I was sitting at a red light and my 93 Jeep Grand Cherokee was rear-ended. It only has minor damage and is fully drivable but the rear hatch is jamed shut.

The insurance company wan's to give me the blue book value and take my car but I know I can't replace it with one that runs as good and I can't afford to spend more on a newer car. My Jeep runs great and one that I buy for $2800 will be full of problems. How can I get them to fix the Jeep? What can I do to get some leverage here?

What will happen now is that if her insurance finds that she was liable, it will pay to repair your car. The fact that she admitted she was at fault, despite what so many people think, doesn't count and means nothing. Why? Because she doesn't get to assess fault, only insurance companies get to do that.
You may be arrested for driving uninsured and without a license but her insurance will still pay for your repairs if they determine that their insured was at fault. (If you account of the accident is accurate, It does sound like she should be found at fault)
Getting insurance now will not help you for this situation. That would be like closing the barn door after the horse got out.
By law you need your states minimum liability coverage.

They want to total it out because the cost to fix it would be more than what they figured the A.C.V of the veh would be. Since the veh is a 98 an insurance company can repair upto 100% of the value of the veh. So in the eyes of the insurance company the veh is considered a rolling total, just because of the year, and mileage most likely. You have the right to keep the veh, what they would do is still total it out on there end. If you tell them you want to keep it, they will call a local salvage yard, and see what they can get for your veh if they junked it to the salvage yard, they will then most likely deduct that from the settlement amt they give to you, if you say you want to keep. So to sum it up, they determine the actual cash value of the veh (damage,interior, exterior, etc) they will then deduct salvage value (what they could get if they sold your car to junk yard), and that would be the settlement amt. So what Im getting at is if they want to total it they'll total it, but you don't have to worry to much about a salvage title because the car is a 98, and my understanding, and training is that any veh over 8 years old, runs the risk of salvage title if totalled out by insurance company. So u can tell them you want to keep, they'll make check payable to you, and your lien holder, and you'd have to have the lien sign off on it to get it fixed at your friends shop. Or tell the adjuster that you have a shop that will fix for $2000. If there is $2000 in damage on a 98 Escort on the rear of the veh, then most likely there is suspension damage, frame damage possibly (escort is a unibody veh made out of sheet metal, so no real frame, all welded together, doesn't take much to screw them up) If that much damage I would be concerned with driving it after the fact.. Will my insurance premium increase with no fault accidents?

I met with two accidents in the last 3 mths. Both were ones where the cars hits me at the rear end of my car so it wasnt my fault at all. Both accidents were reported to my insurance company "(geico). I have never had any accidents before not have i had any tickets or violations before. I have been with geico for almost four years now. Will my premium go up on renewal? I have also heard that even if my premium may not increase, it will not even decrease upon renewal as it would have otherwise. Is this true? If yes, Is there anything I can do to prevent this?

Didn't it strike you as strange that this reckless driver tried to buy you off for a quick $200.00? Plus you have underlying injuries from the terrible trauma your body sustained. Talk to a Personal Injury Lawyer ASAP, and don't tell people you feel fine. You won't know how serious your injuries are until your body has time to start hurting.
An educated guess would be you have a 5 figure claim$ against the guy who nearly killed you.

Have you been in a car accident that wasn't your fault but you got the blame?

I have been in one where, if I did not have a dash cam, that would have happened. A guy backs up into me and says, with a smirk, it’s your fault and you cannot prove otherwise. And “Oh, my neck is hurting.” Almost always when there is front end damage on one car and rear end damage on the other the driver with front end damage is at fault. I said nothing to him but called for a cop. I let him give his story to the cop. Then I showed the cop the video. Handcuff time. His insurance company tried to get out of paying because it was deliberate but that did not fly. There was no pain and suffering to claim on my side but I do think that not at fault drivers should also be able to claim for time lost.
