Can a real estate broker in CA sue for a commission after the close of escrow?

I am a Realtor. I agreed to sell my clients home for 0% listing commission only if they agreed to purchase another property of equal or greater value within 60 days after selling their home. It states in my contract that if they fail to purchase another property using me as their agent within 60 days that they would be required to pay a 2.5% commission for my services. Is this legal?

Unless your motivation to sell is of an extreme urgency neither option is to a sellers advantage.Let me be clear. I know nothing about the Melbourne market. My comments are based on my rather extensive transactional experience.The auction maybe a strategy to employ if it is conducted with a reserve price underpinning the sale price. That said, the brokerage and or auction platform should have the capability to drive buyer traffic to the listing.There is no value to the seller under ordinary circumstances to underprice an asset to theoretically create otherwise absent competition.Why is a standard listing with atypical marketing not a consideration in this sale? Unless there are mitigating circumstances this option has proven to be the most advantageous way for sellers to sell for the highest price.

Can a real estate agent get fired for not selling enough houses and meeting a quota?

Individuals can be a real estate agent and work for themselves (as opposed to working for a company). They don't need a company to technically call themselves "real estate agents." Hell I could get my license right now, and on top of my FT job I would be able to call myself a real estate agent.

So why would a real estate agent work for a company? Answer: companies are more respected than individuals. Would you rather go to a company which has a standard for agents, or hire some joe schmo who happens to have a license? (Additional fact: licenses are very easy to obtain when compared to other professional licenses).

To answer your question - yes, companies can fire agents if they are not up to the companies standards or if they do not sell enough homes (each company has different policies). However, if a real estate agent works for themselves, they will never be fired! Even if they never make any sales! They'll just have an income of $0.....but still technically be "employed."
