I got caught driving more than 20 mph over the speed limit in Illinois. It's my first time and I don't want it to be on my record. What should I do?

Speeding more than 20 mph but less than 30 mph over the speed limit in Illinois requires a mandatory court appearance: you must appear before the traffic court judge even if you intend to plead guilty. In most situations, court supervision is an option for offenses of this nature. If you ask for and receive court supervision, and you comply with the terms of court supervision, the offense will be discharged (typically after four months, although this may vary depending on where you are in the state) and will not appear on your driving record. Expect to pay significant fines, probably in the neighborhood of $500 once all costs are added in, and you will almost certainly be required to attend traffic school.If you were more than 30 mph over the speed limit, court supervision is most probably not an option. Speeding over 30 mph is a serious traffic offense and may, at the prosecutor's discretion, be prosecuted as a misdemeanor for which you may be sentenced to jail (although the court would likely suspend any such sentence on a first offender). If you are in this situation, you're going to want an attorney.Really, for any offense other than a minor offense for which a court appearance is not required, you probably want an attorney who specializes in traffic cases to get advice specific to your situation. There may be ways to get the offense reduced (e.g. amending it to an "equipment violation" as suggested by Christopher Hawk) that the prosecutor has the option to agree to, but the chances of making this happen are a lot higher if you have an attorney handling the case who is familiar with the court and the prosecutor, than if you try to go it by yourself. The attorney fees will be worth it just in the long-term insurance premium savings: the average increase in insurance premiums, over time, due to a single speeding ticket in Illinois is $744.

The first question is whether you are in a county with a juvenile traffic court. If so he will have to appear in court with a parent. If not, then this will be handled the same as an adult citation. The scheduled fine (which is the maximum fine) for going more than 25 mph over the limit is $490. In regular traffic court, the fine should be close to that. In juvenile court it could be lower (it cannot be higher), but some community service might be involved. Additionally, the juvenile hearing officer could suspend his license for up to 30 days.

Traffic school is not ordinarily offered for speed more than 25 mph over the limit, but he can go to court and ask. If allowed, that will add about $50 to the fine, but will avoid the DMV point and any insurance consequences. If he cannot get traffic school, this would be one point with DMV (all speeding offenses 100 mph or under are one point). You would have to contact your insurance agent to see what effect that might have on your insurance. 1 point will not affect his provisional license with DMV, but 2 points could, should he get another citation within the next year.

BTW, there is no Veh C 22345. He was probably cited for violating Veh C 22348.

ADD: To repeat, unless your county has a juvenile traffic court (not all do), you will NOT have to appear in court with your son. If he does not get traffic school, your insurance company will know about the DMV point by simply checking the DMV records--this is not a matter of self-reporting.

What do the police do if you do not let them search your car?

I was coming home from the Casino at 3 a.m. with my friend, Ashley. It is 10 miles from my home. While driving through a town a few miles from the Casino Ashley asked if she could drive. I asked her if she had her license and she told me she did. We switched seats and she drove. Almost immediately we hit the back highway that would take us home. We got pulled over less than a mile down the road. I do not remember why we were pulled over. Turns out Ashley did not have her license it was suspended. We were sober and had nothing illegal in the car. At least I did not. I cannot speak for Ashley. Ashley also had a warrant for failure to appear for that suspended license ironically. The two officers asked if they could search the vehicle. “I do not want you to waste your time and I am very tired so no you cannot search the car” is what I said. They asked me to come to the rear of the car to chat. They told me they noticed some marks in Ashley's arms and legs where she had been picking at her skin. They asked if everything was ok. I told them she had been out of town for a week and showed up at my house that evening needing a place to stay for the night. She had a suitcase and a duffle. I told her one night would be fine as Ashley gets on my nerves with her drama. I fully expected them to arrest her and send me on my way maybe after searching the car. Nope. She got a ticket for no license and they sent us home. Ashley went straight to bed and slept for 13 in my bed. I slept on the couch for about 4 hours. The cops were totally cool and reasonable. I think that they just wanted her to be safe and did not want to take her to county 10 miles away at 3 am. They knew that her ticket gave her a court date that was a week away or so and that the warrant would be dealt with. I stayed calm and was honest and was not impaired. I was mad at Ashley for lying to me and I said as much with the cops right there but I was not yelling at her nor was I feeling angry I was so tired that I was calm. I still think the cops should have arrested her and taken her to jail that way I could have slept in my own bed. But Ashley is my friend and I love her so it was all good. The next day she was off again and I still see her from time to time. Still drama. But the cops did not care about the search of the car this time. I think they are required to ask any time they give a ticket out at 3 am.

We chased a guy driving a stolen car at speeds approaching 100 mph in the city at 3am. He wasn’t about to stop, so I shot out three of his tires while my partner drove. (things were different 45 years ago. I got a commendation for it).The thief didn’t get away.We interrupted a commercial burglary in progress at around 1 AM, wherein the bad guys did make it to their car, and we chased them on to the expressway. The puny engine in our squad car couldn’t go much over 110 mph, but the bad guys car could and they slowly left us behind. After a few miles, they hit the toll road, and we heard over the radio….”all officers in pursuit of the burglary suspect on the tollway, please stay in the right hand lanes as the State Police are coming thru on the left”. And come thru they did, at speeds above 140 mph.The burglars did not get away. And neither will you.
