Can the US citizen stop his deportation by seeking ASYLUM or HARDSHIP WAIVER?

He has no chance.

Asylum will not be granted.

Hardship waiver also will not be granted.

He is a criminal via his bigamy. That alone would render him deported even if he were a legal resident. Once he obtained citizenship it is unlikely that alone would render him deported. But he is not a citizen nor a legal resident so he is out of luck.

Just because a criminal can find someone to marry and breed with is no reason to allow him to circumvent immigration laws.

But he also is a illegal alien. So he has a likely 10 year ban.

I would suggest his new 2nd wife decide if she wishes to leave with him or not.

Sure, there's a way he can be deported. But helping someone's deportation isn't exactly as easy as calling your local police department and complaining, and if the person is present legally it's much more difficult.

I would suggest you not support your friend if you're simply unable to do so. Transferring your frustration over toward efforts to get this guy deported is a waste of time.

Here's something else to think about--if this guy is deported, how is your friend going to possibly get a court order for child support that can be enforced? Court ordered child support doesn't extend into other countries. In terms of finances, she's better off having him here in the United States where he's subject to jurisdiction here.

Let's go ahead and save absolute demands for deportation for actual violent criminals first, then extend to others. Every single apprehension and deportation costs money, and there's only so much money to go around. While this guy might be crap for not supporting his kid and stuff, he's not exactly the biggest threat we have to society in general. I don't want your demands for this guy's deportation to come at a cost of not deporting someone else who's a larger threat.

Double no. Marriage to a US citizen does not cancel a deportation order, especially if the person was ordered deported after a sham marriage. Your niece cannot say, "But this time, it's for real!"

Your other relatives were able to get green cards because they did not have a deportation order already.

Her daughter is free to marry a US citizen, but that won't have any immediate impact on her mother's eligibility to remain in the US. You did not mention whether the deportation order carried a 10-year bar or a permanent bar. If a 10-year bar, then your niece can apply for an immigrant visa after 10 years if her daughter petitions her after marriage and eventual naturalization as a US citizen.

Even immigration reform wouldn't spare your niece deportation. She needs to leave NOW and start the 10-year bar on re-entry, so she can re-enter legally if her daughter ever becomes a US citizen and petitions her.

Many TOURISTS are non US citizens. You can't and don't deport them. Actually, it is non of your business. I can come and work for my cousin because we are related. It is work and it is not work. It is Helping out. That is legit. If he gives me a couple of bucks it is money out of his own pocket...as I am not officially employed by him. And if I entered the US with a working Visa, that means I could work for any employer because I have the necessary paperwork and would be paying taxes to your system. That is also legit.

You just can't deport anyone. There is more than one reason WHY people are not US citizens. Try and use your imagination and think about it.

The employer who hires improperly papered workers is the one who is deep in do-do.

How can you cancel a deportation order?

I need more info to answer your question. An Immigration Judge is the only one who could order deportation. And if that happened, she had to have committed a crime, and it would have had to have been a deportable offense. ( like my husband, who is in LA right now, waiting for Immigration Court). They don't just deport a person for no good reason. My husband was arrested in Nashville 4x for driving without a license. Each time he just went to traffic school and paid a fine but ICE always knew he was there and never put a hold on him. EDIT: You people need to get a little experience before answering questions like this. My friends husband was in LA WITH MY HUSBAND on a DUI offense. ICE gave him a $10,000 bond. He hired an Immigration atty who went to Immigration court with him LAST WEEK, his atty asked that his bond be lowered, WHICH HE GOT, to $3,500. He was up for DEPORTATION, HE IS HERE ILLEGALLY FROM HONDURUS, AND SHE BONDED HIM OUT. Where is he? At home, with his wife and children in NASHVILLE. You can't "cancel"it, BUT YOU CAN MOST CERTAINLY APPEAL IT.

In terms of the actual criminal trial, no. I can't see any reason for that being different. A non-citizen committing a crime can, and should, impact on their immigration status, though. A foreign country has no duty to try to reform you and help you rehabilitate - they can just deport you.I think deportation should be available even if you are acquitted if it can be proven on the balance of probabilities (even though it can't be proven beyond reasonable doubt) that you are guilty. Living in a foreign country is a privilege, not a right. The burden of proof to remove a privilege can legitimately be pretty low.
