biological dad.

ETA: Yes, she has a birth certificate. The copy is filed with the state. Any alterations of the original, like your husband signing it, constitutes fraud. When an adoption takes place, a NEW birth certificate is issued and the old one is sealed. Even YOU can't have access to it. So for your husband to adopt your child and legally be named as her father, you'd have to go through an attorney and/or the courts. Your husband CANNOT sign the child's existing birth certificate. As I said, that's fraud and he won't be recognized by law as her father. You must go through legal channels for any changes on the birth certificate to occur.

My birth certificate name is different than my social securtity how can i change my name?

I basically had the same problem. My name was the same but was spelled differently -- one way on my birth certificate and another way on all records, dating back to when I started school. I don't know what state you were born in. Where I was born, I had to file an application for change of name on my birth certificate with (I think) the State Registrar's Office. Since all my records other than my birth certificate had the same name spelling I wanted it that way on my birth certificate. I believe I had to submit three documents giving the name I wanted to use. Submitted a copy of my marriage license, one of the children's birth certificates and school transcript. Actually when I knew what to do, it wasn't really such a task and only cost a few dollars. When all this was done, I was furnished a certified copy of my corrected birth certificate. Good luck.
